According to Square's Merchant User Agreement Article 42. Suspension or Termination by Us: "We may terminate this Agreement and close your Square Account for any reason or no reason at any time upon notice to you. We may also suspend the...
Services and access to your Square Account (including the funds in your Square Account) if you (a) have violated the terms of this Agreement, any other agreement you have with Square, or Square's policies, (b) pose an unacceptable credit or fraud risk to us, or (c) provide any false, incomplete, inaccurate, or misleading information or otherwise engage in fraudulent or illegal conduct." The decision to deactivate your account is final.
Initial Consumer Rebuttal /* (3000, 7, 2016/01/25) */
(The consumer indicated he/she DID NOT accept the response from the business.)
This may be their "legal" way of dealing with issues like this but just quoting to me that they can terminate any person at any time, is horrible customer service. I did not violate any of their terms and they still will not call me or give me an explanation. I still have not been able to collect the original funds from my customers so I am going on two weeks without being paid. At the very least, I want someone to call me and explain in person why I was terminated.
Final Consumer Response /* (3000, 13, 2016/02/05) */
(The consumer indicated he/she DID NOT accept the response from the business.)
I had an active account. They terminated me so that they wouldn't have to talk to me on the phone. I think as long as I have an account I can access online and as long as they are holding funds, I would consider that active enough to provide phone support, or at least a live person to tell my why they terminated my account other than "see this section of the user agreement" which says they can terminate for no reason.
Final Business Response /* (4000, 15, 2016/02/10) */
Please refer to the email correspondence between you and Square from 1/8/16. The message states: "Currently phone support is only available for customers with an active Square account. For more information regarding account terminations, please visit https://squareup.com/legal/ua. We understand that it can be frustrating to have your account deactivated. Unfortunately, our review found that we cannot support any Square accounts for you or your business."
Square's Account Services team reviewed your account and found a pattern of transactions associated with high-risk activity. For further information about Square’s policies, you can review section 36 of the Square Payment Terms. Square regrets to inform you that from the date which you were given...
notice of your deactivation, you will no longer be able to process transactions using Square. Any funds currently in your account will be held for 90 days from the date of deactivation before being released to your linked bank account. If you’d prefer to receive funds more quickly, you should consider refunding the payments back to the original cards and seeking alternate forms of payment. (Please note that Square will refund all the fees, too. Refunds are available within 60 days of the original payment. To process a refund, log in to the Square dashboard. Use the date selector tool to locate the specific payment. Click the payment you'd like to refund, then click "Issue Refund". Select the reason you're refunding the payment, and click "Issue Refund." Please see Sections 12, 14, 18 and 19 of Square's Payment Terms for more relevant information about this process.

Hello [redacted],
Square received the Order to Withhold back in October 2014. At this time, you were provided with detailed resolution instructions including the direct name and phone number of the Franchise Tax Board representative for your...
case, along with Square's direct fax number to issue a release.
Upon further investigation, it appears that Square was able to locate your Franchise Tax Board agent for a release in June of 2015. Square then removed the hold on your account on June 16th, 2015.
Please note that Square's Tax Operations team does not currently provide live phone support. The issue has now been resolved, but if you have further questions please address them directly to the email last sent to you by Square.
Square reserves the right to place funds on hold within your Square balance in accordance with Article 42 of the Square Seller Agreement. Square does not collect interest on any held funds at any time.
Initial Consumer Rebuttal /* (3000, 7, 2015/06/26) */
(The consumer indicated he/she DID NOT accept the response from the business.)
Thank you for returning the funds to my account. However, this issue was resolved well before June, 2015 and when attempting to contact SQUARE to RE-RESOLVE the issuethere is NO WAY TO CONTACT A LIVE PERSON.
The FTB agent stated SQUARE does NOT LIST CONTACT INFORMATION (like all other credit card processing companies, banks, institutions) and this made the process of getting the funds returned to my bank account much more complicated then it should have been.
When you're 'handling' or 'processing' someone else's LIVELIHOOD...emailing and/or HELP FORUMS is not the place to direct your customers.
I also believe I have a right to know where was that money sitting for the duration SQUARE wasn't depositing it? Escrow? Interest-accruing account? I think these are fair questions.
SQUARE goes out of it's way for customers TO RATE their CUSTOMER EXPERIENCE and can track customers (and retailers)...so why isn't there the same transparency when it comes to TECH SUPPORT w/SQUARE?
THAT is the main point of my complaint. The fact that SQUARE is inconsistent w/timeframes for 'holds' is clearly problematic if you're a SQUARE customer...and to inquire as to where is ANY MONEY sitting before it hits your bank account is a FAIR and reasonable question to ask to have answered.
I look forward to hearing from you and would expect a TOLL FREE NUMBER going as directly to a customer support 'expert' (SQUARE was designed and marketed FIRST to MAC owners...imagine if business platforms running on MAC/APPLE had a tech issue and could only reach TECH SUPPORT via email? That's insane.
I see SQUARE's need to make simple day-to-day issues involving their client's sales = resources to be highly irresponsible and a questionable business practice.
Thank you for taking the time to address these SPECIFIC ISSUES.
All the best,
[redacted]

Initial Consumer Rebuttal /* (3000, 7, 2015/08/21) */
(The consumer indicated he/she DID NOT accept the response from the business.)
Square has responded through email twice and each time they requested more information. The questions have not addressed the issues of why I am not receiving the money that is owed to me. I wish an explanation would be given. It seems as though they are just biding time. This process is starting to hinder my business. I want an explanation from square, why all of a sudden they want to hold the money when I have been doing business for at least two months with Square. Why hold it now? At thiis time of response the email most recently received and responded back to states square would respond back to me within 1-2 business days. It has now been 3-4 days.
Final Business Response /* (4000, 9, 2015/09/08) */
Hello,
Upon further investigation, it appears that a member from Square's Compliance Team reviewed the information you provided and removed the deferred payout status on your account.
Additionally, Article 19 of Square's Seller Agreement states: "At any time and from time to time, we may temporarily suspend or delay payments to you and/or designate an amount of funds that you must maintain in your Square Account or in a separate reserve account (a "Reserve") to secure the performance of your payment obligations under this Agreement."

Complaint: [redacted]I am rejecting this response because: The $[redacted] that was debited from my credit card was never given to the merchant. Square made the merchant send invoices and business documentation to prove the transaction was legit and they deemed the transaction invalid stating it violated their policies. They never gave the $[redacted] to the merchant. I am unable to get a refund from the merchant because they do not have the money. Square did not release the funds to. [redacted]. I contacted the merchant and they are not able to process a refund on Square's system. Please see to it that Square gives me my money back.

Complaint: [redacted]I am rejecting this response because:There is no reason to deactivate an account that is in good standing. I have hundreds of satisfied customers that can attest to my business practices.Sincerely,[redacted]
Complaint: [redacted]I am rejecting this response because:
I opened this square account several years ago, my sales email of[redacted] , no phone number was used or required to open the account. Sincerely,[redacted]
The final deposit was credited to your linked bank account on 3/25/16. Please refer to the latest email correspondence between you and Square with any additional questions.
Complaint: [redacted]Bottom line, based on their own statements here are the possible options that I can understand:1) At [redacted] (first transfer), her account was NOT in good standing and none of the payments should have been allowed.OR2) At 12:04am (first transfer), her account was in good standing and all the payments should have been allowed. If at any time after 12:04am her account went into a NOT good standing status, the payments after that point should have been cancelled. Even if her account went into bad standing right at 12:14, only $** should have been cancelled. The email notices for payments were delayed only about a few minutes, but I did not receive any notices about the payments being cancelled until 1:23am, just an hour after all the transactions were done. This would seem to imply that her account status was in good standing at the time of the transactions, and did not change until after they were complete. If the account went a NOT good status after all the transactions were complete, then all transactions should have been cancelled or they all should have been left alone. The companies own response contradicts the facts of this situation. This leads me to believe that Square Cash failed to follow its own protections/procedures, causing me to lose $** in the process. This is why, in my desired settlement, my item #3 addresses Square Cash fixing the process. In the Square Cash response, I would like to know exactly what time her account was no longer in a good status.** Regarding the closure of my account due to it being "high risk" **I have used my account primarily for referrals and family transfers. I have not done any activities that I would consider risky, and the only reason I can determine this action was taken was due to the ongoing dispute over the $**. Unless there is a legal / criminal action being pursued, Square Cash should be able to disclose details but instead they refuse to and made the decision final. In the interest of open communications with the customers it provides, the stance of not disclosing details is unfair to the consumer. Imagine if the legal system took the same approach - you could be put in jail or fined, but when you ask why you are simply told to go read all the laws. Not only did my account closing impact my ability to use the service but also impacted existing referrals I had pending. The referral program provides $** per referral, and by deactivating my account Square Cash still benefited from the referrals (by gaining users) without providing the compensation the referral program offers. This, again, is an unfair business practice by Square Cash. Unfortunately I am not able to include that in my dispute amount because I do not know how much was lost unless Square Cash tells me.
Sincerely,[redacted]
