To whom may concern,

I purchased a Chrystler 200 from Carmax in 2015. My finance company was Santander Consumer USA. Santander repossessed my car.
Santander Consumer USA approved me for financing in October 2015 for a vehicle I purchased from Carmax. I had the vehicle from October 2015 to August/September of 2016.
Santander Consumer USA repossessed my vehicle without notice. When I contacted Santander, I was told that they were unable to verify my employment and that they could not verify the company in which I provided during the purchase of the vehicle.
Santander USA never once tried to reach out to me to inquire about my employment. I never received a letter, phone call, message or call to my references.
They just abruptly came and took my car from my home with out requesting proof of employment. My payments on my vehicle was current.
As of today, Santander Consumer USA has placed this balance on my credit file as if I haven't been paying them. Do they really expect me to pay for a vehicle they chose to repossess when my payments were current and due to them not being able to verify my employment???
Santander Consumer USA has failed to provide me with documentation of their findings as to why they made the decision to take my car although the payments were getting made on time. Santander needs to remove this balance from credit file as I plan to seek legal action against them as they have unlawfully and illegally took my car when I was clearly paying for the car. I have provided you a screen shot of my credit report showing I had no late payments until they took my vehicle. I also am requesting where in my contract does it state my vehicle can be taken if they can't verify my employment. They are showing on my credit file that I've never made a payment which is false!!! This company is a horrible company to ever do business with.!!!

Desired Outcome

I would like them to remove this incorrect information off my credit report.

According to our records, on October 19, 2015 you entered into a Retail Installment Sale Contract (Contract) in connection with financing the purchase of a 2015 Chrysler 200 (Vehicle). The amount financed was $16,581.25 at an annual percentage rate of 25.93% with 72 monthly payments in the amount of $461.09 each, beginning December 3, 2015. Santander was the assignee of the Contract.

Please be advised that our records show that the associated Vehicle was repossessed on September 9, 2016 due to confirmed fraudulent activity which involved the employer you reported on your credit application prior to funding. Because of nature of the fraudulent activity, Santander secured the Vehicle in an effort to protect our lien interest, despite the account being current at the time.

Additionally, you were denied the opportunity to reinstate the account and redeem the Vehicle and it was later sold at a private auction on September 27, 2016. The proceeds from the Vehicle sale were applied to the remaining balance owed, leaving a deficiency balance. We sent you a letter titled "Explanation of Calculation of Surplus or Deficiency", dated October 23, 2016, which explained how the final balance owed was calculated after the sale of the Vehicle.

The Fair Credit Reporting Act states that we are required to accurately report all account information to the credit reporting agencies.
Please note that we provide account information to the four major credit reporting agencies: Experian, Equifax, Transunion, and Innovis. It may be necessary to contact the agencies directly regarding any disparity between reports.

A review of the information provided to the credit reporting agencies shows that on April 30, 2020, we advised the agencies that the account is open and charged off with a balance of $10,032.00, which includes the principal balance, unpaid accrued interest, and any fees that have been assessed to the account. Further note that the account began reporting as a charged off following the aforementioned fraudulent activity repossession.

As such, we respectfully decline your request to update the information being reported on your account, as we have confirmed that the information reported matches our records.
Please find pertinent account documents enclosed for your review.

I do not accept their response because their reasoning is FALSE. There was nothing fraudulent about my job information. Why was I allowed to drive the car off the lot without my employment completely verified? I am not giving SANTANDER the remainder balance for a car that I no longer have and that was wrongfully taken away from me without any notice. This company is a FRAUD! I will be seeking legal action.

I paid off my venicle since 2019 and has not received my Lein Release documents. The company kept turning me back and forth
My vehicle is accruing storage fees daly and this company has failed to send or email my document since two weeks that I started asking for this. I have spoken to more than 15 people on this matter. It takes a click to send an email to stop this storage fees, why would I not get the document? They often use COVID-19 as excuse but I am only requesting an electronic document for now, which is only a click. I should not have to suffer because I was responsible to pay off this loan without a single day default, they should be responsible to to send my document whether on request or not.

Please note that effective March 2, 2020 Gateway One Lending & Finance (Gateway) accounts will now be serviced by Santander. Your lien release should have been provided by Gateway prior to the conversion.

After further review your account was paid in full on October, 4 2019 in the amount of $330.89 via debit card.

On April 24, 2020 you spoke with a representative in our titles department in which advised of time period to send out a lien of release. Furthermore the lien of release was sent to the incorrect email in which we had to verify again. Therefore a lien of release was FedEx (Tracking# XXXXXXXXXXXX) to the address on file on May 4, 2020 and we have confirmed it was received on May 5, 2020, in addition was sent via email.

Additionally we do have record of you attempting to obtain a release of lien with several representatives. Please note due to COVID -19 we are experiencing high call volume. We regret any inconvenience and misunderstanding that you may have experienced in attempting to resolve this issue. In July/2013 I had a car financed through Santander Consumer USA. The loan was $318.83/month for 72 months. I did fully complete the loan. In fact, I actually paid more than the loan value as I was late a few times for medical reasons. So, I paid the late fees and paid the accrued interest. When I called Santander for my title, I was informed that I still owed just under $11,000.This is FALSE! I pulled my paperwork and accounted for over $27000 in payments. In September of 2019 they stole(repossessed) my car. What now?

Our records indicate that you entered into a Retail Installment Sale Contract (Contract) on June 25, 2013 in connection with the purchase of a 2011 KIA Soul (Vehicle). The amount financed was $13,803.43 at an annual percentage rate of 18.23% with 72 monthly payments of $318.33 each. The Contract was assigned to Santander.
After a review of the account, we have determined that the reduction of the principal balance is accurate. In the agreed upon auto finance Contract, it shows that the account is calculated using the Simple Interest Method. This means the balance accrues interest on a daily basis and assumes the customer will make their payment on the regularly scheduled payment due date. The amount of interest accrued daily can vary based on the amount of the principal balance and the number of days between payments.

Over the life of the account you requested and were granted a total of 8 monthly payment extensions, a due date change and a temporary modification, which lowered your payments for a term of 6 months. In some months, no payment was received, or the payment received was less than the contracted monthly payment amount. In addition, payments were submitted late to the account, of which, 43 were paid more than 10 days late, which caused late fees to be assessed to the account.

Please be advised that interest does not stop accruing when there has been payment assistance granted on the account or when payments are late or no payments are received. There is no grace period for the accrual of interest.

Due to the payment assistance and payment pattern, more interest accrued between payments, causing the principal balance to reduce more slowly. If payments had been submitted in a timely manner, according to the 72 month contracted payment schedule, the principal balance would have been less.

Our records indicate that a letter titled "Notice of Right to Cure Default and Requirement of Strict Compliance" (RTC) dated July 08, 2019 was mailed to the address on file, stating that the account was in default and if not cured by July 22, 2019 we would take possession of the Vehicle.
The default was not cured and the Vehicle was repossessed on September 23, 2019 when the account was 128 days past due. After the repossession, a letter titled "Notice of Repossession and Notice of Our Plan to Sell Property" (NOI), dated September 23, 2019, was mailed to you at the address on file, explaining that the Vehicle would be sold sometime after October 7, 2019, but also gave you the opportunity to redeem the Vehicle.

The Vehicle was not redeemed and was sold at auction. After the sale, a letter titled, "Explanation of Calculation of Surplus or Deficiency" (Deficiency Letter) was mailed to address on file, dated December 1, 2019 which advised how the sale proceeds were applied to the account and that there was a remaining balance owed on the account.

As of the date of this correspondence the remaining principal balance is $7, 048.63, interest in the amount of $333.58, late fees in the amount of $608.07 and miscellaneous fees in the amount of $625.00.

We respectfully decline to refund any amount previously paid to Santander as an outstanding balance remains on the account.

Enclosed please find copies of the Contract, Payment History, RTC, NOI and Deficiency Letters for your review.

While we are experiencing a GLOBAL pandemic causing widespread economic devastation, tens of thousands of people out of work, SANTANDER has decided to continue to report with credit agencies late and missing payments on TOP OF GETTING THE HIGHEST INTEREST ALLOWED. on a five year loan, with 16 payments left, I have not had one late payment . Until COVID19. What is Santander's response? A negative report to the credit bureau. Way to be a team player Santander.

Destroyed credit that I was finally starting to get to a decent number. Now that they have somehow reopened my account it tookmy score for almost 630 to about 570 and its dropping everytime it updates. This cant possibly be legal and if it is ill write every politician that cares about us veterans to have it changed so that its not legal. I need them to fix this immediately.

Desired Outcome

Remove what they just recently did so that i can fix the damage again.

Paying over 40,000 for an 18,000 car that had a 60 month agreement (5 years). I've now had the car for 8 years & still paying on 9,788.34.

I have spoken with an account manager named Talosha *** on several occasions about requesting a removal of the 5,000. Today, I spoke with a supervisor named Jamie, ID # XXXXXX. Jamie offered to submit a request for some fees to be waived. She said that it would not be a substantial amount, if approved. At this point, I'm highly burdened with the unclear leasing terms of this company, it has been a complete nightmare. Being that I've had the car for almost 8 years, it's almost time for a new one. I cannot get ahead because of what's owed on this vehicle. Today, for the 1st time I was made aware that interest is charged daily. I want/need out of this urgently. Also, doesn't seem that they ever factored in the 3,000 or so that put down on the vehicle in 2012.

Desired Outcome

I would like for Santander Consumer USA to waive 5,000 of what's owed on this vehicle, so that I can pay it off and move forward with my life.

Our records indicate that you entered into a Retail Installment Contract (Contract) on October 4, 2012 in connection with the purchase of a 2009 Ford Mustang (Vehicle). The amount financed was $16,404.86, at an annual percentage rate (APR) of 24.99% with a monthly payment of $446.40 beginning November 18, 2012. A cash down payment was listed on your Contract in the amount of $3,000.00. The Contract was assigned to Santander.

After a review of the account, we have determined that the reduction of the principal balance is accurate. In the agreed upon auto finance Contract, it shows that the account is calculated using the Simple Interest Method. This means the balance accrues interest on a daily basis and assumes the customer will make their payment on the regularly scheduled payment due date. The amount of interest accrued daily can vary based on the amount of the principal balance and the number of days between payments.

Please understand that when a payment is received, accrued interest must be satisfied first, and then the remainder of the payment is applied toward the principal balance and/or outstanding fees on the account. Please note that as accrued interest is based on the principal balance, the portion of each payment applied toward interest will generally decrease as the principal balance decreases.

Over the life of the account you requested and were granted a total of 8 monthly payment extensions and 1 due date change. In addition, payments were submitted late to the account, of which, 17 were not paid within 10 days of the scheduled due date, which caused late fees to be assessed to the account in the amount of $358.69. In addition, 3 payments were returned for non-sufficient funds. In some months either no payment was received. Please note that, as a courtesy, all late fees have been waived on the account.

Please be advised that interest does not stop accruing when there has been payment assistance granted on the account or when payments are late or not received. There is no grace period for the accrual of interest.

Due to the payment assistance and payment pattern, more interest accrued between payments, causing the principal balance to reduce more slowly. If payments had been submitted in a timely manner, according to the contracted payment schedule, the principal balance would have been less.

The original maturity date was October 18, 2018. With the above-referenced assistance, the revised maturity date is now June 16, 2020. If a balance remains once the account reaches the maturity date, to avoid the customer having to pay one large balloon payment; Santander will allow the customer to continue to submit their regular monthly payment to the account until the balance is paid in full. If payments received are in line with the Contract agreement, Santander will continue to advance the maturity date on the account.

As of the date of this correspondence, the principal balance on the account has been reduced from $16,404.86 to $8,218.16. Additionally, your account is 27 days past due and you are currently due for your April 16, 2020 through May 16, 2020 payments.

We respectfully decline to make any adjustments, waive $5,000.00 from your account or consider the account paid in full, as we have determined that the balance is accurate and payments have been allocated to principal and interest correctly.

Destroyed credit that I was finally starting to get to a decent number. Now that they have somehow reopened my account it tookmy score for almost 630 to about 570 and its dropping everytime it updates. This cant possibly be legal and if it is ill write every politician that cares about us veterans to have it changed so that its not legal. I need them to fix this immediately.

Desired Outcome

Remove what they just recently did so that i can fix the damage again.

According to our records, you entered into a Motor Vehicle Retail Installment Sale Contract (Contract) on February 3, 2016 in connection with financing the purchase of a 2013 Nissan Altima (Vehicle). The amount financed was $12,900.00 at an annual percentage rate of 20.64% with 72 monthly payments of $316.45 each. Santander was the assignee of the Contract.

No payments were ever received on the account. Our records indicate that On March 18, 2016, we learned the Vehicle had been impounded by the City of Chicago. The total amount to secure the Vehicle was listed as $1,421.45 as of March 22, 2016.

On March 24, 2016, our Customer Service Department, made contact with you we explained the Vehicle would be secured from the City of Chicago Impound Department. On March 31, 2016, the Vehicle was secured.

After the repossession, we mailed a letter to the address; XXXXX *** XXXXX-XXXX titled, "Notice of Our Plan to Sell Property" (NOI), dated April 01, 2016 which advised that the Vehicle would be sold sometime after April 25, 2016 if not redeemed, due to failure to keep the Vehicle free from encumbrances and liens as required in the Contract. The Vehicle was not redeemed and was sold at auction.

After the sale a Deficiency letter was mailed to the address on file dated May 23, 2016, explaining the Vehicle was sold at auction on April 27, 2016 and the resulting deficiency balance, in the total amount of $5,765.27.

Upon review, we are unable to substantiate your statement that you were refused calls, and or disconnected when you made an attempt to contact our office. A review of our records indicate that March 24 2016, was the last physical contact you made with our Customer Service Department, We are unable to validate that you were advised by our Customer Service Representative that we had no records of your account.

In reference to your statement that you have made monthly payments, enclosed is a copy of the Payment History, which will confirm all posted payments to the account. If after reviewing, if you believe that this is inaccurate and can provide any receipts, running bank statements or front and back copy of checks payable to Santander, we will review this matter further. Please send your documentation through the Revdex.com portal. Once received we will review and respond accordingly.

As of the date of this correspondence the account payoff amount is $5,498.72, which is good until May 27, 2020.

The Fair Credit Reporting Act states that we are required to accurately report all account information to the credit reporting agencies. I have spoken with an account manager named Talosha *** on several occasions about requesting a removal of the 5,000. Today, I spoke with a supervisor named Jamie, ID # XXXXXX. Jamie offered to submit a request for some fees to be waived. She said that it would not be a substantial amount, if approved. At this point, I'm highly burdened with the unclear leasing terms of this company, it has been a complete nightmare. Being that I've had the car for almost 8 years, it's almost time for a new one. I cannot get ahead because of what's owed on this vehicle. Today, for the 1st time I was made aware that interest is charged daily. I want/need out of this urgently. Also, doesn't seem that they ever factored in the 3,000 or so that put down on the vehicle in 2012.

Desired Outcome

I would like for Santander Consumer USA to waive 5,000 of what's owed on this vehicle, so that I can pay it off and move forward with my life.

As instructed by Customer Service, I faxed proof to Santander's accounting department showing these payments were made early. I have proof the fax was received. 1. Santander should have never rejected the payments as I have made the payments this way, with the exception of one or two payments, years ago, since I've had the loan since 2017. 2. The $42.33 in late charges should have never been applied. As of this date, even though I sent clear proof I made my attempt to faithfully send the payments, the $42.33 in late charges have yet to be removed. Since my first payment, which was due on August 1, 2017, I have NEVER had a late payment with Santander by my own actions or non-actions. In fact, all payments have been made early. Santander rejected the first payment referenced according to Bluebird by American Express. Since that payment was rejected by Santander, I cancelled the second payment myself fearing negative responses from Santander. If they review my account and the faxed documents, they can clearly see that in good faith I have NEVER had a late payment. The payment delivered on 1-27-2020 was cancelled by Santander!
Apologies, I can't seem to upload more than one file so I uploaded the one that was most pertinent. I can provide all documentation if needed.
I've attempted to call Santander on several occasions but they are apparently still dumping all calls from their queue. I sent them an email on 3-31-20 and have yet to receive a response.

Not applying pay off amount and closing my account.
This company holds the loan to my 2013 Kia Soul. The car was totaled in an accident on 3/15/2020. My insurance company, Geico, issued a payoff loan check #XXXXXXXXX in the amount of $2041.14 on April 3, 2020. They were told the payoff amount was good until 4/17/2020. I kept checking my account online to see when my account would clear. Another payment was due on April 20th for 187.77. I kept calling Santander to find out what was going on. They kept telling me they didn't receive the check. The balance was still showing. They told me to give it a week or two and it would clear. I checked my account again and it now has an additional $187.77 added to it for the next month and I was showing Past Due. I was told that I would be charged a late charge in 10 days less now, and my credit would be affected in 30 days.
I called my insurance company today, April 27, and was told they cashed the check on April 24th. I again checked my account and its still showing a balance of $375.54.
I spoke to a representative from Santander today and he was very rude. I did not get his name.
Its not my fault that they did not cash a check that was issued on April 3rd till the 24th of April and the check still hasn't been credited to my account.
I have spent almost a month trying to resolve this issue to no avail. I formerly want to make a complaint that this company does not deserve an Aplus rating. I've also sent 4 emails and received no replies to any of them.

Please note that effective March 2, 2020, all Gateway One Lending & Finance (Gateway) accounts will now be serviced by Santander. We provided notice of the conversion of your Gateway account to Santander in a letter sent to you dated February 21, 2020.

A review of the account payment history shows that on May 6, 2020, a Total Loss insurance payment in the amount of $2,035.49 posted to your account, effective March 15, 2020 (the date of loss). An internal processing issue prevented the payment from posting to the account sooner; however, the payment satisfied the remaining balance in full. Further note that you did not incur any additional charges because of the delay in processing the payment.

Please accept our apologies for any inconvenience this situation may have caused you during the transition of service, and for any negative experience you may have had with our representatives while trying to reach a resolution to your concerns. The experience of our customers is of the utmost importance to us and we appreciate your feedback.

Be advised that Santander has not yet initiated credit reporting for any of the recently acquired Gateway accounts; however, reporting is tentatively scheduled to commence on May 31, 2020. We ask that you contact us again with any questions or concerns you *** have after we have commenced reporting the account to the credit agencies.

They credited my account and apologized.

The vehicle in question was voluntarily returned. The balance that is owed is not correct. They resold the vehicle.
Three Santander representatives confirmed that the vehicle was in fact returned and resold. The last representative that I spoke with said that the vehicle was only sold for $700, which left my balance at $6,550. Now, after two years of not having the vehicle, Santander sold the "remainder" of the loan to NCB Management Services. I feel that they sold the vehicle for more than $700 and that the amount owed is incorrect.

Desired Outcome

The account with Santander was closed for two years. Now there is a collection account. I would like the collection account removed from my credit report.
