We appreciate the customer contacting us regarding their concerns. We installed a bath surround for the customer in June 2007. All installations carry a one (1) year labor warranty. We were initially contacted approximately seven (7) years after installation in December 2014. We advised...
the customer at that time we no longer serviced or installed bath products. The manufacturer provides a limited lifetime warranty on the surround itself, but plumbing or other repairs are the responsibility of the customer. The customer declined to file a claim at that time. The local office spoke to the customer upon receipt of the complaint and the customer agreed to allow us to assist in filing a claim with the manufacturer.
We appreciate the customer contacting us regarding their concerns.We have inspected and have scheduled installation of the foyer. We are also scheduling replacement of the damaged door.
The customer service manager called customer and left voice mail to schedule replacement of kitchen area. We've also emailed customer to call to schedule.
We were able to reach an amicable resolution to this matter with the customer. We appreciate the feedback.

I am rejecting this response because:This phone tag is an ongoing issue! We called to complain on May 12 , then May 17th I called back and then was told that a [redacted] attempted to call me on May 15th and left a message but there NEVER a message. Ever since then its phone tag with [redacted] for only attempts to call once at day in the morning. Both me and my wife are working individuals and cannot get to the phone in the am. After several more phone tags and no one else in customer service to help us but [redacted] we are left with unresolution. We don't want replacement of the same lousy flooring, we want something put down that resembles the thousands of dollars we spent. This flooring hasn't lasted two months! According to what [redacted] has told me wife two days ago, Empire cannot provide written warranty that the ongoing issue with this floor will be fixed for we will continue this round about with Empire for years to come- we just want a resolution to the cheap flooring they sold us...
its not just the kitchen and the rips we have- its the ongoing issue of the QUALITY of flooring they supplied to us. I have pictures of what they left in my master bathroom when they first installed and what the left in the powder room. This has been nothing but a complete NIGHTMARE.

I am rejecting this response because: Empire insist that my complaints started after the pipe burst and that is not the case. My complaint is the material I chose was not installed. I was only shown the color and not able to inspect the wood. I admit the fault on my part that I should have insist so but thought I had no worries because it was Empire. No moisture test was conducted prior to the installation. I made over 5 complaints to Empire about the quality of the wood and the workmanship well before the water damage it just so happen to burst during my complaining. Empire refuse to admit the salesperson wrote down the wrong product I agreed to and insist they are correct when as the customer I have no defense against them. I feel like I am being bullied and they are twisting my complaint as to I am only complaining after the water damage when that is not the case. I am complaining that I should have gotten the product I asked for and that even after they installed the floor I had to make phone calls because their was too much glue left behind and their was a plank damaged in which the worker insist on making me agree that he had fixed it when he did not. By the time I was available for him to come back out the pipe burst. I have declined their work because they will not accept responsibility for their fault and do not wish to go thru problem after problem with these guys. Empire acts as if everything was done correctly and it was not. The moisture test was not conducted and regardless if the floor would have been saved the moisture in the house would have still been too much and they would have discovered that if they would have did it first. I am only one person asking for a refund and I see absolutely no reason why I should have to go thru so much trouble for a refund. It is clear I was overcharged for a product I did not ask for. Empire way of doing business is not what I expected. I am simply asking for compensation for Empire to accept their fault. I agreed and signed the paperwork because I just wanted to get the floor done and over with because I had some set backs and just wanted the floor completed. I really though I had contracted an honest company that I had nothing to worry about but would have been better off getting someone from Home Depot. I also checked the price of the wood and was told it was a special order because it was very thin and flimsy. I was told by the clerk the wood was $2.19 sq ft. and I had the nerve to think I was getting quality for such an expense price.

I am rejecting this response because:In addition to the full refund I also want $2500 for all the trouble and expense I have gone through since August 19, 2015. Waiting for up to 6 hours and Empire does not show up for the scheduled completion (3 times). Damage to my home: carpets had to be shampooed; the new floor had to be cleaned; walls, counters, tubs, toilets, doors and appliances had to be cleaned; toilets still need to be pulled, resealed and re-installed ( I have submitted estimates for this repair twice) litter had to be picked up from my driveway and yard. I lost time (waiting for workmen who did not show & getting estimates for the same repairs twice) at work so therefore I lost wages. Countless time spent on the phone and faxing and e-mailing only to be told they didn't have the items and had to do it all over again. Waiting for days to hear back and when I finally talked with someone at Empire they hadn't listened to the voice mail or read the e-mail and would look it up as I was on hold. The embarassment of having family and friends over for Christmas celebrations on a bare subfloor that Empire had said would be taken care of in a week and six weeks later it is still bare and then Empire reports that the job is complete without ever talking to me or returning my phone call in which I left a message telling them for the 3rd or 4th time that it was NOT complete. The aggravation and frustration of this project has been off the charts. No amount of money will take care of that. No company should be allowed to treat customers like this, hold their money and not complete a job to the customer's satisfaction.
