Thank you for contacting us regarding the concerns of Ms. [redacted] We appreciate the opportunity to address this matter. buyers and ticket sellers. To this end, we are committed to providing the best possible customer service and maintaining a simple, transparent checkout process.Though Ms. [redacted] claim is unclear, we believe she may be referring to the show time of the event, in which case, we would like to provide clarification. Our website is completely user-driven, meaning all order details is information either selected or inputted by the customer while placing their order. When Ms. [redacted] viewed our website, she selected an event listing page for [redacted] Circus at 4:00 PM on 2/4/2017. Once selected, she navigated to the ticket listing page where the event name, date, and time are reiterated and Ms. [redacted] chose two tickets for Section: * Row: *. She continued to the order summary page that displayed her event and ticket information. After she input her email address, she continued to our Checkout page that featured an even more in-depth itemized breakdown of all ticket information and pricing details, such as the price per ticket, delivery and service fees, and total charge of $214.95 in bold text. Ms. [redacted] was required to input all necessary billing and shipping information and review her order.Since we do not own any inventory of the tickets listed for sale on our website, we are unable to provide customers with exchanges or refunds and must adhere to an “all sales are final” policy—a standard throughout the industry. Ms. [redacted] indicated that if an error occurs with a customer’s order we do not act to remedy the situation, though this is inaccurate. As stated in our policies and terms of use, “When an error is found in processing your order, you will be notified of the error and provided with available options, including the option of cancelling your order.” However, as Ms. [redacted] order did not undergo any errors, she does not qualify for a refund.Ms. [redacted] placed her order on 1/27/2017 and received her valid tickets via email on 2/2/2017 for her to print and bring to her event that took place on 2/4/2017. As Ms. [redacted] received the valid tickets for the event she selected, and her event has since passed, we consider this matter closed. If Ms. [redacted] has any additional questions, we encourage her to reach out to our customer service department.
Initial Business Response /* (1000, 5, 2015/10/09) */
We'd like to note that before this complaint was made, we spoke with Ms. [redacted] and had come to an amicable resolution for both parties. We would like to take time to address Ms. [redacted]'s concerns. We should explain that we are an...
online resale marketplace, which means we do not own or generate ticketsinstead, we merely facilitate transactions between ticket buyers and ticket sellers. This fact is noted on every ticket and checkout page and at the top of our homepage with the statement: "We are a resale marketplace. Prices may exceed face value. This site is not owned by any venue."
We find it difficult to understand why Ms. [redacted] believed she was purchasing tickets directly from the [redacted]. The above disclaimer and our branding clearly show that we are not affiliated with any venue or other ticket marketplace. And, while Ms. [redacted] takes issue with the fact that the prices of her tickets exceeded those advertised by the venue, our sales terms clearly state that prices may be above face value. Furthermore, our checkout process gave her multiple opportunities to examine the full details of her order.
When Ms. [redacted] selected tickets and was taken to our checkout page, she was directed to review her itemized order breakdown, which clearly displayed the service and delivery fees, the price per ticket, and the total price in bolded text. Ms. [redacted] was then directed to review our terms and conditionsvisible in a text box below this order totaland presented with the bolded message "All sales are final." At this point, she was also presented with the message "I agree to the sales terms and conditions. I have reviewed the Order Summary above," and a check box that she needed to click to continue with checkout. Below this check-box, another message was displayed that, in Ms. [redacted]'s case, read: "By clicking 'Place Order', your credit card will be charged the total amount, which includes ticket, service, and delivery fees." This notice was followed by a button labeled "Place Order." When Ms. [redacted] clicked this button, she signified her acknowledgement of the total price and these terms, and completed her order.
Our sales policies, including our "all sales are final" policy, are disclosed throughout the purchase processfrom a notice on every ticket page to a sales terms statement displayed at checkout with the message "All sales are final. All prices are listed in US Dollars (USD)." Additionally, all sellers on our site are notified as soon as an order for their tickets is placed, which means we are unable to cancel orders or offer refunds. While we understand Ms. [redacted]'s frustration, she was made aware of this fact, and made an educated, conscious decision to purchase tickets from our site.
As we mentioned above, we have reached a resolution with Ms. [redacted]. If Ms. [redacted] would like to discuss this matter further, we welcome her to contact a member of our management team.

transactions between ticket buyers and ticket sellers. The top of every event listing page clearly states, “We display secondary market tickets. Not affiliated with any box office or official website.” Once an event is selected customers navigate to the ticket listing page, the top of this page reiterates, “A service fee is added to ticket orders at checkout. This site not affiliated with any venue. Tickets may be above face value.” Once our customer selected the ticket listing they desired for [redacted], they were directed to the checkout page. Here customers are provided with an order summary that displays the event details, ticket location, and number of tickets the customer has selected. Our customer was prompted to provide an email address and continued to the checkout page. On this checkout page customers are presented with a complete itemized breakdown of their order on the left-hand side. This breakdown detailed the price per ticket, all fees, and the total charge of $1,296.95 in bold text prior to entering any payment information. Below this total our customers are displayed the message, “Please note: We are an independent resale marketplace. Ticket prices may exceed face value. Prices in USD.” Customers are then presented with our terms and conditions, including a bold message which clarifies, “All sales are final. All prices are listed in US Dollars (USD).” Our customer was then required to select a check box signifying their agreement to these terms. Directly above the "Place Order" button, the order total was reiterated in bold text stating, "By clicking 'Place Order,' your credit card will be charged $1,296.95 which includes ticket, service, and delivery fees" at which time our customer proceeded to place their order.Due to the nature of our business on the secondary marketplace, Tickets-Center is not affiliated with any artist or venue and do not own inventory; instead, we act as an intermediary between customers and sellers. Since our customers are purchasing tickets owned and listed by individual resellers, we must ensure that our policies are fair to both parties. This means that we are unable to offer refunds and must adhere to an “all sales are final” policy—a standard throughout the industry.Tickets-Center has reached out to our customer and offered a one-time courtesy resolution via email in the interest of customer service. As such, we consider this matter resolved. If our customer has any additional concerns relating to their order, we welcome them to contact our customer service department. Regards,Tickets-Center

"Helvetica Neue", Helvetica, Arial, sans-serif, "Helvetica Neue", Helvetica, Arial, sans-serif; font-weight: inherit; font-style: inherit; border: 0px;">Thank you for reaching out to us. Tickets-Center appreciates the opportunity to address Ms. [redacted] concerns. It should be noted that Tickets-Center operates on the secondary market; this means we do not own or generate tickets—instead, we merely facilitate transactions between ticket buyers and ticket sellers. At the top of every ticket listing page it states, “We display secondary market tickets. Not affiliated with any box office or official website.” Reiterated on the checkout page the message, “We are an independent resale marketplace. Ticket prices may exceed face value. Prices in USD. Tickets purchased in a single listing will be seated together, unless otherwise noted by the seller.” Ms. [redacted] expressed difficulty in finding our contact information though this material is readily available on our site through a “Contact Us” link containing an email address and phone number.
Our site is user-driven meaning all order details are based off of information the customer either selects or inputs. Any relevant information regarding the type of tickets or seating information is available in the Notes of any ticket listing. Ms. [redacted] order did not have any notation to indicate the tickets she purchased were handicapped accessible seating.
In regard to Ms. [redacted] concerns with the ticket price on the primary market, or face value, it should be noted that since we operate as a secondary marketplace that serves as an intermediary between sellers and customers all ticket prices are set by the sellers, not Tickets-Center. This fact is explained clearly throughout the purchase process, from a notice on every ticket listing and reiterated on the checkout page. Prior to Ms. [redacted] purchasing tickets was required to agree to our terms and conditions—visible in a text box below this order total—and presented with the bold message “All sales are final.” At this point, Ms. [redacted] was also presented with the message “I agree to the sales terms and conditions. I have reviewed the Order Summary above,” and a check box that needed to be selected in order to continue with checkout.
Because our customers are purchasing tickets owned and listed by individual resellers, we must ensure that our policies are fair to both parties. This means that we are unable to offer refunds and must adhere to an “all sales are final” policy—a standard throughout the industry.
Since Ms. [redacted] tickets were not listed as accessible seating, Tickets-Center maintains that her order was filled correctly. Ms. [redacted] received her valid tickets prior to her event, which has since passed. As such, we consider this matter closed. We encourage Ms. [redacted] to contact a member of our customer service department for any additional concerns she may have.
