Initial Business Response /* (1000, 5, 2015/11/03) */
Hello,
Upon further investigation, a member of Square's Compliance Team recently conducted a review of your Square account and after further review, it was determined that excessive prepaid card transactions were processed with your Square...
account. This activity is a violation of the Square Seller Agreement.
According to Section 47 of Square's Seller Agreement: "All transactions taken with Square must represent a bonafide sale of a good our service. Excessive gift card use is an indication of a violation of this term. "47. Representation and Warranties. You represent and warrant to us that: (a) you are at least eighteen (18) years of age; (b) you are eligible to register and use the Services and have the right, power, and ability to enter into and perform under this Agreement; (c) the name identified by you when you registered is your name or business name under which you sell goods and services; (d) any sales transaction submitted by you will represent a bona fide sale by you; (e) any sales transactions submitted by you will accurately describe the goods and/or services sold and delivered to a purchaser; (f) you will fulfill all of your obligations to each customer for which you submit a transaction and will resolve any consumer dispute or complaint directly with the purchaser; (g) you and all transactions initiated by you will comply with all federal, state, and local laws, rules, and regulations applicable to you and/or your business, including any applicable tax laws and regulations; (h) except in the ordinary course of business, no sales transaction submitted by you through the Services will represent a sale to any principal, partner, proprietor, or owner of your entity; (i) you will not use the Services, directly or indirectly, for any fraudulent undertaking or in any manner so as to interfere with the operation of the Services; (j) your use of the Services will be in compliance with this Agreement."
Furthermore, Section 42. Suspension or Termination by Us states "We may terminate this Agreement and close your Square Account for any reason or no reason at any time upon notice to you. We may also suspend the Services and access to your Square Account (including the funds in your Square Account) if you (a) have violated the terms of this Agreement, any other agreement you have with Square, or Square's policies, (b) pose an unacceptable credit or fraud risk to us, or (c) provide any false, incomplete, inaccurate, or misleading information or otherwise engage in fraudulent or illegal conduct."
The decision to deactivate your account is final. For security purposes, Square cannot disclose further details regarding the reason for account deactivation.
Initial Consumer Rebuttal /* (3000, 7, 2015/11/04) */
(The consumer indicated he/she DID NOT accept the response from the business.)
First, I don't care that my Square account has been deactivated. My concern is the theft of my money with no explanation nor appeal process.
There is absolutely NO MENTION anywhere in the Square Seller Agreement of "excessive prepaid card transactions" nor does it mention what exactly "excessive" means.
Section 47 of the Square Seller Agreement says (as of 11/4/15 at 9:03 AM Eastern time):
47. Representation and Warranties
You represent and warrant to us that: (a) you are at least eighteen (18) years of age; (b) you are eligible to register and use the Services and have the right, power, and ability to enter into and perform under this Agreement; (c) the name identified by you when you registered is your name or business name under which you sell goods and services; (d) any sales transaction submitted by you will represent a bona fide sale by you; (e) any sales transactions submitted by you will accurately describe the goods and/or services sold and delivered to a purchaser; (f) you will fulfill all of your obligations to each Buyer for which you submit a transaction and will resolve any consumer dispute or complaint directly with the purchaser; (g) you and all transactions initiated by you will comply with all federal, state, and local laws, rules, and regulations applicable to you and/or your business and employees, including any applicable tax, wage and hour, and tip laws and regulations; (h) except in the ordinary course of business, no transaction submitted by you through the Services will represent a sale to any principal, partner, proprietor, or owner of your entity; (i) you will not use the Services, directly or indirectly, for any fraudulent undertaking or in any manner so as to interfere with the operation of the Services; (j) no transaction submitted by you through the Services will involve your Cards (except for reasonable test swipes); and (k) your use of the Services will be in compliance with this Agreement.
All of my transactions are in compliance with the published agreement. As for Section 42, nothing I have done specifically falls into their problem list so they use this catch-all to steal my money and simply refer to Section 42 as the reason, which is really no reason at all.
And then on their Revdex.com response above they say "For security purposes, Square cannot disclose further details regarding the reason for account deactivation." Come on Square - this is my money and my situation - why can't you be honest and open with me and everyone else? I give you permission to tell them everything! Stop hiding behind these T&Cs that you keep making up as you go along.
Again, I don't care that Square terminated my account. My concern is that they STOLE $2000 from me and do not provide any way to contact them, appeal the decision, or any other form of recourse.
Final Business Response /* (4000, 9, 2015/11/17) */
According to Square's Merchant User Agreement Article 42. Suspension or Termination by Us: "We may terminate this Agreement and close your Square Account for any reason or no reason at any time upon notice to you. The decision to deactivate your account is final. Any funds currently in your account will be held for 90 days. If you do not wish to wait the 90 days, you may issue a refund at any time within 60 days of the date of the transaction. Final Consumer Response /* (4200, 13, 2015/11/19) */
(The consumer indicated he/she DID NOT accept the response from the business.)
They haven't proposed any sort of resolution - it's like they simply copy & pasted all the previous emails. Square still has not provided any details on what I did wrong, they simply refer to the catch-all paragraph in their user agreement that says they can do whatever they want for whatever reason they want. Beyond this, the even worse part (besides stealing my money) is that they don'r provide an appeal process or a way to contact them and discuss the problem. Their word is final and they won't listen to reason or discuss options. An absolutely horrible company with disgusting business practices.
I spoke to my bank and they have not received any funds. They informed mme that it only takes 3 to 7 business days to process. It has been nine business day, so my assumption is my bank has not received any fund. I can not express how imperative I receive my fund quicker then 45 days. Again this is my rent we are speaking of.Complaint: [redacted]I am rejecting this response because:Sincerely,Roberta [redacted]
Revdex.com:I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me. Sincerely, [redacted]

Complaint: [redacted]I am rejecting this response because:
i'm wondering if anyone on a human level is going to step in here. As you can see all of the letters that are sent over our form letters. There's no personal explanation relating to my personal situation with square! This company is defrauding thousands of consumers as you can see by the information that I have sent over. This is not an isolated incident I sent over 56 documented instances where they are doing the exact same thing to other consumers. They do not have a telephone line where anybody can reach them how is this legal? They are able to take your money, not provide answers and hold it apparently for as long as they see fit! As of today I have sent over a statement validating each and everyone of those charges. These charges have been Valerie dated directly with the credit card that was charged! Releasing funds for these charges should not be an issue because all charges from the date that I began doing business with Square have been validated through the credit card company therefore no charges will be disputed! Now can you tell me what is preventing this company from releasing my funds immediately? They claim there maybe chargebacks? How is that possible when I sent over a letter straight from Citibank stating that all charges each and everyone of them are lifted have been validated by the customer. This company is operating way outside corporate standards and to be handling small businesses money and slapping holds where ever they see fit because they don't have money to pay their bills is a travesty and I hope the Revdex.com is going to step in and take action! As I mentioned, I have also reported this matter to every entity that I could possibly find. I want immediate action taken this company is fraudulent they do not have staff to adequately answer calls and thousands on top of thousands of people have been affected by their fraudulent business practices! I have spoken to at least eight individuals Who also owns small businesses and have had the same issues with square. Why is it OK for square to use our money as operating expense money and slap irrelevant holds on business accounts. How is the Revdex.com allowing this? I will not except a response until I receive a telephone call from a human being that works with square, I want this matter dealt with appropriately, you took my money now the least you can do is return a phone call! Your company is fraudulent and operates by its own set of laws and you came across the wrong person because I will see to it that you are find for your illegal business practices.
Sincerely,[redacted] Tatenco

Initial Consumer Rebuttal /* (3000, 7, 2015/09/30) */
(The consumer indicated he/she DID NOT accept the response from the business.)
'For any reason', is not acceptable. I was on the phone with Square customer service to many times, and if my deposit account needed to be changed, then they had ample time to tell me what I was doing that wasn't correct or needed to be changed. All of my transactions, have been completely in the same pattern. Their policies are very general, and they seem to be doing this at random and probably have some financial problems on their end. I will not accept there vague explanations. I have done nothing wrong, and classes are complete and I have obligations. What they are doing is very unethical. And to have no one speak to me, and they are making money off of what they are holding and the charges to me from my transactions. This is insane!!! And I have contacted the FTC and the attorney generals office. I have nothing to hide This money needs to be deposited immediately

Final Consumer Response /* (4200, 13, 2015/10/15) */
(The consumer indicated he/she DID NOT accept the response from the business.)
They CAN NOT give a valid reason as to why they are holding $28,315.00. I have had a total of 107 transactions with them totalling $101,243.00, from January 1, 2015- October 15, 2015. I have had 1 partial refund of $500.00, which was done in May of 2015. I can not imagine what prompted them to hold my money for 90 days, and not be able to give me a valid reason. I believe they do not have the money to pay out. I did receive the ridiculous letter their attorney gave to my Attorney Generals office, and on the last line of the letter, it stated they would release my money after the 90 day hold, IF I did not receive any charge backs. This letter was also provided to the District Attorney in San Francisco. These excuses are not valid reasons, and I DO NOT ACCEPT THIS
Refunds are available within 60 days of the original payment. To process a refund, log in to the Square dashboard. Use the date selector tool to locate the specific payment. Click the payment you'd like to refund, then click "Issue Refund". Select the reason you're refunding the payment, and click...
