I am rejecting this response because: I will accept the refund and will send you my form. I am cancelling my membership due to the horrible way in which I was...

treated never getting calls back and essentially being told I was not important. The other part of my refund was supposed to be in personal training and I want nothing to do with this gym ever again...so really you stole 300 dollars from me.

I am attaching
notes from the account showing our contact with Ms. [redacted].  The personal training charges were on [redacted]'s account and there were no
issues with his account. His account was terminated by the member with the
corporate office 12/8. All [redacted] accounts...

I am rejecting this response because:We live two hours away from the Bellingham location.  We did not sign-up for or at the Bellingham Fitness Evolution, I do not even know the address or whereabouts of this business.  I signed up for my daughters membership through the North Seattle location online, which was somehow inadvertently linked to Everett, which I explained in detail in my original complaint.  We signed up for North Seattle as it is close to our home.  I have repeatedly attempted to cancel this membership and Fitness Evolution continues to automatically withdraw money out of my checking account.  I would like and need this withdrawal to cease and be refunded the amounts from the time I initially attempted to cancel the membership but was turned away or told to contact someone else.I should not have to contact Bellingham for any reason since I have never dealt with or visited that location, it is unreasonable for this gym to continue to charge me for a membership which we have no access to a location to use.

I am rejecting this response because:Thank you [redacted]. Here's where my disagreement lies with. On December 1st, I was originally charged around $160, which was the 3 times for evofiit. My account was over drafted and I had to pay a fee of $35, which I don't agree with because this was a billing mistake on the clubs end. On December 15th, I was charged about $185, which was the 3 times for evofiit, my monthly gym fees, and a late fee. What I am asking for in a refund is $169, which will be the $129 originally issued, my $35 overdraft fee (which ** had kept telling me he was working on), and the $5 late fee.

I am rejecting this response because:According to CA law, an offer is: " A promise that is, by its terms, conditional upon an act, forbearance, or return promise being given in exchange for the promise or its performance. It is a demonstration of willingness to enter into a bargain, made so that another party is justified in understanding that his or her assent to the bargain is invited and will conclude it.  Furthermore, NEW conditions may not be imposed on the offer after it has been accepted by the performance of its terms"I was sent an offer in the mail that specifically promised a 9.95 monthly rate and that there would be "zero" fees at  sign-up if the offeree canceled their current gym membership. I called the gym to confirm said details of the offer sent. The customer service associate whom I spoke with confirmed my specific inquiries regarding the the zero fee offer.  Based on the offer sent and information provided by the gym associate. I accepted the offer.  Two months later I was charged a"rate lock" FEE to have the privilege to keep the rate that I was initially offered. The "rate lock" FEE, intentionally ambiguous, represents a change in condition from the initial offer. Additionally, the offer failed to display membership prices and fees “clearly and

I am rejecting this response because:This is untrue. I went in several time as well and was always told that the manager was not in. I said that [redacted] and I wish to terminate. They said that July would be my last payment but I had to come sign paper work with Manager but they were not in. I made 2 appointments and was also to receive personal training in which also didnt happen. They say you get personal training session each month but then when you actually wanna take it they say you have to pay for personal trainer and the one offered is only to upkeep if you take the class. I had notified them a few times prior to 6/30/15 about cancelling my account as well as [redacted]s. They always told me that the manager wasnt in and even on 30th when I went in they said that manager had to leave rescheduled for 2nd and still not available then. Then on 15th they over charged me $5 on each account $10 total for my final payment. I file police report and the officer said that they have heard multiple complaints. I also know several others that are experiencing these issues with this place.

We do not show we ever received a request to freeze the accounts so the accounts remained active.  There will not be a refund issued.  What I'm able to do is terminate the memberships moving forward.  Please note if the payment is returned for any reason included but not limited...

The member has a signature on file for membership which states "ANNUAL
RATE GUARANTEE FEE. You agree a non-refundable $39 annual rate guarantee fee

billing cycle for the member after the initial payment. The member was informed
both in club and on the phone what the charge was for. The member became irate
and disrespectful to the staff on more than one occasion. The account was
terminated for the behavior which is clearly stated in the agreement "(d)
Cancellation by Club: The Club reserves the right at any time to cancel and/or
suspend your membership or any of your membership privileges for (i) failure to
comply with any of the Club’s Rules and Regulations, (ii) any conduct the Club
determines to be improper or in any way harmful to the best interests of the
Club or other members, (iii) any payment due under this Agreement is late, or
(iv) any other reason not prohibited by law. Termination of your membership in
such cases is effective on the date the Club mails a written notice of
termination to you at your last address shown on the records of the Club. You
will remain liable for financial obligations incurred by you prior to
termination. The Club will refund any unused dues that you have already paid
for the billing period in which such notification is mailed to you calculated
in the same manner as stated for Regular Cancellations above. " We have chosen to terminate the member's account based on his behavior. His
account was terminated as of 11/3. We will issue a refund of $48.99 for
his account from November. The member's friends accounts were terminated at
their request and no final dues were charged. The friends last day available to use the club is 12/31

I am rejecting this response because: they would call me on days telling me that I was supposed to have an appointment and I was late ten to fifteen minutes even though I would specifically tell them I wasn't available on those days because I worked and then said it would come out of my balance sessions.  Then it basically means that they intentionally lied about the sessions going out of my balance
