I am rejecting this response because:Priceline alleges that language is made available to indicate that availability is not guaranteed The separate e-mail I received, a PDF of which is attached, does not indicate that the option to add a room is subject to availability This should be expressly stated in the e-mail offering the pricing optionality, so that consumers are not mislead Otherwise, indicating that a consumer can add a room at the same rate is a misleading business practice: the consumer is baited into choosing the option, but when one clicks on the link, the pricing is switched
As an alternative to adding disclaimer language, Priceline could elect to (a) not offer this option at all, as the option is not really available to the consumer - one is simply attempting to book the same reservation again or (b) make the exercise of the option subject to a timeframe (e.g., add a room at the same rate if booked within hours), during which time Priceline, and not the consumer, bears the risk that pricing could changePriceline's response necessitates that the concept of "availability" be examined further It was clear, from visiting Priceline's webpage on the day that I attempted to exercise the option to add a room (which was hours after the initial booking), that there were rooms available, of a similar type and kind, at the same hotel, just at a higher rate Thus, this was not a question of whether Priceline would be able to windsor, ct secure a room at the hotel - they were: the exact type of room I booked was available, through Priceline's website Rather, this was a question of whether Priceline was willing to honor its pricing option From the consumer's perspective, the primary reason one would exercise the option offered by Priceline is to obtain the same pricing If Priceline is unwilling to offer the same pricing, even if the same types of rilable, then Priceline's e-mail option, and response to this complaint itself, are misleading Priceline's option is merely meant as a means of attracting customers to its website to make additional reservations, but there is no intention of ever offering the same pricing Thus, the provision of this e-mail constitutes a misleading business practice and, to protect customers, should not be allowedI am certainly sympathetic to Priceline's assertion that travel costs are dynamic However, Priceline is in the business of speculating on the costs of travel for its own profit Thus, it should bear the risk of price increases where it offers its customers certain pricing optionality Failure to do so misleads customers and constitutes bait and switch advertisingI initiated this complaint because I wish to travel with a few friends, and hoped that Priceline would honor its pricing option When Priceline was unwilling to do so, I asked that my reservation be canceled, so that I may make alternative travel arrangements Priceline was unwilling to do so, citing its terms and conditions, which I reviewed and acknowledged It is ironic that Priceline is unwilling to stand behind its pricing optionality, which it put in writing, but at the same time is unwilling to cancel my reservation and refund my payment, because of its terms and conditions
