I am writing because Priceline charged my credit card, even though I did not enter into an agreement with PricelineI am requesting a full refund to my credit card
On June 24, 2014, I attempted to purchase three airline tickets via priceline.comUpon clicking online to purchase, I received an error message stating that the tickets could not be confirmed, and that the transaction has not been concludedI called Priceline at ***and typed in my trip number (***86)The automated message stated that the tickets could not be booked because Priceline was unable to confirm the prices with the airline, and further stated that my “credit card would not be charged.” Later that day, I received an email with the trip itineraryI then recontacted Priceline at ***4, and again entered my trip number (***86)The automated message again indicated that the tickets could not be booked and that my “credit card would not be charged.”
On June 30, 2014, I noticed that my credit card had been charged the price of the three tickets, in addition to a $charge (I do not know what that charge represents)I called ***and spoke to ***, then *** and then manager ***I explained the situation*** said that "for reasons out of our control," sometimes it takes as long as minutes to confirm a reservation, and that I “had not waited long enough to see if it went through.” However, in this case, the contract was not entered into because Priceline was unable to confirm the transaction online, and informed me that Priceline could not confirm the tickets with the airline and that my “credit card would not be charged.” Therefore, after rejecting my offer, Priceline cannot subsequently accept the offer and insist that a contract was formedAt no time during the transaction was it ever communicated to me that I was expected to wait minutes, as manager *** suggested, to see if the transaction went throughUpon receiving a rejection message, and after being informed by Priceline at ***that the tickets could not be booked and that my “credit card would not be charged,” I reasonably concluded that there was no contract for purchase
Manager *** also said that subsequent to the transaction at issue, he saw in the system that I attempted to book tickets two more times, and that those attempts were rejectedAt no time did I receive any communication stating that the transaction had been completedTo the contrary, I was told on June over the phone that Priceline had been unable to book the tickets and that "credit card would not be charged." *** also acknowledged that he could see in the system that I had made two additional attempts to book tickets after the first attempt, which had apparently "been accepted." Why would I continue to try to book tickets if the first attempt had been accepted? When I asked *** this question, he of course had no answerIn sum, Priceline offered no relief, telling me that I would only be able to pay fees to change the date of the tickets
I had also attempted to contact Priceline’s Customer Service Department via its online messaging systemOn July 1, I received an email from *** *(travel inquiry # ***), indicating that Priceline acknowledged that I was “not aware of the reservation.” Obviously, Priceline acknowledges that I was unaware that any agreement for payment was reached
