My monthly payment of $370 gets split unevenly between Principle and Interest. Santander an never explain to me the monthly percentage or formula that they use to calculate Interest. $82 of my April payment went towards the Principle. There has been months where even less has gone towards my principle. Every month the Interest taking is a different amount and is always significantly more than what goes towards the Principle. Why aren't Santanders Interests rates fixed? Why does the interest rate fluctuate every month? lending practices seem very predatory

Other (requires explanation) Have more of my payment going towards the Principle to actually pay off the car loan

Re: Revdex.com Case No.: XXXXXXXX
Santander Account Number: ***

Dear Mr.:

We have received your complaint submitted through the Revdex.com (Revdex.com), regarding the above-referenced Santander Consumer USA Inc. (Santander) account. Thank you for allowing us the opportunity to address your concerns.

Our records indicate that on April 28, 2018, you entered into a Retail Installment Contract (Contract) to purchase a 2010 Hyundai Genesis (Vehicle). The amount financed was $13,942.63, at an APR of 24.00%. The Contract disclosed a term of 72 monthly payments in the amount of $370.74 each, which began on June 12, 2018. The Contract was assigned to Santander.

In regard the total amount that you will pay for the Vehicle, we refer you to the Federal Truth-in-Lending Disclosures on Page 1 of the Contract. Under the section titled "Finance Charge", the dollar amount that the credit will cost you, is $12,750.65, plus the "Amount Financed" of $13,942.63, equals the amount paid under the section titled "Total of Payments", which reflects the amount of $26,693.28. This is the amount you will pay if all payments are made according to the payment schedule set forth in the Contract.

We have determined that the reduction of the principal balance on your account is accurate. In the agreed upon auto finance contract, it shows that the account is calculated using the Simple Interest Method. This means the balance accrues interest on a daily basis from the date the Contract is signed and assumes the customer will make their payment on the regularly scheduled payment due date. The amount of interest accrued daily can vary based on the amount of the principal balance and the number of days between payments.

Please note that daily interest, or per diem, is determined by multiplying the loan's principal balance by the contract interest rate divided by 365.

When a payment is received, the outstanding accrued interest must be satisfied first, then the remainder of the payment is applied toward principal and any fees owed on the account.

Over the life of the account you requested and were granted 1 due date change.

Please note that interest does not stop accruing when there has been payment assistance granted on the account or when payments are late. There is no grace period for the accrual of interest.

Due to the payment assistance and payment pattern more interest accrued between payments, causing the principal balance to reduce more slowly. If payments had been submitted in a timely manner, according to the contracted payment schedule, the principal balance on your account would have been less.

In regard to the amount of your payment that was applied to your principal balance for April 2020, our records show that there were 37 days between the payments received on March 13, 2020 and April 19, 2020; therefore, 37 days of accrued interest was deducted from the payment received on April 19, 2020, in the amount $370.74. Of this payment, $89.31 was applied to principal and $281.43 was applied to interest.

As of the date of this response, the principal balance on the account has been reduced from $13,942.63 to $11,509.97.

We respectfully decline to apply more of the payments made to the principal balance, as the payments have been applied accurately and according to the Contract.

Enclosed is a copy of the Contract and Payment History for your review.

Thank you again for allowing us the opportunity to address your concerns. If further assistance is needed, please contact us directly at 1 (888) 222.4227.

Sincerely,

SANTANDER CONSUMER USA INC.

Dear Ms.:

We have received your complaint submitted through the Revdex.com (Revdex.com), regarding the above-referenced Santander Consumer USA Inc. (Santander) account. Thank you for allowing us the opportunity to address your concerns.

We are aware of the current events that may be affecting our customers, and regret any inconvenience you may have experienced during these difficult times.

Our records show that you entered into a Temporary Modification on October 15, 2019, to reduce your monthly payments from $685.52 to $411.31 for a period of 6 months starting on November 17, 2019. Our records further show that only 3 payments have been received on your account per the modification. (November 14, 2019, December 16, 2019 and January 17, 2020)

Shows May Payment is due and went to pay it. I went to pay it like normal. Clicked on amount due that clearly said 403.08 and agreed to make the payment. I then find out they took the payment and no clue where it's going. I agreed to May and amount but instead I guess they are applying it to the principle.
No clue as that's not what I authorized and very deceptive and misleading. I've sent a dispute with them immediately and now sent a formal Revocation Of Payment and Disputed with my Bank.
At a time like this they need to update their website as it violates many laws and the payment results in unauthorized.
They need reported and their misleading tactics need changed not to take consumer money at this time. It's awful and sad to see at this time.

Desired Outcome

Revocation as Requested to them within 10 minutes and then again in formal writing and now through my bank. I want them to change their misleading payment and practices and adjust it to not be against the law. That would be ideal.

Re: Revdex.com Case No.: XXXXXXXX
Santander Account ***

Dear ***:

We have received your complaint submitted through the Revdex.com (Revdex.com), regarding the above-referenced Santander Consumer USA Inc. (Santander) account. Thank you for allowing us the opportunity to address your concerns.

Our records indicate that you entered into a Retail Installment Sale Contract (Contract) on October 17, 2016 in connection with the purchase of a 2012 Chevrolet Impala (Vehicle). The amount financed was $10, 554.86 at an annual percentage rate (APR) of 21.00%. The payment schedule called for 60 monthly payments of $287.84 each month, with the first payment due on November 20, 2016.

In regard to the total amount paid on the account, we refer you to the Federal Truth-in-Lending Disclosures on Page 1 of the Contract. Under the section titled "Finance Charge", the dollar amount that the credit will cost you, is $6, 715.54, plus the "Amount Financed" of $10, 554.86, equals the amount paid under the section titled "Total of Payments", which reflects the amount of $17, 270.40. This is the amount you would have paid if all payments had been made according to the payment schedule set forth in the Contract

In the agreed upon auto finance Contract, it shows that the account is calculated using the Simple Interest Method. This means the balance accrues interest on a daily basis and assumes the customer will make their payment on the regularly scheduled payment due date. The amount of interest accrued daily can vary based on the amount of the principal balance and the number of days between payments.

Our records indicate that over the life of the account you requested and were granted a total of 4 monthly payment extensions. In some months, no payment was received, or the payment received was less than the contracted monthly payment amount. In addition, payments were submitted late to the account, of which, 30 were paid more than 10 days late, which caused late fees to be assessed to the account.

Please note we have no record of any additional complaint on file besides the Revdex.coms Case # XXXXXXXX nor any type of dispute.

The enclosed payment history shows that we received payment on April 11, 2020 through our IVR (Integrated Voice Response) in the amount of $300.00 and prior we received payment through the IVR (Integrated Voice Response) on March 6, 2020 in the amount of $300.00.
Therefore unable to substantiate our online IVR (Integrated Voice Response) or Online Banking system is not working correctly. Additionally as of the date of this response the account is past due for March 2020 in the amount of $176.24 and April 2020 in the amount of $287.84.

Santander's monthly billing statements are generated up to 15-22 days prior to the next scheduled payment due date. Statements are provided to customers as a courtesy, however, customers are responsible to make their monthly payments as set forth in the contract, regardless of whether the statement is received. ***- I have reported this to them, to my bank, and made two official complaints. They now have in writing formal complaints. Currently their site is down. Auto Loan- Made April Payment.

You may view your current or past billing statements through our website under "MyAccount". Please contact us if you need assistance with any login information.

We apologize if you feel that you have been treated in an unprofessional manner and hope that this explanation of your account is satisfactory to you. If further assistance is needed, please contact us directly at (888) 222-4227.

Sincerely,

SANTANDER CONSUMER USA INC.

Re: Revdex.com Case No.: XXXXXXXX
Santander Account No.: ***

Dear Mr.:

We have received your complaint submitted through the Revdex.com (Revdex.com), regarding the above-referenced Santander Consumer USA Inc. (Santander) account. Thank you for allowing us the opportunity to address your concerns.

Our records indicate on June 12, 2019, you entered into a Retail Installment Sale Contract (Contract) with Payless Car Sales (Dealership) in connection with financing the purchase of a 2015 Jeep Grand Cherokee (Vehicle). The amount financed was $24,743.50 at an Annual Percentage Rate (APR) of 17.28%. The payment schedule called for 72 monthly payments in the amount of $558.31 each, beginning July 27, 2019. Santander was the assignee of the Contract.

A review of the account indicates two (2) payments received within the month of February 2020. On February 14, 2020, you submitted a payment in the amount of $558.31 which satisfied the monthly payment due on February 27, 2020. Subsequently, another payment in the amount of $558.31 was applied to the account on February 27, 2020. An internal processing error occurred and unfortunately the payment did not advance the account.

A Santander representative spoke to you on March 31, 2020 regarding concerns of the payment that you submitted on February 27, 2020. In an effort to assist you, the representative submitted a request to our Accounting Department for the payment in question to be reviewed.

After an audit of your account, an update was completed on April 2, 2020 by our Accounting Department to advance the account, as the payment received on February 27, 2020 should have applied and advanced the March 27, 2020 monthly payment. We have enclosed a copy of the account Payment History indicating the updated payment. We apologize for any inconvenience this matter has caused.

Please note that 2 additional payments have applied to the account since February 27, 2020 and our records now indicate that the account is current with the next payment due on June 27, 2020. We believe this matter is now resolved.

Regarding interest concerns, we have determined that the reduction of the principal balance is accurate. In the agreed upon auto finance contract, it shows that the account is calculated using the Simple Interest Method. This means the balance accrues interest on a daily basis and assumes the customer will make their payment on their regularly scheduled payment due date.

When a payment is received, the accrued interest must be satisfied first, and the remainder of the payment is applied toward principal and/or fees owed on the account. The amount of interest accrued can vary based on the amount of the principal balance and the number of days between payments.

As of the date of this correspondence, the principal balance has been reduced from $24,743.50 to $22,257.53 and the account is current.

Please find enclosed account related documents.

Thank you again for allowing us the opportunity to address your concerns. Please contact us directly at (888) 222-4227 if you need additional assistance.

I send funds to Santander Consumer USA in excess of the monthly payment amount to go to principal, but they apply the extra to next month's interest!
I have a loan from Santander Consumer USA for my 2019 Mitsubishi Mirage. I have sent more money than the monthly payment each month in hopes of paying the principal off early. Instead, that money is applied to next month's interest. I don't owe them for next month's interest. I enclosed a letter explaining the extra money goes to principal. Account #XXXXXXXXXX. My Oct.29,2019 excess payment had $289.17 go toward Nov.'s payment. My Jan.30 excess payment had $229.17 go toward Feb.'s payment. In March, I sent a money order for the exact monthly payment of $470.83 and another money order for an additional $129.17 with a letter asking the $129.17 be applied to the principal. However, the $129.17 was applied to interest with no reduction to the amount due in April. When I called Santander, Their associate started me out with their standard,"Do you understand simple interest?" I helped her understand how badly she would be hurt, if she ever she ever says that to me in person. So she began explaining the simple interest of my extra payment was less than half of Avogadro's number so that money goes to interest. I asked for her name. She said she would send the matter to accounting. I can call back in 3 to 5 business days.

Desired Outcome

I want any funds that I have sent to this lender in excess of my monthly total amount due to be applied directly to the principal.

Re: Revdex.com Case No.: XXXXXXXX
Santander Account ***

Dear ***:

We have received your complaint submitted through the Revdex.com (Revdex.com), regarding the above-referenced Santander Consumer USA Inc. (Santander) account. Thank you for allowing us the opportunity to address your concerns.

Our records indicate that you entered into a Retail Installment Sale Contract (Contract) on September 13, 2019 in connection with the purchase of a 2019 Mitsubishi Mirage (Vehicle). The amount financed was $17,966.80 at an annual percentage rate (APR) of 23.41%. The payment schedule called for 72 monthly payments of $471.08 each month, with the first payment due on October 28, 2019.

Additionally, a correspondence dated October 4, 2019 was mailed to the address on file advising you of our opportunity to reduce your APR, which resulted in lower payment of $470.83. Please note the original APR of 23.41% was changed to 23.38%.

After a review of the account, we have determined that the reduction of the principal balance is accurate.

Regarding your previous communication with a Santander Representative, on April 22, 2020 they advised you of simple interest and in effort to assist, your concerns were sent over for review to our Accounting Department regarding your $129.17 payment received on March 28, 2020. Please note, the representative advised you to follow up on this request. On April 23, 2020, our Accounting Department confirmed they could not reallocate to principle only, due to our current payment guidelines as owed interest on the account was not satisfied when the payment posted.

Please note, on the enclosed Payment History the last payment we received by mail in the amount of $1,470.83 was allocated as $322.18 towards interest and $1,148.65 towards your principle balance.

Thank you again for allowing us the opportunity to address your concerns. If further assistance is needed, please contact us directly at (888) 222.4227.
