These statements are for the services dated 10/21/14-11/21/14 and show that a balance of $110.73 has since been due. We have mailed these statements to [redacted]’s address of record via [redacted] for review and the account has since been placed into a cease communications status to give [redacted] time to receive and review this information. The representative updated the phone number as a “bad number” and the number was placed on our do not call list. Our records indicate no further calls have been made to ([redacted]. After reviewing our files, it has been determined that Mr. [redacted] was contacted by our office, in error, while attempting to locate another consumer. Any phone numbers and/or addresses mentioned in the complaint have been removed, and should not receive further contact from our company. This information has been obtained and mailed to Ms. [redacted]’s address of record for review. The Itemized Statements that were obtained were received directly from [redacted], which is the original creditor of Ms. [redacted]’s account. The statements are dated 08/30/2013, 09/16/2013, 11/05/2013 and 11/22/2013 and reflect the lapse of insurance coverage fee of $50.00 after the termination date of 09/21/2012. We have documented the account accordingly with Ms. [redacted]’s dispute and it remains open with our office in a cease calls status as requested. attempt to  assist with the issues mentioned in  the complaint, we have contacted our client, [redacted],  and obtained an itemized statement in an effort to validate the total charges placed with our agency for collections. This information has been forwarded to [redacted]’s address of record: [redacted]. #[redacted] for review.  The statement we have been provided is for services and unreturned equipment fee’s for the service period of 12/22/2010. The service address listed is : [redacted] and a balance  of $946.95 has since been due.   In regards to the credit bureau inquiry [redacted] provided with her complaint, we have reviewed this information and per the FCRA, a collection of an account is a permissible purpose for obtaining a credit report.  As such, EOS CCA may obtain a consumer credit report for the purpose of collecting on an account in connection with a voluntary credit transaction involving the consumer on whom the information is to be furnished.  Our records indicate that EOS CCA has not reported this account to the credit bureaus and we have placed the above account in a cease and desist status for no further contact with [redacted].  If you have any questions or concerns, please contact our Consumer Relations Department at [redacted] for further assistance. August 5, 2015   RE:          Complaint ID: [redacted] | [redacted] | EOS [redacted] #: **-[redacted]                 Original Creditor:  U.S. Department of Education | Creditor Account #: [redacted]     Dear Revdex.com:   We recently received the rejection statement for the above referenced Revdex.com complaint from Ms. [redacted], regarding her defaulted student loan with the U.S. Department of Education (ED).  The rejection statement states that the borrower does not accept that the supporting documents submitted in March were illegible,  she is frustrated that her paperwork was misfiled which has cost her thousands of dollars and the borrower also stated that she believes her account is being kept purposefully in an attempt to profit from handling fees. EOS [redacted] takes complaints of this nature seriously and we regret that the borrower was dissatisfied with our response.  According to our records, the borrower’s account was placed with our agency for collections on 6/22/14 and the balance on the account was $3923.19.  The borrower has had a total of $901.00 applied to her defaulted loan of which 10 payments were voluntary in the amount of $5 each.   In addition, an involuntary Treasury Offset Payment (TOP) in the amount of $851.00 was applied and the total amount due as of today is $2922.79.  The borrower has been certified for TOP by the Department of Education since 2012 and once an account becomes certified for an offset, that account will remain certified until the account is out of default, or inactivated as legally required by law (e.g. active bankruptcies).  The supporting documents faxed to our agency on March 24, 2015 were properly filed; however, due to the poor quality of the fax images we were not able to enroll the borrower into the rehabilitation program.  We have mailed a copy of the fax to the borrower’s mailing address in order to illustrate how the March 24th fax transmission was received.  This is a client requirement and not ours.  The client will not fund the rehabilitation with illegible documentation.   At the present time, we are unable to submit the borrower’s account for rehabilitation until we receive the required missing documents per the Financial Disclosure for Reasonable and Affordable Rehabilitation Payment guidelines. In an attempt to assist the borrower, we have mailed a new Financial Disclosure for Reasonable and Affordable Rehabilitation Payment and to provide further clarification on the paperwork that is required, the following supporting documents are needed in order to successfully enroll the borrower in the rehabilitation program:   Section 1: Borrower Identification You can use a P.O. Box as your mailing address; however, you would need to supply the zip code for your physical address as the calculation is based off your county. Section 2: Household Income and Reasonable and Necessary Monthly Expenses ·         Your employment income o   Signed copy of your Federal 1040 tax return for the most recent tax year (both pages) or a tax transcript form provided by the IRS o   Or, copies of your two (2) most recent pay stubs (they must be dated within the past 90 days) o   Or, if you are self-employed, provide either the most recent 1040 tax return or 1040-ES worksheet. ·         Other Income o   Any documentation showing the source and amount ·         Line 13: Necessary medical and dental – The borrower claimed $4200.00 is in collections; however, this line item pertains to the amount that is being paid per month o   This is not required if you spend less than $60/mo per person in your family.  If you spend more than that, provide proof of what you actually spend out of pocket on co-payments for prescription drugs, doctor visits, and other medical needs: cancelled checks and/or receipts. Statements, etc.  Providing only a bill showing the amount owed is not acceptable. ·         Line 15: Transportation –The borrower claimed $1292 a month o   Please provide a written statement indicating the number of cars that you own. For example: I _____ am responsible for # of vehicle(s). ·         Line 18: Federal student loan payments – you claimed $44.00 a month o   Current billing statement (less than 90 days) §  The proof that you sent is an account summary and not a billing statement.  A billing statement will show a recent payment history as well as monthly minimum amount due. ·         Line 19: Private Student Loan Payments – you claimed $1200.00 GI Bill Debt o   Current billing statement (less than 90 days) §  We did not receive any proof of this debt.  Please supply proof of monthly payments being made. Please note that the above are all requirements of our client, not EOS [redacted] and are related to proper compliance with Federal Regulations and Administrative Rules for compliance.  Please have the borrower contact me directly as I look forward to further assisting her with any questions or concerns and the completion of her rehabilitation program.  I am confident that we will be able to help her expedite a resolution for the borrower. In our original response to the issues mentioned in the dispute, EOS CCA provided Mr. [redacted] an itemized statement from our client, [redacted], which is the original creditor on his account. The statement was for services dated from 11/20/2012 and show that the balance of $1,313.37 and has been due since 11/20/2012.             This statement came directly from our client, and is the same statement that our client would have provided to Mr. [redacted] at the time of service. In addition, the statement EOS CCA provided to Mr. [redacted] reflects that his insurance company was also charged for a portion of the balance. Account #: [redacted]  Dear Revdex.com: We recently received the above referenced Revdex.com complaint from Ms. [redacted], regarding her defaulted student loan with the U.S. Department of Education (ED).  The complaint alleges that the borrower has faxed her application and financial documents in order to enter into the rehabilitation program; however, the PCA continues to inform the borrower that they have not received the paperwork.  The borrower also stated that her interest rate was not reduced while she was deployed in 2010.EOS [redacted] takes complaints of this nature very seriously and we regret that the borrower is dissatisfied with the manner in which the account is being administered.  EOS [redacted] has investigated the borrower’s complaint and our conclusions are set forth below. Our review shows that during a conversation on 10/20/14, the PCA rep offered the borrower the rehabilitation program based off of a preliminary financial profile.  Our representative properly informed the borrower of all necessary documents that would need to be sent to our agency in order to confirm the preliminary rehabilitation quote and on the following, day the PCA received partial documents from the borrower.  The borrower’s fax included a cover sheet, the borrower’s Financial Income Statement application and a handwritten breakdown of all monthly expenses.  The borrower did not submit proof of income, proof of necessary insurance or student loan payments that she claimed on the application.   EOS [redacted] made numerous attempts to inform the borrower of the missing documents; however, all attempts   were unsuccessful until 3/5/15.  On 3/5/15, we contacted the borrower and informed the borrower of the missing documents that were needed in order to get her enrolled into the rehabilitation program.  Our agency received additional documents from the borrower on 3/25/15; however, the copies were illegible.    EOS [redacted] attempted to contact the borrower; however, all attempts have been unsuccessful. In regards to the interest, the Private Collection Agency does not have anything to do with the accrual of interest; therefore, if the borrower believes that the interest should have ceased at the time of her deployment, she should contact the Department of Education regarding that issue.  The Department of Education can be reached at ###-###-####. In addition, on Jul 22, 2015, EOS [redacted] conducted a search on the Department of Defense database in order to confirm the borrower’s active duty status and found that the borrower had not been listed as being active.  If the borrower can provide supporting documentation related to being in the military, we will investigate this matter further.  The borrower’s account has been moved to one of our Special Assistance Unit Managers.  Her name is Jenna Keohane and she can be reached at ###-###-#### ext. After conducting a reasonable investigation of this matter, we have found that on 06/30/2016, EOS CCA received a dispute filed through the credit bureaus and in response to the dispute, we mailed itemized statements obtained from our client, [redacted], to Ms. [redacted]’s address of record for review. In addition to these statements, we forwarded the information provided in above complaint to our client, for further review.  Per their records, the account was not paid in full at the time of disconnection. According to their records, the account was disconnected on 08/22/2011 and the last payment on record was for the services through 06/16/2011. The itemized statements that were previously sent to Ms. [redacted] are the final bill for the services provided from 05/07/2011 through 09/22/2011. As a result, the residual balance of $271.90 has been due since 08/23/2011. The account remains open with our office in a temporary status that will cease communications which will allow time for Ms. [redacted] to receive and review the information.
