The first indication that this club has of a problem with a bank account claimed to belong to *** *** is March 3rd At that time Ms*** recited her bank account number to our GM who was able to identify the membership using the account information for monthly payments as Sahag
D*** whom Ms*** claims she does not know At that time the GM suggested Ms*** notify her bank that an unauthorized person was using her banking information and that he would look into the possibility of a refund.Upon further researching we discovered a signed membership agreement for Sahag D*** where the checking account and routing number were authorized (attached) dated 4/2/ We determined the member had stopped using the gym and decided to cancel future charges to the membership The last billing on that membership was 4/1/15.If Sahag D*** fraudulently used Ms***' account information that would be a bank issue To the best of our knowledge the information given to us was given in good faith and when requested by Ms*** we discontinued use of the information in dispute.Respectfully,Sheila K***Billing Manager

Attached are both *** ***' Membership Agreement and Cancellation Request Both documents state that cancellation takes effect days after the written request is received by Fitness EvolutionAdditionally the documents state that
one billing cycle will be collected from receipt of noticeThe request is dated 3/1/making 4/the last payment required. *** *** mis-quotes the Agreement stating "being a member for calendar days a person would be charged an annual fee" The Agreement states that the fee will be billed in the middle of the month approximately days from the membership join date That fee became due in March and unfortunately, also noted in the Agreement, no employee has the authority to make changes to the AgreementThere will be no refund and the membership will be cancelled 4/30/dependent on the April paymentRespectfully submitted,

I am rejecting this response because: the business is still calling me to collect my card informationI received a message couple days ago from the business telling me that my account is delinquent, that I need to pay it off and that there will be other chargesThank you for closing my account and removing the balanceI would like you to credit back the first month due, because the Manager there did not call me to apologize or nothing was sent to me to let me know that indeed it is an incident that will never happen againInstead I keep receiving messages from that place asking me for money and telling me that they will add more chargesFurthermore, that plan is not what I wanted to sign forYour sales business practice are very bad and totally misleadingIf you refund my fist month dues due to that horrible experience with your business I will accept the resolution. I called and spoke to***He states that the paperwork is very clear that one has to cancel days in advanceHowever, if you are within the billing cycle the next cycle is going to be charged as the customer would still have full access to the gymThe monthly fee is not prorated if a
customer canceled the membershipIf you were to cancel on the 10th of a month, you would be changed on the first of the next month because it is within that days noticeAs the day cancellation policy is on all paperwork this fee with not be refunded

There are no refunds on PIF PT sessionsA number of sessions are paid for a
specific trainer is not part of the contractA liability release is a prominent part of the PT contractThe only appointment for training was made 8/When MrM*** left our employment in mid-August he informed the clients he was training and they were subsequently contacted by other personal trainers to set up appointmentsA message was left on 9/When Mr*** requested a refund he was reminded by the club manager that per the terms of the signed contract there were no refunds but any other personal trainer could train himHe refused the assistance of another trainerThe non-refundable sessions are available to Mr*** whenever he wishes to make an appointment with one of our certified personal trainers to redeem themSheila K***
