Santander has taken 4 of last 5 payments to finance charges, none to principal. Payoff has changed 3 times and is more than amt financed
2013 Camaro purchased from West Chevrolet, financed $18,596.00 and only one payment of first 5 payments has gone to principal. $334.48 goes to principal and rest of $450.75 payment goes to interest. Nov,, Dec and Jan payment went completely to interest charges. Feb payment $334.48 went to principal and $165.52 to finance charges. Then Mar payment of $450.75 went completely to finance charges, none to principal. The first payment statement dated 10/9/19 had payoff as $18,667.86 which is more than amount financed. Next statement dated 10/29/19 had payoff as $18,852.65 then statement for 11/26/19 still payoff was still $19,160.63 After payment was made Nov 29 2019 the December statement dated 12/27/19 principal was still $18,,596.00 and payoff was $19,050.65 Statement dated 1/27/19 after 2 payments principal was still same and payoff was $18,939.95 On 2/27/19, I paid $500.00 because there were late fees but $334.48 to principal and $165.52 to finance charges none to late fees. Payoff has always been more than principal. I have spoken to my daughter an attorney and a friend in financing that all 3 said that Santander has bad at their finance practices.
I want the principal balance corrected and estimated payoff should be less than principal balance. Would like to request that Santander please take Mar, Apr and May payments be added to the final loan payment and we start fresh with Jun 2020 payment.

Our records indicate that you entered into a Retail Installment Sale Contract (Contract) on October 2, 2019 in connection with the purchase of a 2013 Chevrolet Camaro (Vehicle). The amount financed was $18,596.00, at an annual percentage rate (APR) of 20.15% with a monthly payment of $450.75 beginning November 16, 2019. The Contract was assigned to Santander.
After a review of the account, we have determined that the reduction of the principal balance is accurate. In the agreed upon auto finance Contract, it shows that the account is calculated using the Simple Interest Method. This means the balance accrues interest on a daily basis and assumes the customer will make their payment on the regularly scheduled payment due date. The amount of interest accrued daily can vary based on the amount of the principal balance and the number of days between payments.
Please understand that when a payment is received, accrued interest must be satisfied first, and then the remainder of the payment is applied toward the principal balance and/or outstanding fees on the account. Please note that as accrued interest is based on the principal balance, the portion of each payment applied toward interest will generally decrease as the principal balance decreases.
Please note payments were submitted late to the account, of which, 5 were not paid within 10 days of the scheduled due date, which caused late fees to be assessed to the account in the amount of $107.73.
Please be advised that interest does not stop accruing when there has been payment assistance granted on the account or when payments are late or not received. There is no grace period for the accrual of interest.
Due to the payment pattern, more interest accrued between payments, causing the principal balance to reduce more slowly. If payments had been submitted in a timely manner, according to the contracted payment schedule, the principal balance would have been less.
As of the date of this correspondence, the account is 33 days past due and you are currently due for your April 16, 2020 through May 16, 2020 payments, with your next regular payment due on June 16, 2020. The payoff is currently $18,893.71 which is good through June 2, 2020 and will continue to increase per your billing statements until payments are allocated to the principal balance. The payoff on your previous billing statements were correct.
We respectfully decline to make any adjustments to your account, as we have determined that the balance is accurate and payments have been allocated to principal and interest correctly. In addition we kindly request to please contact us at the telephone number listed below regarding your request to move your March 2020, April 2020 and May 2020 payment to the end of your Contract.

Our records indicate that the vehicle associated with the account was deemed a total loss on or about April 29, 2016. On that date, the outstanding principal balance on the account was $22,019.25, which did not include outstanding interest or fees owed, if any.
We received a total loss payment May 14, 2016, effective for April 29, 2016 in the amount of $14,878.45 in which left a remaining principle balance of $8,825.15.
In addition, the payment history indicates that on July 20, 2016, a Guaranteed Asset Protection Insurance (GAP) payment was received from Protective Asset Protection (GAP carrier), in the amount of $5,453.56. This reduced the remaining principal balance owed on the account to $3,374.59. Our records show that no other refunds or payments were received after that date.
Furthermore on May 15, 2016 an Insurance Letter advising a balance remained on the account after the insurance proceeds applied was mailed to the address on record. We made numerous calls to reach you regarding the remaining balance on your account but we were unable to reach you.
Please understand that Santander does not determine the amount that either the insurance or the GAP carrier elects to pay. We respectfully suggest that you contact the Insurance Provider and the GAP carrier for a further explanation of their decision.

Santandar won't refund my $2000.00 pmt on 1stcontract that was voided due to error with enterprise.Have letter promising refund.2ndcontract was done.
I purchased a 2019impala-LT on or about 25 Nov 2019 from Enterprise Car Sales,fayetteville,NC finance by Santandar. I made the first payment of $2000.00 on 7Jan2020. On or about Feb 2020, I received a call from the enterprise manager, Mr. Hunter, that they had bought the contract back from Santandar due to error of not including the service contract amount in the computation on Santandar's end. We redid the contract which included the service contract amount on 7Mar2020 with the 1st pmt due on 18 Apr 2020still financed by Santandar. Afterwards, I received a letter from Santandar dated 7 Feb 2020 stating this transaction and that any payments made on the voided contract up to the date of the notice had been sent to Enterprise who will return my funds. Mr. Hunter, of enterprise, had their account dept. research the issue and confirmed that they had not received the funds. I sent emails back to Santandar through their online site to relay the findings. I have records. They never replied to any of my emails. I spoke to their representative of the dealership dept. on 17 Mar 2020 over the phone. He researched the issue with his managers and informed me that they had not release the funds to me because enterprise still owed $355.29 on the voided contract when enterprise bought the contract back. Mr. Hunter of enterprise informed me that the contract was purchased completely and that he would contact Santandar to settled the matter but later He stated that they have not replied to it either. Now, when I check my online acct. with Santandar, it shows both, the old contract with a $355.29 balance outstanding and the new contract with is correct and I am making pmts on it. This should not be. They both, have the same vin number, also. There is no reason to hold my funds due to a discrepancy between those two businesses. I am sure this is a breach of contract but I just want my due funds reimbursed. Thank you
I just want my due reimbursement of funds from the old contract and for my online account corrected to show only new contract and not old contract(it was null and voided). Thank You

Account went into collections, and I paid this debt in February.Was told it would take 30 days to be removed from my credit it is May and still nothin
This account went into collections in February I made the decision to do a settlement to pay it off for less than I owed. The representative that took the payment said I would see it fall off my credit in 30 days it is now May and it is still sitting on my credit report with no update since February. Before I paid this debt this company harassed me every single day about paying them and updated my credit report with a late payment status. Now that I have paid them they have fallen silent and I can't reach them, and they aren't even responding to the credit disputes that I have done through equifax. I am working on my credit and trying to get to a better place with my credit and having this debt that I have paid still sitting on my credit is hindering me. I just want them to do what they said they would as a company and remove this debt. The law also states if you don't hear from a creditor in 30 days then it should be removed from credit but equifax is not even adhering to the law.
I am seeking for the company to remove this debt from my credit report completely because of the numerous of attempts and different outlets I have taken to contact them with no luck. We are in a pandemic right now and credit is very important during these times to get any financial help if needed.

In addition, our records indicate that on February 20, 2020 you were offered a Settlement Offer Agreement - Full Payment, with Santander, to settle your account in full for the amount of $3,000.00, a copy of which is enclosed.
The Settlement Offer Agreement that was sent to you, dated February 28, 2020, stated, "Once all payments have been received by SC, posted to your account and cleared in accordance with the terms set forth in this letter, SC will (i) forgive the remaining portion of your Outstanding Balance, (ii) consider your account as settled, (iii) adjust our records to reflect the settlement of your account and (iv) report the status of your account to the credit reporting agencies as settled for less than the full balance, and (v) release the title (if applicable)."
Our records do not indicate that you were advised that the reporting of the account would be removed from your credit reports once we received the settlement payment. We regret any miscommunication regarding this matter.
The enclosed payment history reflects that on February 20, 2018, a payment was received for the settlement of the account in the amount $$3,000.00. On March 9, 2020 the remaining balance was waived on the account, per the Settlement Offer Agreement, and the account reflects a zero balance.

Our records indicate on November 21, 2018, you (Co-Buyer) and *** (Buyer), entered into a Retail Installment Sale Contract (Contract) with Fayetteville KIA (Dealership) in connection with financing the purchase of a 2018 KIA Rio (Vehicle). The amount financed was $18,327.45 at an Annual Percentage Rate (APR) of 18.00%. The payment schedule called for 72 monthly payments in the amount of $421.10 each, beginning January 5, 2019. Santander was the assignee of the Contract.
Santander sets interest rates based on many factors including but not limited to the current value of the Vehicle, the applicants' credit worthiness, and their credit rating. Santander proposes funding for the applicant which they can either accept or reject at the time of their application. We have confirmed that the APR reflected on the Contract is within the allowable state limits.
Please be advised that the enclosed Contract indicates a Trade-In Allowance credit of $530.00 and a rebate credit in the amount of $1,500.00.
Regarding your down payment claims, we are unable to substantiate your statement that a down payment in the amount of $2,500.00 was required in order to proceed with the funding of this account. According to the Retail Purchase Agreement, attached to your complaint and the enclosed Contract, there is no indication of any down payment proceeds toward the Vehicle. Please note that the enclosed Contract also shows no indication of any down payment proceeds. Further note that down payments are paid directly to the Dealership, not to Santander, and are not part of the amount financed.
Please be advised that any charges incurred due to the Vehicle being parked on the side of the road were not assessed by Santander. Additionally, we are unable to address your concerns of any legal ramifications indicated in your complaint. We kindly suggest reaching out to the entity that has charged you in order to further address this matter.
As of the date of this correspondence, the account is 46 days past due in the amount of $846.20 from the April 5, 2020 payment with late fees in the amount of $75.00.
As we have confirmed that the terms of the Contract are correct and no down payment has been charged, we respectfully decline your request to adjust any originating terms of the Contract.

I was told upon settlement of my vehicle that a title would be sent to me once the funds cleared.A month had gone by and no title. I called on April 24th and first spoke to a lady in customer service. She told me that my title was electronic and I would have to have it printed on paper at DMV. I have never heard of such a thing. She then transferred me to a man in the titles department. He also said that Santander does not send titles. That's not what my settlement letter said. He told me I would have to go to the dmv and tell them the account has been deleted and they can print a title. I was livid of such nonsense. So today I check my mailbox and there's my car title. All of my stress and anguish to be given the run around. Someone needs to train their employees. This could have saved me from having a bad day.
Other (requires explanation) I want a sincere apology for all the hassle I went through just to get a title. Train their employees to get it right the first time.

The Settlement Offer Agreement that was sent to you, dated February 28, 2020, stated, "Once all payments have been received by SC, posted to your account and cleared in accordance with the terms set forth in this letter, SC will (i) forgive the remaining portion of your Outstanding Balance, (ii) consider your account as settled, (iii) adjust our records to reflect the settlement of your account and (iv) report the status of your account to the credit reporting agencies as settled for less than the full balance, and (v) release the title (if applicable)."
Our records do not indicate that you were advised that the reporting of the account would be removed from your credit reports once we received the settlement payment. We regret any miscommunication regarding this matter.
The enclosed payment history reflects that on February 20, 2018, a payment was received for the settlement of the account in the amount $$3,000.00. On March 9, 2020 the remaining balance was waived on the account, per the Settlement Offer Agreement, and the account reflects a zero balance.

Our records indicate on November 21, 2018, you (Co-Buyer) and *** (Buyer), entered into a Retail Installment Sale Contract (Contract) with Fayetteville KIA (Dealership) in connection with financing the purchase of a 2018 KIA Rio (Vehicle). The amount financed was $18,327.45 at an Annual Percentage Rate (APR) of 18.00%. The payment schedule called for 72 monthly payments in the amount of $421.10 each, beginning January 5, 2019. Santander was the assignee of the Contract.
Santander sets interest rates based on many factors including but not limited to the current value of the Vehicle, the applicants' credit worthiness, and their credit rating. Santander proposes funding for the applicant which they can either accept or reject at the time of their application. We have confirmed that the APR reflected on the Contract is within the allowable state limits.
Please be advised that the enclosed Contract indicates a Trade-In Allowance credit of $530.00 and a rebate credit in the amount of $1,500.00.
Regarding your down payment claims, we are unable to substantiate your statement that a down payment in the amount of $2,500.00 was required in order to proceed with the funding of this account. According to the Retail Purchase Agreement, attached to your complaint and the enclosed Contract, there is no indication of any down payment proceeds toward the Vehicle. Please note that the enclosed Contract also shows no indication of any down payment proceeds. Further note that down payments are paid directly to the Dealership, not to Santander, and are not part of the amount financed.
Please be advised that any charges incurred due to the Vehicle being parked on the side of the road were not assessed by Santander. Additionally, we are unable to address your concerns of any legal ramifications indicated in your complaint. We kindly suggest reaching out to the entity that has charged you in order to further address this matter.
As of the date of this correspondence, the account is 46 days past due in the amount of $846.20 from the April 5, 2020 payment with late fees in the amount of $75.00.

Our records indicate that the vehicle associated with the account was impounded on June 24, 2019, due to an accident. At that time the account was 131 days past due and the vehicle had already been assigned for repossession. On July 18, 2019, an evaluation was done to assess the damage to the vehicle. The cost of the evaluation was $85.00, which was assessed to the account on November 27, 2019.
Please understand that a repossession agent was already in the process of attempting to repossess the vehicle from impound, when it was retrieved by you on July 23, 2019; therefore, a mileage fee, for the impending repossession of the vehicle was assessed to the account in the amount of $50.00 on October 24, 2019, which was paid on November 7, 2019.
The enclosed payment history reflects that 7 late fees have been assessed to the account for payments that were not received within 10 days of the scheduled due date, totaling $444.88, which have been paid. In addition, 2 payments were returned due to Non-Sufficient Funds (NSF), causing returned payment fees to be assessed to the account, totaling $50.00, which remain unpaid.
In regard to monthly billing statements, our records show that you elected to view your statements electronically, instead of having them mailed each month. Enclosed is a copy of the last 6 billing statements for your review. If would like to have your billing statements mailed to you instead of viewing them electronically, please contact our Customer Service Department at the telephone number provided below, for further assistance. You may also view your statements anytime at our company website under "MyAccount".
Our records further indicate that you contacted our office on January 9, 2020, regarding monthly billing statements and fees owed on the account.
