I am rejecting this response because: They sent the paperwork but I needed to take time off of work to file the paperwork with the county. I lost wages, $filing fee and $parking. They have an office in NJ and one of their representatives should have done this. They filed it to begin with so they should have filed the release. Without the county filing the paperwork is uselessI was told that once the system was up and running that it would back log and I would receive a credit for the months that the system was not working. Again on 10/11/I was charged an estimate. Where is my credit?? This company continues to fail in all areas

Our Fleet Performance department has attempted to reach out to the
customer to schedule an appointment A follow up email was sent after a voicemail was left on the primary contact phone number on the account The Fleet Performance will attempt to contact the customer again tomorrow We welcome the customer to reply to the email sent, with a time that would be best to contact them, so that we can ensure that contact is made
Vivint Solar has contacted the customer to discuss their concerns with production and billingThere is no compensation due for the customer as we find the system is operating normallyThe customer is receiving energy credits from their utility provider for the production of the solar panel system,
thus also confirming normality of the solar panelsThe customer's utility provider, APS, has an On-Peak and Off-Peak period, as the rates are different during both timesMost of the production occurs during the On-Peak period, and APS restrictions do not permit the customer to utilize their credits in their On-Peak bank for their Off-Peak periodThis is not something that Vivint Solar has control over, and the customer has been advised to speak with their utility provider to settle their credits with them

As outlined in Section 6(b) in the Power Purchase Agreement (iii) Seller DefaultA "Seller Default' shall mean Our failure to perform any of Our material obligations under this Agreement and the effect of such failure is not cured within thirty (30) days after You give Us written notice of such failure." And as per Section 3.A.(iv).(1) "We do not warrant or guarantee the amount of energy produced by the system for any period, any cost savings" The non functional panels do not put Vivint Solar with in the terms of seller default as we do not guarantee the amount of energy produced by the system for any periodThe days which Seller Default then is applicable begins after Vivint Solar has received written notice via certified mailOnce Vivint Solar has received official written notice from a customer, if Vivint Solar fails to initiate addressing the concern with in days, Vivint Solar is with in Seller DefaultIf Vivint Solar begins addressing the concern in that time frame, whatever action that calls for, Vivint Solar is not with in Seller DefaultAt this time, Vivint Solar has not received written notice from the customer and has continuously made efforts to address the system issue even through the need to reschedule the appointments. Vivint Solar has emailed the customer on 8/again offering personal assistance to ensure system issues are addressedTo reiterate, Section 5.D states "You hereby grant to Us and Our employees, agents, and contractors the right to access and use Your Property so that We may install, operate, and maintain the System through out the Term, enforce Our rights as to this Agreement and the System and the System interests, and take any other action reasonably necessary in connection with the construction, installation, operation, maintenance, repair, or removal of the System." Vivint Solar is with in the terms of the contract and cancellation is not an option at this timeVivint Solar will continue to attempt to work with the customer to address concerns
The customer is requesting something that is not within the terms of our agreementThe customer was provided a copy of the contract and all terms are outlinedWithin the terms of the contract is the information regarding the option to transfer the agreement to a new property owner, should the
potential owner wish to take over the remainder of the agreementThe buyout option is also outlined should the potential buy decline taking over the contractVivint Solar has offered a resolution that is within the terms of our agreement
Vivint Solar contacted the customer on 12/to inform him of his panel reinstall dateVivint Solar specialist will continue to monitor the account and ensure the panels are installed in a timely manner

Vivint Solar attempted to contact the customer on 3/to discuss their account, and left a voicemailAt this time, we are in the process of analyzing the customer's utility statements, which they have agreed to send over. Vivint Solar will continue to work with the customer until all concerns have been addressed

I am rejecting this response because: Vivint is still not addressing the issue of the panels being installed on my roof when my roof has been pass it's usable life for at least years The panels have only been on for months I even supplied them with my roof inspection report from HomeGuard that clearly states that the roof is vulnerable to leakage and way pass it's usable life I don't know what type of bogus inspection Vivint did but it clearly contradicts that actual truth about the vulnerability of my roof to leakage Also, I did call in to complain about a leak shortly after the panels were installed and Vivint sent a technician out and determined that the leak was not caused by the panels Now I question if they lying to me about that also Vivint is a untrustworthy company that deceives consumers into contracts and then traps us with their contract written in tiny illegible print I would highly recommend any who wants solar to work with anyone other than Vivint Not to mention, I scheduled the uninstall, they didn't show up on the scheduled date, showed up a day later and removed the panels without anyone being home and then try to chase me down to sign a form that I authorized the removal They even try to tell me that it's ok to have anyone sign the form What a joke Did not do business with this company if you have the choice, nothing but lies lies and more lies
