- Well-known academic studies show that burying such important details amount to deceptive marketing toward consumers
- Many Priceline Express Deals offer choices for number of beds, which further confuses consumers in choices available upon booking Express Deals
- The choice between smoking/non-smoking room is a decidedly important one, yet Priceline does not prominently warn consumers over the lack of such choices in Express Deals
- Priceline never warned consumers that such choices will not be available upon checking in
- Priceline assumed that a single King bed will be sufficient to accommodate two adults
- Priceline assumed that even smoking rooms will be acceptable to non-smokers of sensitivity
- No possible remedies were available on the night of checking in
