I just got off the phone with [redacted] at AAMCCO and he told me the transmissions were picked up from R&L Carriers on 7/21/17. Sent to LKQ Smart parts 1540 N.4079 HWY E. P.O. #138272Contact Person: [redacted] My bank ,BofA put the amount owed in my account until dispute was resolved but was a credit from the bank not from LKQ. I also had a cost of $1620.51 to install the 1sttransmission which was bad and will have to pay that again when AAMCCO installs another. So in reality I'm out that money and don't consider this case closed until they make good on the price of the original installation. As of today it has been 20 days that their product has been picked up, I find it hard to believe they have not received them yet.
Regards,
[redacted]

Unfortunately, we cannot offer any refund beyond what was already given due to the reasons already stated previously.

The complainant is requesting reinstat their warranty due to having their engine installed after 10 business days. Per the Terms and Conditions of our Free Warranty: Line 10: "10.Engine or transmission must be installed AND warranty activated within 10 business days of delivery OR ALL WARRANTIES...

WILL BE VOID. Falsifying information will automatically void your warranty." [redacted] The engine was delivered on 12/16/2016 and the warranty was registered on 1/3/2017. the complainant submitted proof for the warranty on 1/2/2017 and that exceeds the 10 business days from delivery. Even if the shop was closed between Christmas and New Years of 2016, we have to go by normal business days and still had to count the days their shop was closed as business days. Because the engine was not installed within the 10 day period from delivery, per the Terms and Conditions of the Free Warranty, the warranty is voided and all future claims will not be accepted.  We hope this closes this matter and any issues going forward.

[redacted]  I still have not heard from the company on handling of the parts bill to repair the timing cover.  A refund for the parts is expected but this has not occurred yet.  No word from the management either.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below. It is clear to me that I did not receive the item that I was lead to believe I would be receiving.  I feel that I should be allowed to return my item at no shipping cost to me and without a restocking fee due to being mislead by this company. I am willing to get any written documents from my mechanic stating my his expertise in this matter on what I have received.  I will only accept in closing this case, by receiving a FULL refund on this engine and SW engines pay the shipping cost back to them. I don't understand why this company felt the need to treat me in such an unfair way and take this amount of money from me in a fraudulent manner.   The attachments added to this response came directly from their web site.

I have reviewed the response made by the business in reference to complaint ID [redacted] and find that this resolution is satisfactory to me.  I sure hope that something is done to stop this type of treatment.  We were planning on buying a transmission from your company, but after short responses that gave us no information, we went elsewhere.  I just wanted you to be awareand take whatever steps you feel are appropriate.

The issue regarding the warranty not being activated, occurred due to their lack of email response. I included in several of my emails to SW Engines requests on how to activate the warranty because the instructions stated I needed the paperwork that accompanied the engine. There is no info in the accompanied paperwork about the warranty activation. So I included requests for assistance in activating the warranty with my initial complaint about the motor. Furthermore the website states every engine is tested prior to shipping. If this was the case why would the issues not be disclosed at that time. This creates a false expectation and the motor was installed and the leaks were unable to be noticed without running the motor. As the motor was installed it had to be uninstalled and fixed and re installed. Creating a substantial expenditure over the regular cost. And hence forth this created an extended installation time. Which is what also contributed to the warranty activation time frame being extended.. I still request a refund even if it be for the billable hrs needed to uninstall and re install the more due to their failure to disclose the issues prior to delivery. I also request the warranty to date and in the future be fully activated and accepted by SW Engines due to their lack of clarity an unreasonable expectations of installation. I further submit that the installation was done by a accredited and certified garage that will support my claims that the company should have had knowledge of the issues with the motor and certify that the motor was installed as soon as scheduling allowed at that facility. I request that my complaint be reopened and submitted to the company for review. Sincerely [redacted]

When defective engine claim was accepted, labor charges are an integral part of it. The company accepted that the first engine despatched and received on 9/9/15 was defective. The defective engine was replaced by the company on 9/30/15 and thus the labor included as part of the sale agreement is due by the company to me for the amount of $2150. This was accepted by company's customer service representative -[redacted] and [redacted] and I was told that the company will re-imburse upon installation and completion of 500 miles after installation of the second replacement engine. Please own up else face consequences. Do not cheat as the company is trying to do.Regards,

Without any inspection on their part, or request for more detailed information,  the company used an excuse that would nullify the warranty.  The fast is that the repair shop did flush the lines, replaced the filter, filled the transmission, tested it for leaks and there were no leaks, but the unit did not work.  On the work order the business references, the replacement filter was listed in parts used along with the transmission fluid.  The repair shop uses a generic term "service" on the replacement transmission to indicate their standard procedures for flushing lines, replacing the filter, filling and testing the fluid levels.  One more additional thing I would like to point out is that the business deleted all of the emails between me and Mr. [redacted].  I printed some hard copies of many of our exchanges, but the entire string has been deleted on line and I cannot access the details of the Warranty documents.  I have requested the repair shop to write me a letter that explains all of their actions on trying to get the deficient transmission working.  I feel the business shipped an untested transmission to me and to avoid any additional expenses, they are using a contrived excuse to nullify the warranty and not ship an additional transmission.

the complainant did order an engine on 12/28/2016 in the ammount of $3395. the complainant called us back on 1/3/2017 to cancel their order. Per the Terms and Conditions of our Free Warranty: Line 3: "All returned parts or cancelled orders are subject to a 25% handling and restocking fees plus...

customer assumes all shipping costs." [redacted] Since the complainant canceled their order we did refund the complainant back $2546.25 of the overall amount paid to cover the 25% restocking fee. the complainant did file a dispute with their credit card company which was denied. We hope this closes this matter and any issues going forward.

The customer received the Transmisssions on 12-21-15.  We received a call from the customer on 1-12-16 claiming the 3rd gear was slipping.  The customer did not activate the Free Warranty per the Terms and Conditions which all customers must agree to when...

I would invite them to send the recording as they have completely fabricated a lie.  They of course will not be able to provide that recording as it never happened or will come up with some sort of excuse.  As I stated, I called them for a status of the order and had left a message asking for an update on the engine dleivery.  I am very confident that they never shipped the engine since the person (Bill) I spoke with on my 2nd call (since they never called me back) ask if I wanted to re-order the engine.  Why would I have canceled and why did they ask if I would like to reorder the engine if I just wanted an update??  Again, and I am very sure, they never held up there end of the agreement and shipped the order in the 1st place even though they were very quick to charge me for the engine that they never provided. Also, unlike them,  I can provide all the details on when the engine was ordered (5/8/15)   SW engines emailed me indicating delivery would be NLT 5/28/15.  I called to check on the status of the delivery on 6/1/15 allowing extra time because of memorial day (trying to give them the benefit of the doubt).  Why would I call on this date to cancel an order that was promised on 5/28?  Again, I can prove this with their email.  There (so-called) phone log would show that is the date (far past the due date of delivery?)    So, for a fact, when the so-called manager (Bill) told me the order was canceled I asked for his supervisor so I could speak with someone else, and that is when Bill told me to [redacted] and hung up on me.  SW engines has numerous complaints posted all over the internet.  I wish I would have checked them out before ordering.  It is my hope that this complaint will prevent others from being ripped off.To make matters worse, now SW engines claims that I swore at them, and that is slander and defamation of character!!  What legal course of action can I take in the courts to get justice?

Chuck [redacted]

[To assist us in bringing this matter to a close, we would like to know your view on the matter.] This is the 3rd copy/paste reply. I was instructed by the warranty manager Dale over the phone to send photos of the damaged engine to prove to them the engine they sent me was damaged beyond repair. Now that they see pictures with the covers off they claim I have voided my warranty. How am I supposed to show the extremely worn and damaged interior of the motor without pulling valve covers and oil pan cover. Just not taking responsibility for there poor product.
Regards,
[redacted]
