The day right to cancel is in the membership agreementIt states:
"5-DAY RIGHT TO CANCEL: You, the Client, may cancel this Agreement at any time prior to midnight of the fifth business day (or subject to additional terms on the reverse side of this contract) of the health studio where the training services are provided after the later of (i) the date of this Agreement, or (ii) the date Fitness Evolution services are available to the Client; excluding Sundays and holidaysTo cancel this Agreement, mail or deliver a signed and dated notice, or send a telegram which states that you, the Client, are canceling this Agreement, or words of similar effectThe notice shall be sent to your home facility addressWe reserve the right to retain up to $per person for handling of paper work."
The day cancellation request did not need to be done specifically in clubAs it states in the agreement the member could have sent a certified letter as wellThis membership agreement was set up in July, however, the member did not call regarding a cancellation until January I hope this helps to better explain the day california state cancellation

The club will not be refunding the member's duesAs noted in the contract, the club may cancel Members membership at any time for breach of the Rules and Regulations or generally undesirable behavior, as determined by Club in its sole discretion, and Member will not be entitled to a refund of any portion of initiation fees or dues paid to the date of cancellation

Attached are copies of signed PT REGISTRATION agreement, MEMBERSHIP CHANGE FORM/SERVICE CANCELLATION REQUEST and an account status print-out.The registration form details the terms of the agreement, specifically the need to cancel in writing days before cancellation or final billing and
authorizes Fitness Evolution to bill member monthly for the service.The change form again reaffirms the stipulation that cancellation will occur one month after the date of the cancellation request which includes billing in that final month.The account status print-out shows that Fitness Evolution has adhered to the policies of the registration agreement and the cancellation request and began the billing as authorized and ended it as stipulated on the cancel request.However Ms*** has stopped her bank payment for her October membership dues and PT payment and her membership is now in default.Respectfully, Sheila K***Billing Manager

The complaint #*** has been taken care of by Fitness Evolution in Meridian/San Jose.Since this business has so many complains with Revdex.com, I wonder how this business is permitted to continue providing such a lousy service to members?My issue with fitness evolution would not be taken
care of if there was not a Revdex.com to notify them of my complaintTo this day, I have not been able to talk to any one in Fitness Evolution corporate or customer service through the phone or customer serviceThe only persons responding are the front desk people in the gym who have no authority.I only received a no reply email from Fitness Evolution that my membership has been downgraded.Regards,***

They have made absolutely no effort to reconcile or even seek understanding on this issue, and seem unconcerned about satisfaction for three long-term, previously satisfied customersInstead of an apology, they threatenWe are amazed that they would respond with the falsehoods aboveAlso interesting that their website does not have clear contact information for customer satisfaction or even headquarters oversight.We think this clearly shows a deficient service orientation and believe that the Revdex.com can serve as a way to warn and protect other Californians about the way this company operates

Per the ***'s agreement in order to terminate the membership the request does need to be sent via certified mail to the local facility. As a courtesy we allow members to meet in club with the Manager to complete the requestWe received the request to terminate the membership in club on
10/23/2014. We would not be able to accept September as the last month dues

Hello,We do show that you talked to the club at the end of May, however, at that time there was a balance on the account because your 5/membership dues were returnedWe show the last visit in the club was 5/The account is currently closed but still has a balanceWe are able to settle your
account balance with the payment of your May dues, $13.99. Your May dues, per your membership agreement, would have been the last month dues if you had cancelled during your April 19th visit
