Complaint: [redacted]I am rejecting this response because:  the company stated they gave me credit for my inconvenience. This never happened, to the best of my knowledge. They gave me the run around from the start. I believe the shoes must be mismarked and I am used to a European size 40 being a size 9. The [redacted] size chart listed a [redacted] size 40 as a 9. The shoes are quite simply the wrong size.

The sale of counterfeit items is strictly prohibited and against the Federal Law. We really want to protect Poshmark users from the potential legal ramifications of buying or selling counterfeit products. Any one of the following could result in up to $2,000,000 in fines and/or up to 10 years in prison:
 
(1) conspiring to traffic in counterfeit goods, in violation of Title 18, United States Code, Section 371; (2) trafficking in counterfeit goods, in violation of Title 18, United States Code, Section 2320(a); and (3) concealing and selling imported counterfeit goods, in violation of Title 18, United States Code, Section 545.
 
Therefore, the team has issued the buyer a prepaid return label to ship the item back to the seller and will not be allowing the buyer to repurchase the item. The team is closely monitoring this order due to the counterfeit nature of the item.

Going forward, what is POSHMARK going to do to discourage hundreds, if not thousands, of sellers from posting misleading ads and causing frustration to the buyers, because as I stated before I made several orders through POSHMARK that resulted in items not matching their description. Can I trade on Poshmark?
Trading is allowed on Poshmark. However, our Posh Protect policy does not cover trades within the system and the buyer must pay the standard shipping fee for such trades. When payment for the full value of items is not exchanged through the Poshmark system, we cannot guarantee that both parties will ship their items to each other as promised or as described. Trading is based on an honor system and is difficult for us to support. For this reason, we discourage users from trading on Poshmark as they are not protected.
I completely understand I am not protected by Posh when trading or making a deal.  However, in this instance it's not the person that I had the deal with that is not fulfilling her end. THIS IS ALL ON POSHMARK. I would have no complaint if the person had not fulfilled her end! And those photos weren't proof of me harassing a specific person.  That just confirmed the story I already told. I used pictures that did not belong to the person that was using them, I did not list her name within MY listing, and she is still using Posh. So this is just confirming my opinion, Posh is protecting the scammers and the honest users are being punished. Why had I been allowed to sell for over 6mo and then my account was shut down without warning? I also would have no complaint if I hadn't been allowed back at all! But due to your "very accurate system" I was allowed back, that makes no sense. Or if I had at least had a warning that my closet would be closed then I could've messaged my buyer to finish our transaction outside of Posh.  I am not asking to use your platform to sell my things anymore, I am just asking for my order to be fulfilled. I would also ask that the customer service have more training in handling reputable sellers. There is no phone number to call with an actual person, if you do call you just get a voice mail and never get a call back.  And trying to handle the problem through email is just as bad, it takes days to get a generic response that doesn't apply to YOUR specific problem. Time and time again I am seeing you side with the scammer and not the person that is actually honest and making you a profit.Sincerely,[redacted]

Our records show that this seller was issued a warning for selling counterfeit items. They continued to list and sell counterfeit items and were suspended on March 29, 2018. They reinstated their account through our system's process on March 30, 2018. At that time they agreed that any further...

violations would result in permanet restriction. On April 14, 2018 it was detected that they were still selling counterfeit items and as a result their account has been permanently restricted from our system.

Upon looking into the dispute, the team was unable to determine whether the item was sent out in the condition reported. The disputed areas were not visible on the seller’s listing, meaning that there is no record of condition prior to shipment. A member of our disputes team did request additional photos of the item from before it was shipped on [redacted] but has not received any additional photos to date. Our team did add $** in Posh credit to the seller’s account.

Our Posh Protect policy states that we will give the buyer a full refund if your item never ships or does not match the listing description. Otherwise, all sales are final. Our disputes team compared the listing photos and description with the buyer’s complaint. However, because no measurements...

Complaint:[redacted]I am rejecting this response because: First, I already sent 9 pictures. Two there is no way for me to make a white patent material as clear as a black patent material- no amount of additional pictures can help with that- the color is the color. Three, I looked at the pictures I sent and you can see the scuffs- if you make a small effort to look. Four the request to send additional pictures was over mother's day weekend. Which would lead me to believe the request was an effort to stall because they had no intention of returning my monies in the first place. Additionally, I have spoken to other "Poshers" (people who buy and sell on POSHMARK)who have said they have gone through the same pains with this company to abide by its own return policy. Nine pictures were more than sufficient to return my monies and for me to return the item to the seller. Whom, by the way advertised the item as New with Tags- it is not or there is a manufacturer defect that was not disclosed- nor does POSHMARK have any intention of addressing the issue. This company is too busy trying to abort their own return policy. I work for my money and I don't deserve junk. So when I spend my money I expect to get what is advertised or my monies back. POSHMARK no doubt believes because they have seen my picture that I don't deserve customer care and have not even offered to give me credit for my useless purchase. Yes, I reported them to [redacted] as well because $* of the $** I spent on the garbage that was sent to me came from there the other $[redacted] came from monies I earned on POSHMARK (which get this you have to jump through hoops to get= your earnings from your things you have to jump through hoops to get in another form other than cedit on their website-WHAT A SCAM). All I ask is for my money back I still have the faulty product in the box and tissue paper it was sent to me in BECAUSE I CANNOT USE IT, IT IS DAMAGED UPON ARRIVAL! Which I told them upon arrival.
