We spoke to the complainant on 3-2-16 and explained exactly why he warranty was voided and he agreed to the reasoning. We can provide a recording of the call if needed. We called the complainant on 2-23-16 in response to an email.  He informed us of the situation with the transmission and we...

began to investigate the claim.  We give 10 days to activate the Free Warranty after receiving the engine per the Terms and Conditions of the Free Warranty.  We asked him to send a diagnostic report as standard practice and never received the required documents from the complainant. Upon further investigation, we found the complainant had falsified his warranty activation by putting a delivery date which coincided with his warranty activation date to make the 10 day requirement.  The complainant ordered the Transmission on 12-10-15 and received it on 12-16-15. As you can it would be required to activate your warranty no later than 12-26-15.  This can often be extended if needed by simply calling in and letting us know there is an issue with the installation date beforehand.  The complainant was aware of this and entered a false date which would make the warranty activation valid. Therefore, we have denied the claim based on falsifying information during the warranty activation process. This complainant Free Warranty is now void and null as a result.

Thank you for supplying the invoice number. Please let us look into the order and details and get an update as quickly as possible.

The complainant ordered an engine from us on 10/20/2016 and called 10/26/2016 to cancel their order. Per the Terms and Conditions, "All returned parts or cancelled orders are subject to a 25% handling and restocking fees plus customer assumes all shipping costs."...

[redacted] We did refund the complainant on 10/28/2016 minus the 25% cancelation fees as it is clearly stated in the Terms and Conditions. We do hope this closes this matter.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below. The long and short of the story is this: SWEngines sold me an engine that, they claim, was in working condition when it left their facility.  When it arrived at my mechanic, it was not in working condition.  Who's at fault or why it happened is really inconsequential: I did not get what I paid for, end of story.  I paid for something that wasn't broken and I got something that was broken.  If I ordered a DVD from Amazon.com and it arrived at my house smashed to pieces, I would return it and get a refund or a replacement.  That would be me paying for something that works and receiving something that doesn't work.  It's the same principle-- I did not get what I paid for.  Additionally, my mechanic, as well as the truck driver who delivered the engine, confirmed that the engine was not properly fastened to the pallet in the truck, and was subject to the laws of gravity over the course of it's 1,500 mile trip.  Basically, it fell over and was broken in the process.  As an aside, in regards to the shipping carrier, when I asked SWEngines who the carrier was, they claimed they didn't know, so I was unable to contact anyone.

We read over the emailed response from the company we have an open complaint on. According to the email, they are willing to send a third engine. We were originally sent a bad engine, they sent a second one, and acted as if we would collect warranty labor pay after the instillation of the second engine and removal of the first one they sold. I find myself wondering why an engine supplier would send a second engine if they do not feel that the first one was bad, and that the labor to put it in would not be reimbursed. We are not willing to install engines for free (a value of around 700.00) until they find one that is good. If I bought a 500.00 engine, I would expect these type of problems. When I buy a 1490.00 engine, and follow the warranty install parts guideline to the o-ring (which is about 600.00 in new parts including water pump and all seals and fluids which are required for warranty, according to the paperwork that comes with the engine.), I expect that engine to last somewhat close to the guarantee of 3 years or 36,000 miles. This car has been at my shop, with a customer waiting for months now. I really wish I hadn't done business with this company. I have already lost 600.00 in parts and 1400.00 in labor, I refuse to lose any more money by swapping engines at will because I was not given what I was promised at time of purchase. We are willing to remove their second engine, and they can come get both of them after full reimbursement of engine cost. Regardless of how this turns out, I will never buy anything from this company and will be sure they haven't just changed their name again. (Multiple name changes since 2012).

They referred to the small print as a solution. They do not stand behind their supply chain, they used the most inefficient, low costs carrier (trucking co ). they are not taking responsibility for their poor service, and the extra costs to the customer.  Thank you.

In this case the customer decided to opt with replacing the Oil Pump per the advise of his mechanic instead of repairing the cam bearings.  Per the Terms and Conditions of the Free Warranty, "We provide a one-time warranty claim service for our products. You may only file a single warranty...

claim on any product you purchase from us, without the possibility of filing any future claims on the same product." Unfortunately, this customer was ill-advised by his mechanic and no longer has an active warranty.

The complainant requested a refund for an alleged engine that was not working properly. We did send out the complainant another engine and they stated that the second engine also allegedly was not working properly. We did decide to refund the client the amount owed back to...

them. We did send out a straight refund to the complainant on 5/26/2016 for the full amount of $2245 with no restocking or shipping fees.  We hope this helps clear up the matter as the complainant did get a refund and this should close this matter.

This business is running a scam plain and simple.  They have provided me with nothing but excuses to every issue I have brought to their attention.  They hide all important information that the consumer needs to know in "fine print" that no normal person is ever going to see.  They sent me a piece of junk and will not stand behind the service they provide or the parts they sell, yet they charge a premium price.  They have nothing but rude to me on the phone.  I will never do business with these people again and I will tell everyone I know what a scam they are running.  If I can find anyplace on the internet to leave a negative review I will do that as well.  Businesses such as this should not be in business and are only out to take people's money.

[To assist us in bringing this matter to a close, we would like to know your view on the matter.] The car's repairs were not completed within ten days of when the transmission was received because of the holidays the repair shop was closed. The car could not be driven the 501 miles that was stated by the company because the transmission was defective.

All customers are made aware of the Warranty Activation requirement which is fairly standard in our industry.  All customers are informed of this requirement in the Terms and Conditions of the Free Warranty, which must be read and agreed upon before the purchase, which can be found on the web site at: http://www.gotengines.com/warranty.html.  The Warranty Activation requirement is also in bold and emphasized on the invoice after the purchase.  We apologize if this was not enough to make this customer aware of this process, but we do make a point to make this more than clear and most customers have no issues noticing. GotEngines has not changed it's name as claimed, it is simply an independent affiliate site and has been for some time.   We encourage all customers to pay close attention to the Terms and Conditions of the Free Warranty when making a purchase so we do not have run into situations like this.

Mr. [redacted] had ordered a Nissan trans back on 4/20/2015 and somehow he had received a Ford transmission, we do not how the mix up happened whether it was the trucking company or our shipping crew. Mr. [redacted] was sent the correct transmission and everything has been straightend out. Unfortunately we do...

not cover rental cars, it states that right on the warranty and on the terms and conditions form that he had agreed to.

the complainant is stating the engine that was purchased was damaged via transport. The engine was signed for, and the individuals who took the engine was given the opprotunity to look over the engine before accepting. Once the complainant told us of the damage we reccomended that they swap parts...

out from their old engine that they had on hand. The engine was ordered on 9/6/2016 and shipped on 9/26/2016. The complainant did not register the warranty and to this date it has not been registered. Per the Terms and Conditions of our Free Warranty, line 10: "Engine or transmission must be installed AND warranty activated within 10 business days of delivery OR ALL WARRANTIES WILL BE VOID. Falsifying information will automatically void your warranty." http://www.swengines.com/warranty.php the complainant also is stating the engine has timing issues but also per the Terms and Conditions of our Free Warranty, Line 4: "New timing belt must be installed". The complainant did do a dispute with their credit card which we are waiting on the resolution on to see who they favor in their response. Since no warranty was activated all claims will be void prior or in the future. We hope this closes this matter and any issues going forward.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.Regardless what their contract says we would not be in this predicament if the first engine sent was beyond "faulty". I have an email which states the first engine went through a cleaning and inspection. The engine sent was rotted in rust. The second engine sent was not rusted on the out side like the first one bit is fill of sludge on the inside. So the fact that both engines are not in workable conditions. I should have a full refund. The company should not keep the amount of money I paid if I don't have a good engine.

Shortly after getting your email about the company involved's reponse to my complaint, I received 2 emails from them stating that a replacement engine had been shipped and a tracking number with expected delivery betweeen Tues 9/22 and Thurs 9-24. It was not delivered and when I tried to track the delivery with the provided number the transport co. (SAIA) stated the number didn't exist.  These people are lying to me and to you. I don't believe they will make good on my purchase at all. No I have spent $3700 on engine and install and have nothing. I do not have money. (I have been unemployed for 20 months and borrowed money to try to have a car.

The picture of the engines are just an example of the what the engine will look like coming from us.  The Terms and Conditions clearly state there is a 25% restocking fee as stated in our previous reply.  The complainant is correct when saying the engine shipped it it had of shipped, the customer would be responsible for the shipping fees to and back as well.  We will consider this matter closed as we have done nothing but follow the instructions of the complainant by cancelling the order and the 25% restocking fee was levied under the Terms and Condition of the sale.
