I am rejecting this response because: GM is not looking at the documentation submittedThere was no possible way for us to know that the May payment did not go throughThe evidence clearly shows that a payment was made with a transaction numberThis is the only thing that is available on the website as far as history is concernedThere were no phone calls to notify us, and absolutely no correspondence that something was wrong until after the fact of reporting this to the credit bureau. In addition, we are using the same account that was provided for May and there was nothing wrong with June, July or August payments, unless there is problem with the beginning of the accountWe can not tell anything from this websiteIt is not user friendly and not conducive for communication. If this can not be resolved through Revdex.com, we will continue to seek other ways to rectify GM's misinformation and communication in regards to our account

Complaint: ***
I am rejecting this response because I never received the title from GM Financial. Can GM Financial provide me with proof that it sent me the title back in February? It gave me tracking info for the signed lien waiver in April but has not yet proved it sent me the title by giving me the delivery tracking/proof of delivery information for February. I believe GM Financial sent it to a third party by mistake back in February, because that is what GM Financial told me (at least once by supervisor *** * ***) in March. I never got the title back in February and GM Financial wants me to pay money to get a duplicate title through getmycartitle.com. I should not have to pay GM Financial for a duplicate title

Thank you very much for your very detailed responseAgain, I submit to you that you have incurred no costs for these late fees and did not in my mind make a good effort to advise me that the title was not being releasedAt the very least I would have accepted this had you sent a registered letter but you did notThe fact of this matter is that I no longer want the car due to mechanical issuesSince you are not willing to release the title, you are still the "legal" owner of the vehicleYou have made this clear in your statementsPlease advise where I can deliver the car for you to take possession of it .

Dear Ms***,
Thank you for the additional correspondence sent to the Revdex.comI have reviewed your concerns and would like to offer the following informationThe contract is a simple interest contract which means interest accrues daily on the unpaid principal balanceThe Total Sale Price shown in the Truth-In-Lending Disclosures on the face of your contract assumes that all payments will be made as scheduledThe actual amount you will pay may be more or less depending on your payment record
In review of the account activity and payment history, more of your monthly payments were applied to accrued interest due to payments being made after the scheduled due datePlease note that throughout the time that the account has been active, six deferments have been processed per your request for the months of February and March of 2007, October and November of 2007, and May and June of Please understand that when a payment is deferred or delinquent, interest still continues to accrue
If you have any further questions or are in need of additional assistance regarding this matter, please contact GM Financial at ***
Sincerely,
GM Financial

I am rejecting this response because: The following statement: "Our records reflect that you have not been reported to the credit bureaus for any late payments" is inconsistent with (1) statements made by GM Financial employees in phone correspondence and (2) what the credit bureaus currently reflectAttached are PDFs reflecting the status of my GM Account with both Equifax and TransUnionBoth credit bureaus reflect GM financial reporting last on June 16th Further, when I spoke with GM Financial previous to filing complaints the representative on the phone confirmed that it was GM Financial's policy to start and continue negative credit reporting until the issue you had working with the dealership to obtain the paperwork you needed was resolvedShe alleged that this policy was a precaution against the wild possibility that I may somehow still possess the vehicle (despite the fact that the dealership called on multiple occasions, including on the day of turn in, to confirm that they had the vehicle)Ironically, GM Financial customer service representatives acknowledged they had that information from the dealership - but that there were issues with the paperwork between GM Financial and the dealershipAs a matter of fact, it was that conversation that prompted me to file this complaint; because that policy is in violation of my rightsGM Financial reported a missed payment in May and is reporting a worst payment status of 60-DaysI have never missed a payment nor have I ever made a payment late. All payments were made on time; my account was paid up thru April 15thVehicle was remitted to the dealership on March 20thThe nearly month delay for GM Financial and the dealership to effectively work together towards resolution (still unresolved as reflected by attached credit reporting) is unacceptableThe fact that both credit bureaus report late and missed payment and your records allegedly show otherwise is evidence that your "records" are incorrect and/or not in sync with your reporting (and thus your IT system is technically incompetent) or - you are being dishonest; either of which is unsatisfactory.GM Financial may be advised that I have documented this entire episodeAs an active duty military service member I do not have to be represented by a private litigatorCivil penalties for SCRA violations (which this is) are enforced by the U.SDepartment of JusticeCivil penalties are $55,for the first violation and $110,for subsequent violationsThis violation is being actively pursued via routine legal methods (from the Department of Defense) to the Department of Justice.GM Financial's inept policy of negative credit reporting has held my credit hostage and en***gered my security clearanceTo date these issues have not been resolved; (1) My credit reporting is still incorrect, (2) I have not received an official apology from GM Financial, (3) nor has GM Financial made any offers of financial restitution. If these issues are fully resolved I will consider rescinding my complaint (and pursuit thereof) with the Department of Justice.Regards,

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID ***, and find that this resolution is satisfactory to me.I would also like to add that if there was derogatory information to report, I believe that would have been reported with no problem and if GM financial is making updates to their system, some type of communication should be made with their customers so that we are aware and can make adjustments and arrangements if we need to Just like customers are expected to communicate, the companies should do the same
