I am rejecting this response because: The manager who signed me up claimed he was going to waive my enrollment fee since I was referred by another member. He also never mentioned the annual service charge. Someone placed in a management position should be able to explain all of this to me rather than sweet talk me into signing up by neglecting to inform me of their financial policies. This is a scam, and I want all of my money back.

I am rejecting this response because: I fail to see why you did not attempt to contact me. And why would I go in to cancel something I had not signed up for. And you can't wave charges because you turned me over to collections and I was told that at that time you cancelled my membership.  I paid the collections people $60 to go away so I have no membership and owe nothing. So this is an empty offer.  You had all my info so a simple call or letter saying "welcome to our gym - do you want to continue and how do you want to pay for this." How hard would that have been!

I am rejecting this response because: I made numerous attempts to contact the gym to find out why I received an invoice when  the monthly bill was being deducted from my checking account.  All of the calls (at least 10) initially went to a voice mail box with no response after leaving a message. After that when I called the box was full. After that the phone would just ring off the hook with no voice mail.  A couple of those calls went to the corporate office and again no one answered the phone.  I then went online and sent an email to corporate with no response.  I finally went to the gym in person and was told I would need to talk to a manager and they were busy.  I would need to return in person again and make an appointment with the manager.  I went the second time in person and this was when I was given the transaction code (scribbled on a piece of paper) so I could verify the information with my bank.  That's when I discovered the code had been entered incorrectly by Fitness Evolution.  By this time my membership had been cancelled and I had been turned over to collections. I would like for Fitness Evolution to provide the following: The transaction code for the Sept Billing that was rejected.  As I said before I didn't request any changes to be made by my bank regarding the billing for Fitness Evolution.  I have had the same checking account for over 10 years and there have been  no changes.I would also like to know what the cancelation policy is for Fitness Evolution.  I was billed for 5 months after the payment was rejected before my membership was cancelled by Fitness Evolution.  I was billed an additional $10 each month ( on top of the $9.99) for a statement fee? Is that ethical considering the monthly gym fee was $9.99 per month?  I would like to see copies of the invoices that were sent to me since I only remember receiving one.I would also like to know why after almost 2 years this just shows up on my credit a couple of weeks ago. This whole billing issue should have been easily dealt with if Fitness Evolution had been available to respond to inquiries.

Our membership contract requires a 30 day cancellation notice. Any charges withing those 30 days, including monthly dues and yearly maintenance fee are due and payable. These charges are within the 30 day notice. Member is able to use the gym during those 30 days.

We are waiting for either the doctor's note or the signed refund form for the amount that has been approved.

Per the 30 day cancellation notice on your membership agreement, your final chargewould be 6/20/16. According to our records, the charge on 7/20 was decline and now waived in our system. I am making a formal request for Fitness Evolution to refund the unused portion of my gym membership from the date of termination.  A selective warning from JC (local gym manager) about using the an exterior portion of the motion cage while allowing other’s to use it does not justify (1) termination of my entire gym membership and (2) non-refund of my prepaid membership.  He is making this personal which is highly unprofessional and does not represent Fitness Evolution in a good light. It is unethical for them to keep the unused portion of my gym membership fees.  Fitness Evolution carries a pattern of not refunding customers as is evident in the on-line reviews. Thank you for your assistance. Best Regards,[redacted]

I am rejecting this response because I want $39 credit not one month of membership.  I understand what the contract says.  However, if you look at their advertising, from their website, you'll see that what they're claiming about the advertising not being false.  No where on their website does it say anything about you have to come in for more information. That too is false.  Take a look yourself at [redacted] or look at the screen shots I found.  There is not one single mention of the verbiage they are telling you they have.

to accept a written request as opposed to forcing the person to physically coming in. Twice we were told that the ONLY way to cancel was to come to the center. 2) The response did not address the fact that we had to pay for May when canceling on April 2. We were told "30 days", which to me meant May 2, not May 30. Last thing we were told was that "we don't pro-rate anything". I will accept this response once I am assured that training of your associates to accept a written request has taken place AND I receive a satisfactory explanation (more than 'it's our policy...') as to why we had to pay for 59 days instead of 30.Thank you,[redacted]

I have been charged 19.99 by Fitness Evolution on April 18 although I was sent an email by them that the issue has been taken care of.Seems like they are asking me to pay $49 to downgrade after all this hassle.There is no such thing as paying $49 to downgrade that I have signed for.Should I file for another complaint?Thanks[redacted]
