I am rejecting this response because: I have spoke to *** many times the past two months about this refund and she told me I am am getting the refund whenever corporate will send me and email to be transferred to a third party refund companyI cancelled two days after signing up

Hello,The member does not need to come into the club to cancelThe member can always send a certified letter, as per theoriginal signed agreementThe $charge is valid, however if the membersubmits a certified letter postdated by 9/15, we can waive day notice requirementThank you

Hello,We did receive the doctor's note which stated the member cannot utilize training at this timeHowever, it did not state that she was permanently unable to use the facility, which would be a reason, per our agreement, for cancellationThe member did sign for months and has been unable to
meet requirements to be taken out of a contractAs a courtesy, however, the member’s account was frozen until the medical issue is resolved and we have discontinued further payments on the contract until that time.Sessions already paid for will be available for use (total of remaining)

On 9/the member was emailed and called regarding refund form

All the points mentioned in the customer's rejection were addressed in our original response and are covered and agreed to when joining a signing the Membership Agreement Our Membership Agreement is reviewed and approved by the Attorney General of Maryland

Per Mr***'s complaint, he signed a contract and a cancellation form at Fitness Evolution, "the exact same thing the previous year" The membership he had the previous year shows a contract and a signed cancellation request Both of these electronic forms are automatically emailed
from a Fitness Evolution account to the member when they are signed The membership for shows a signed contract which was emailed to him when he signed (with the same email address used the previous year) and no other files A check of his email history would illustrate this pointThe contract states the need for cancellation in writing and we have nothing on file As a courtesy we did cancel the membership when the member called in late October but held him to the terms of the signed contract which states a day notice required to stop billing It is our policy to accept cancellation only in writing - not by email or verbally - and this is explained during the sign up procedure as well as in separate locations on the contract No refund is warrantedA copy of Mr***'s signed contract is attachedSheila K***

Hi ***The Rate Guarantee Fee is a standard part of our membership agreement and I see that it was charged correctly as scheduledWe did however waive your last month of dues as well as our 30-day cancellation notice as a courtesy

I have attached the copy I made of the cancellation letter I mailed to Bally to cancel my membership along with part of the envelope that includes my return address if it does not get delivered to themThis was done the date on the cancellation request 12/15/

We offer month to month memberships with a day written request to terminate the membership. I do apologize for any confusion however it does state in the agreement you signed that it is a month to month membership, no where does it state it is a trial for three months. I
have attached the agreement for your records

Member received correspondence to phone number on file regarding past due balanceAs of now, Fitness Evolution will offer $as a settlement offer (65% of the balance with the return charges deducted)To dispute that amount any further, doctor's note must be submitted as previous employees are no longer with the company

The first indication that this club has of a problem with a bank account claimed to belong to *** *** is March 3rd At that time Ms*** recited her bank account number to our GM who was able to identify the membership using the account information for monthly payments as Sahag
D*** whom Ms*** claims she does not know At that time the GM suggested Ms*** notify her bank that an unauthorized person was using her banking information and that he would look into the possibility of a refundUpon further researching we discovered a signed membership agreement for Sahag D*** where the checking account and routing number were authorized (attached) dated 4/2/ We determined the member had stopped using the gym and decided to cancel future charges to the membership The last billing on that membership was 4/1/If Sahag D*** fraudulently used Ms***' account information that would be a bank issue To the best of our knowledge the information given to us was given in good faith and when requested by Ms*** we discontinued use of the information in disputeRespectfully,

I am rejecting this response because:while it's nice that you have finally done what I asked to be done months ago! You are absolutely a bunch of crooks and I will be sure to share my experience with everyoneWord of mouth is a very powerful thing and everyone should know what kind of scams are being run over thereLastly, there better not be any additional charges in my account, as you stated in a previous message that there would no days noticeTherefore, if there are any amfuether charges, they will be disputed and if they are placed back on the account, keep in mind I have in writing that there wouldn't be a days noticeI hope you get all that you deserveGood riddance

I am rejecting this response because:I am a man not a women so someone else used it thenStill doesn't change the fact that no one informed me of the change at all and that you don't have paper work with your heading on it with my signature on itPlus you are still trying to charge me more now for the membership after you already know the card is expired

satisfactory up until this point: His Name is *** *** His birthday is S*** *** *** and his phone number us ***Also weeks ago I went back in and once again spoke with *** *** who told me I would get a confirmation for the email in hoursDid not receive so my bank called and let him know that they would take legal measures if necessary to get us our refund, I got a confirmation after the bank spoke with him but then was supposed to hear back in days and no response, So we are hoping to resolve this matter before our respective financial institutions go any further
