November 19,
Dear Mr***,
Please allow me to respond to your complaint filed on October 22, 2014, with the Revdex.com of Western Pennsylvania (“Revdex.com”) regarding overdraft protection, funds availability, and Overdraft Item Fees assessed to the Spend Account ending in
*** (“Spend”) and Reserve Account ending in *** (“Reserve”) of your PNC Bank, National Association (“PNC”) Virtual WalletI appreciate the opportunity to address your concerns
In determining whether you have sufficient funds in your account to pay checks and other withdrawal items, PNC’s general practice is to consider all pending electronic transactions (including, but not limited to, point-of-sale transactions) for which PNC has received notice, even if those transactions have not yet posted to your accountPending transactions immediately impact the balance used to pay items presented for payment during nightly processingWe receive transaction information from merchants and other sources throughout the business dayAlthough pending transactions are reflected in your available balance, Overdraft Item Fees are only assessed on the posted items presented to your account against uncollected or non-sufficient funds
PNC’s general practice is to post items according to the date and time they were authorized or when PNC received notice of the transactionDetails of our policy are disclosed in the Withdrawing Money section of our Virtual Wallet Fine Print (“Account Agreement”)For your reference, additional copies of the Account Agreement and our Virtual Wallet Features and Fees are being sent to you under separate coverPursuant to PNC’s Consumer Funds Availability Policy, which can be found in the Account Agreement under the section titled Determining Availability of a Deposit, “If you make a deposit through one of our branch tellers, ATM, mobile device, remote deposit scanner or by mail before our cut-off time, we will consider that day to be the day of your depositHowever, if you make a deposit after our cut-off time or on a day that is not a business day, we will consider the deposit as being made on the next business day that we are openAdditionally, as detailed under the Initial $of Your Deposit section, “The initial $of any deposit will be available on the evening of your deposit to pay checks or items that are presented to us that evening for postingThe balance of the $100.00, if any, will be available on the first business day after the business day of your deposit for all purposesThe remaining balance of your total deposit will be available according to the availability provisions for such deposits as otherwise stated in this policy
The beginning balance in your Spend Account on September 29, 2014, was $A PNC ATM check deposit in the amount of $was made that day, of which, $was made available to pay items presented for paymentAdditionally, a Non-PNC ATM Surcharge Reimbursement of $posted, bringing your total available balance to $to pay items presentedPNC received transactions totaling $421.17, overdrawing your Spend Account by $-Subsequently, two (2) Overdraft Item Fees totaling $were assessed to your Spend Account related to ACH payments made to *** in the amount of $and *** *** in the amount of $
The beginning balance in your Reserve Account on October 17, 2014, was $On October 17, 2014, a *** transfer from *** posted in the amount of $8.55, overdrawing your Reserve Account by -$Subsequently, an Overdraft Item Fee in the amount of $was assessed to your Reserve Account on October 20, On October 20, 2014, a *** transfer in the amount of $posted to your Reserve Account with an overdrawn balanceThat item was returned and a $Returned Item (nsf) Fee was assessed
As disclosed in PNC’s Virtual Wallet Features and Fees, within the Overdraft Services Section, there is a $per day Continuous Overdraft Fee assessed each day the account remains overdrawn for or more calendar days, up to a maximum of $This fee is in addition to any other fees assessed for the overdraft
My review of your Virtual Wallet history confirms that Overdraft Item Fees, Returned Item (nsf) Fees and Continuous Overdraft Fees were appropriately assessed, as disclosed in the notices sent to your address of recordIt is PNC’s practice to refund any fee assessed as the result of a proven bank errorAs no bank error occurred, PNC respectfully declines your request for refunds
Your PNC Virtual Wallet includes Overdraft ProtectionIf you overdraw your Spend account, (the “protected account”), we will transfer money from your Reserve, Growth or other designated PNC account (the “protecting accounts”) to cover the transactions creating the overdraftFor more information, please refer to the section entitled “Overdraft Protection Agreement” within the Account Agreement
PNC Alerts, which in addition to keeping your account register up to date, recording purchases as they are made, and maintaining a positive account balance, may help to effectively manage the account and avoid the assessment of fees
Enclosed for your records are copies of the following:
• Overdraft Notices dated September 30, October 20, and October 21,
• Virtual Wallet Spend Account Statement dated October 9,
• Virtual Wallet Reserve Account Statement dated November 10,
I attempted to contact you by telephone on October and 31,2014, and by email on October 31,2014, but was unsuccessful in reaching youOn behalf of PNC, I appreciate the opportunity to clarify our positionI welcome the opportunity to further discuss your Virtual Wallet with youPlease call me toll free at ###-###-####, extension ***, which is also my direct telephone numberI am available Monday through Friday from 8:AM to 4:PM, Eastern Standard Time

I did not talk to anyone from PNC bank regarding the issue we had with the merchant account and equipment till two days ago , when I was told that PNC WON'T DO ANYTHING TO RESOLVE THE ISSUE.Furthermore I was charged additional $of early cancellation fees for years aheadBut in my contract I had an amendment that gave me the option to cancel within the first yearThat was not honored as well by the bankAt the end I am behind over $in fees and a pretty disappointed by my bank that I have dealt with and trusted for over yearsThere will be further legal actions coming up and I will definitely get some of my friends in the media involved in all that as well.Customers of that bank should be aware of the bad practices and services are being offered by employees of PNCI will be closing my business account with them ASAP!!!

We advised the consumer in our response that the loan is current, and no fees or costs were charged to her account as a result of the errorSince the customer advised that the credit bureaus have not yet adjusted their reports to show that payments were made timely, PNC submitted an additional request that the bureaus remove any delinquency reported from September through August
February 2, 2015 Good morning, we have been in contact with the customer and have provided resolution to the complaintThank you,*** ***
