We have refunded the customer back to the card on file

On 10/14/- Select Home Warranty did advise customer to secure her own contractor as we have given pre-approval for in repairs

Section specifically states what is and isn't covered with respects to the customers claimOven/Range/Stove TopThis Agreement covers all modules, components and parts of the gas or electric oven, range and stove top necessary to the functionality of the oven, range and/or stove top.(i) Burners (ii) control boards (iii)thermostats (iv) broilers (v) temp controls (vi) heating elements (vii) igniter (viii) ignition module (ix) spark ignitersExcluded: (i) range hood; With regards to the A/C claim the customer has $left on their cap for this claimNo additional funds due at this time

We have tried reaching the customer numerous times with no responseFor help with this issue the customer mat call mr [redacted] at ###-###-#### mon-fri 9-est

We did reach out to the customer and they hung up on usThe customer laced a claim for an ac not workingWe sent a technician and the unit failed due to a shorted to ground electrical failuresThese types of issues are not covered under the termsPlease see section of the terms"This policy covers mechanical breakdowns, it does not cover shelves, door handles, doors, hinges, knobs and buttons, door seals, displays, latches, timers, leveling equipment, clogged drains or lines, cosmetic issues, gaskets, leak searches, lights, noise, refrigerants, valves, dispensers, installation, electrical failures."

Select Home Warranty is in the process of refunding the customer at this time

We can proceed with transferring the customers warranty to their new propertyCan you please confirm what the new address should be so that we may update your account accordingly? In addition, is there a new phone number that we should update on the account? Please let me know as soon as possible so that we may process your request

The cusotmer was issued a refund directly back to their credit card on 02/02/

Please refer to Section of your warranty: Garage Door OpenerThis Agreement covers the following garage door opener components: (i) control board; (ii) motors; (iii) chains; (iv) belts; (v) gears; (vi) pulley; (vii) sheave fork; (viii) axle bolts; and (ix) switchesExcluded: (i) garage doors; (ii) springs; (iii) brackets; (iv) tracks; (v) rails;Per the diagnosis received the customer needs their garage door replacedIt clearly states in the warranty contract that garage doors are NOT covered under their contractAs a courtesy however, the customer was approved $towards the repair/replacement of the door which is the maximum allowance that will be paid on this claimIn addition, should the customer wish to cancel their contract we can proceed as requested per section of their warrantyThe customer unfortunately, is not eligible for a full refund as full refunds are issued within the first days of coverageSince this customer paid for their warranty in they are no longer eligible for a full refundPlease confirm if you wish to proceed with cancelling your contract so that we may process your request accordingly

Again, Select Home Warranty has already issued a full refund back to the customers card

This customer already filed a dispute with their credit card companyNo additional funds due at this time

We spoke with the customerHis pool issue was not covered under the policyWe have approved him for a $good will reimbursement towards his claim

Please see attached invoice received from the customers technicianPer the invoice received they replaced all cracked and chipped shingles above living room areaApplied roof sealer to expose all nail headsThe customer was already informed that per section shingles are not covered under their contractThe customers claim was deniedNo additional funds due at this time

Complaint: [redacted] I am rejecting this response because:This is the same response they gave me previously, and is not acceptableThe business was highly unprofessional and misleading, and are refunding a different amount than what is owedThis is not a simple policy cancellationThe company did not uphold their end of the contract, therefore we should be refunded the full amount of unused services for the months we did not use, and no cancellation fee should be taken from that refundThey are trying to refund far less than what they owe, and have been highly unprofessional and systematically misleading and dishonest Regards, [redacted]

I do apologize but unfortunately, we do not have any technicians who are available to go out to the customers home for diagnosisWe can offer the customer one of two options, 1) approve $towards the replacement/repair of their stove of 2) have a full refund processed to the customerPlease let me know which option you prefer so we may proceed accordingly

Complaint: [redacted] I am rejecting this response because: I have been attempting to resolve this in a timely manner and I feel as if Select isn't attempting to resolve this in good faithAt this point there are options to resolve this matterThey are outlined below: 1) My preferred resolution after dealing with this matter for months, spending endless time on the phone, being forced to have a contractor come into my home to determine that the components are covered and still having to fight to have the claim paid per the contractor you retained is that Select pays the $to completely fix my garage door opening system as was outlined at the time of sale and continues to be outlined by their sales reps as being completely coveredIf Select chooses this, I will cease filing complaints and follow up with the ones I have filed to date as "resolved"2) Realizing that Select has largely been unwilling to pay for the total value of the claim despite the contractor Select hiring telling you the price, and your sales reps telling me all components are coveredI will settle with Select issuing me a check for the amount of $$for my policy + the $service feeI believe this is fair since I would not have incurred the $fee had Select issued me a refund at the time I requested it (upon realizing there was no signed and valid contract.) If this is the resolution Select prefers, I will continue filing complaints and alerting government entities of Select's fraudulent contract practices, misrepresentations at time of sale, unconscionable business practices and bad faith claims handling If neither of these options is acceptable to you, I will continue filing complaints with governmental entities to fully investigate your companies business practicesAnd if Select continues to be unreasonable in reaching a resolution, I will seek counselI have done a fair bit of case law research and have determined that according to N.JCitizen Action vSchering-Plough, Corp., N.JSuper8, 12-(AppDiv.), certifdeniedN.J(2003)And N.J.S.A56:8-(fraud in sales or advertisements), I am entitled to legal, equitable relief, treble damages and reasonable attorney’s fees, and all I need to prove is unlawful practice (ie contract over $has to be in writing and signed, intentional misrepresentation, defrauding consumer, etc.) which caused me an ascertainable loss, IE $to fix my garage door opener and components that were represented to me as coveredIf I have to seek legal counsel I will seek all of the above and punitive damages for the above referenced egregious acts Regards, [redacted]

We received the refund check today in the amount of $585.35.Thank you for your help with this processAs I stated, we don't feel they honored their end of our contract and should have refunded two full yearsWe simply needed our washing machine serviced and after a month of trying we were finally instructed to call our own service company and they would reimburse usAfter seeing all of the stories on the Revdex.com pages, I knew we would have been pro-rated in that reimbursement according to appliance age etcThis was their gameEvery scenario is like clock workI also wanted to mention that after you contacted them they tried to force a contractor to service meThey refused the job for multiple reasonsThe contractor called me to tell me why First and foremost, Select Home Warranty owed him money and he had been trying to collect and he refused to do any additional work until they paid himAnd, I was outside of his travel radius even if he would accept the job

The customer spoke with Mr*** on 11/7/and the customer was informed that we can have a technician sent out for diagnosisThe customer refused and requested to cancel their agreementThe customers contract has already been cancelled and a refund for their October 18th installment has already been refundedThe customers account is cancelledNo additional funds due at this time
