Santander is not doing their job correctly. They claim that we are behind in payments. Now they have sent a NOTICE OF RIGHT TO CURE. Please try to get them to do what is right. We don't have the money they want. Check the reviews, they don't have any good ones. Thank you, ***.

My bank double played some bills ( a computer problem) and I was left short for my car payment for one month. I resumed regular payments plus whatever extra I could afford to catch up the missed payment. A couple months later, they contact me because I was still a month behind. My payments are $303 so I paid $350, $75 a week later, $175 the next week. Still said I was a month behind. Turns out anything less than a FULL payment will not go towards the missed payment, it goes towards interest. Still waiting for a bank statement, but I have paid over $500 trying to get my account current, none of which has gone towards the arrears.

My vehicle was totaled, insurance paid the cost of the loan. I was told that I would received a refund of $1114.88. Only got $560.24.
I called to confirm what I would be receiving back for a refund and was told $1114.88 Oct. 17th. I called again on Oct 2th bc I received a check for $560.24. I was told I was being charged a vehicle return fee of $495 that I was also told I would not have to pay several times prior to the recent phone calls. They do see the notes in the system that I was promised $1114.88 but stated I was misinformed. Which I have been misinformed multple times if that is the case. I was also told by the leasing department that I have been on time with my payments that I could lease another vehicle due to good faith. When I wen to the dealership I was told that I was unable to get another vehicle to lease due to my credit. When I was actually told that I could lease because of good faith with the totaled vehicle.

Desired Outcome

I am looking for a refund of $495 that I was promised that I would not have to pay since my vehicle was not returned due to my own choice but for because the vehicle was totaled by someone else. I would also like to lease another vehicle because I was told I would be able to due to good standing with payments on my account.

We have received your complaint submitted through the Revdex.com (Revdex.com) regarding the above referenced Chrysler Capital account. Thank you for allowing us the opportunity to address your concerns.

Please note that per the terms of your lease agreement, "Additional terms: Information about a Security Deposit and a Late Charge can be found in the additional Lease term section. In addition to the other amounts promised in this lease, you agree to pay the following: Vehicle return fee of $495.00 if the vehicle is not returned to us or our agents. This fee will not apply if the Lease ends early by your purchase of the vehicle."

Please be advised after a review of the account we have confirmed that a vehicle return fee in total amount of $495.00 was assessed to the account and was valid. However, this fee was included with the total loss and was paid with the proceeds received from the insurance carrier.

A review of the account indicates that a refund of $557.44 was issued on the account on October 16, 2019. In addition, a second refund of $350.45 was issued to you as well on October 28, 2019 due to overage after total loss funds were received and posted to the account.

The overage refunds were sent via U.S. Mail. Our records indicate both refunds were mailed to your address of record noted above.

In regarding to the refund amount provided to you we regret any miscommunication regarding this matter.

The Fair Credit Reporting Act states that we are required to accurately report all account information to the Credit Bureaus. Please note that we provide account information to the four major credit reporting agencies Experian, Equifax, Transunion, and Innovis. It may be necessary to contact the agencies directly regarding any disparity between reports.

As a matter of information, Santander has current policies and procedures that meet the Federal and State requirements necessary to be in compliance with certain debt collection practices, as it is Santander's objective to protect its customers from unfair debt collection acts.

A review of the information provided to the credit reporting agencies shows that on November 6, 2019 we have requested update to indicate: Closed Current as of September 11, 2019 with no delinquencies reported.

In regard to your request to lease another vehicle, please be advised that we have reviewed our records and determined that no application for credit has been submitted to either lease or purchase a vehicle with financing through Chrysler Capital. Once a credit application is submitted through the dealership of your choice, financing would be either approved or denied at the time of submission.

Refunds were issued in the total amount of $907.89, and we respectfully decline to issue any additional refunds on the account.

I do not accept the response from this business and the reason being is not only did one represenative misinform me or "miscommunicated", but many did. I am not at fault for calling in to customer service and speaking with people who I am to look to for the correct information provided to me.

I see that another check was sent out for $350.45. However, I have not received a check in the mail for that amount. I did receive the first one for $557.44.

As a major bank serving customers, I would hope in the future that someone will take this as a learning experience and coach their staff to not give out incorrect information.

My vehicle was totaled, insurance paid the cost of the loan. I was told that I would received a refund of $1114.88. Only got $560.24.
I called to confirm what I would be receiving back for a refund and was told $1114.88 Oct. 17th. I called again on Oct 2th bc I received a check for $560.24. The vehicle was flooded after the great flood of 2016 and paid via insurance and Gap. I was unaware of a remaining balance and hope that if a balance remain it can be forgiven or a settlement offered due to financial hardship. I recently disputed this account with the credit reporting bureaus, and the information was reported as verified and accurate. I'm sure we both understand that most disputes are often conducted using software, such as e-Oscar, and that mistakes can be made during that process, and that the software can have limitations when it comes to completing a proper investigation of records. I am disputing the following information directly with you, the furnisher of information, and I am requesting that you conduct an investigation as outlined in the FCRA Section 623: The account has been charged off and still is reporting a balance. If you're unable to perform a reasonable investigation, or you're unable to locate the necessary documents to investigate my dispute(s); then you are required by the FCRA to remove the negative information from my credit reports, which can also include complete removal of the account. Please be advised, the vehicle associated with the above referenced account was declared a total loss on or about August 12, 2016; a claim was filed with your insurance company, State Farm Insurance. Prior to August 12, 2016 the account's principal balance was $13,798.39.

The enclosed payment history reflects that total loss proceeds in the amount of $6,334.00 posted to the account with an effective date of August 12, 2016. Following total loss proceeds, we received a GAP payment in the amount of $6,393.11, which posted to the account on October 14, 2016. Also, an Extended Warranty payment in the amount of $552.80, which posted to the account on December 16, 2016. Our records indicate that no other payments were received for the account after December 19, 2016.

Please be advised that we do not determine the amount that the insurance carrier elects to pay. Please note that it is the customer's responsibility to continue to make payments on the account until all insurance proceeds are received and the account reflects a zero balance.

I had back surgery on 7/26/19. They repossessed my car 8/3/19 and said I had until 8/16/19 to pay it off. I had to jump through hoops just trying to get them the payoff. Only could be received by cashier's check through the US Mail. I talked to several employees in the company to ensure that I was doing everything correctly. I was told several times that you have until 8/16/19 to pay it off. It was my understanding throughout all the phone calls and voice mail HELL, MY CAR HAD BEEN MOVED TO AN AUCTION OVER TWO HOURS AWAY. I have 23 staples in my back and they refuse to move the car back to Lakeland. I had to go to the emergency room that evening due to my blood pressure out of control and the stress. I made the drive on Tuesday to Sarasota without my surgeon knowing. That drive caused me severe pain. This company has no respect for their customers. I would never refer anyone to them for a loan. You would be better off going to a local buy here pay here. STILL AWAITING RESPONSE ON MY CLEAR TITLE ð?¤?ð?¤?ð?¤?

In May 2019, I financed a 2019 Ford Escape through Santander Consumer USA. Fast forward to July 12 2019, I was robbed at gunpoint while at an ATM and forced to empty out my bank account. I was subsequently beat and ended up being in a coma. It was so bad that evidently, my family was advised to prepare for the worst as they didn't think I would regain consciousness. I awoke on September 18, 2019. I was kept for observation and was cleared to return home on September 26, 2019. I retrieved the vehicle from impound on this day as well.
I had noticed several missed calls from Santander once I started going through all the calls and messages while I was hospitalized, due to not receiving payments. It is just me, both of my parents are deceased and I do not have a mate to pay bills on my behalf. My plan was to contact Santander on the morning of 9/27. I had just spent over 2 months in the hospital and just wanted a good nights sleep in my own bed. They had to have been looking for the vehicle for sometime, because oddly enough, I come out of my home on the morning of 9/27 to see the vehicle is gone.
I immediately contacted Santander and was advised the vehicle had been repossessed. I explained my situation and asked what I can do to retrieve my vehicle. Santander stated they will not allow me to retrieve the vehicle, unless the loan was pain in full. The amount past due at the time was $1800 The full loan is in excess of $25,000! Their reasoning for not allowing me to just pay the past due amount and retrieving the vehicle is because I had not responded to their numerous attempts to contact me and that I have proven to be an unreliable customer for failing to make timely payments. I reiterated the fact that I was in the hospital and that I have documentation to prove this. Santander still refused to budge even after speaking to several supervisors. They would all respond with "Its not personal sir, it's just business" Not one person I spoke with showed any empathy in regards to my situation. A supervisor named Maria (Employee ID: 011547) even began to yell at me when I asked her if she knew what it was like to be hospitalized for an extended period of time. Her words were "This isn't about me sir" I just wanted her to put herself in my shoes.
Now I no longer have a vehicle, I will more than likely be stuck with a hefty bill, and my credit is shot now that it shows up as repossessed. When I research the vehicle, it's estimated between $10,000 and $15,000 based on the mileage. When they auction this vehicle, they will not get anywhere close to the full $25,000 loan amount meaning I will be billed for the remainder of the loan amount. LONG STORY SHORT STAY AWAY FROM THIS COMPANY BECAUSE AS THEY STATED "IT IS JUST BUSINESS". They will not do anything to help you if you experience hardship.

I had a van repo that I paid all of the fees of almost$ 4,00 that included all fees and payments to reinstate but they're now telling me that I again owe them $700 more because of a late assessment of repo fees. This is very confusing to me because I'd previously got a claim submitted for a $1,700. charge that they were charging me that had been included in the almost$4,00 amount. I called and still can't get a clear answer as to why I again owe them "miscellaneous" fees ( as stated on the payment record) that I'd paid previously. They never even gave me an answer to the claim that was put in either way. I am so sick of this company!!! DO NOT USE THEM!!! They will take all that they can. I am now looking for a way out :(

Called the dealership and it turns out that Santander never paid the dealership for my truck and it's been over 30 days since I had the truck. Not sure if the dealership is gonna want it back or if It's gonna get repo right away from Santander once they pay the dealer because I'm technically late on my truck payment even though I couldn't make a payment because I don't have an account with them yet... Very frustrating and stressful situation. I depend on this vehicle to get to work and home. :(

Checked my account statement online for the last 6 months. accounting information regarding my loan is incorrect and shows a higher amount due than what is actually due at this time. possible money laundering and fraudulent activity happening as money is not accounted for based on statements they have provided which do not match my financal statements from bank and accountant. Spoke to FBI to report suspicious activity and was advised to also file a complaint with attorney general of NY and TX including IRS to investigate issue. Also requested all statements regarding my auto loan to be sent via email/ mail and Santander employee stated they " delete files and only keep items for one year" which was recorded on phone line. Statement given by Santander Consumer states I owe total amount of $10754.19 as of 08/17/2019. Accountant stated I should only owe a total amount of $9436.15 as of 08/17/2019. The amount of $1318.04 has been conclusive to not be accounted for that should have gone towards principle amount due. Some statements produced by Santander are blank. Statements also show on several occasions total amount of monthly payment went to interest only futhermore Based on a fixed rate stated in contract that can not be applicable and is conclusive that is predatory lending which is illegal and fraudulent.

Desired Outcome

For account to be appropriately credited before litigation arises. Accounting practices are fraudulent. I have contacted FBI, IRS, Attorney General, my attorney, and my accountant and will go to all media outlets i find appropriate if account is not fixed within guidelines asked of by the Revdex.com.

Our records indicate that on April 20, 2017, you entered into a Retail Installment Contract - Simple Finance Charge (Contract) to purchase a 2015 Chevrolet Cruze (Vehicle). The amount financed was $12,728.15, at an annual percentage rate (APR) of 19.77%. The Contract disclosed a term of 72 monthly payments in the amount of $303.18 each, which began on May 20, 2017. The Contract was assigned to Santander.

In regard the total amount paid on the Vehicle thus far, we refer you to the Federal Truth-in-Lending Disclosures on Page 1 of the Contract. Under the section titled "Finance Charge", the dollar amount that the credit will cost you, is $9,100.81, plus the "Amount Financed" of $12,728.15, equals the amount paid under the section titled "Total of Payments", which reflects the amount of $21,828.96. This is the amount you would have paid if all payments had been made according to the payment schedule set forth in the Contract.

After a review of the account, we have determined that the reduction of the principal balance is accurate. In the agreed upon Contract, it shows that the account is calculated using the Simple Interest Method. This means the balance accrues interest on a daily basis and assumes the customer will make their payment on the regularly scheduled payment due date.

The amount of interest accrued daily can vary based on the amount of the principal balance and the number of days between payments. When a payment is received, the outstanding accrued interest must be satisfied first, then the remainder of the payment is applied toward principal and any fees owed on the account.

Over the life of the account you requested and were granted 2 monthly payment extensions and 1 due date change. In addition 21 payments were not paid within 10 days of the scheduled due date, which caused late fees to be assessed to the account. Due to the repossession of the Vehicle on November 23, 2018, repossession fees were also assessed to the account.

Please note that interest does not stop accruing when there has been payment assistance granted on the account or when payments are late. There is no grace period for the accrual of interest.

Due to the payment assistance and payment pattern, more interest accrued between payments, causing the principal balance to reduce more slowly. If payments had been received according to the contracted payment schedule of 72 months, the principal balance would be less.

We regret any miscommunication regarding your billing statements or if you received billing statements which were blank. Enclosed are copies of the requested billing statements from *** 31, 2017 through August 20, 2019.

Took out an auto loan with Santander Consumer USA. I believe (along with several others) they are embezzling money from their customers. Over the entire length of my loan each statement I receive from Santander Consumer shows the principle and interest have fluctuated each month. Some months 100% of my monthly payment goes directly to interest and none to principle. I have researched countless hours and speaking to many accounting professionals regarding my loan and it was founded that my current payoff balance is not what it should be. It is actually higher than what it is supposed to be at this time. I have supporting documents stating my claim. I have reached out to Santander Consumer regarding my previous statements that I could not acquire online and I was told directly on a recorded line "They delete all loan records after 1 year" I can not obtain any financial records regarding my loan prior to one year from present time. My loan is only 2 years old at this time. As a result I will be owing thousands of dollars at the end of the loan life. This is due to them charging more interest that what is stated in their contract (taking more money and putting it towards interest and not principle.) These loans are fixed rate loans. auto loans use simple interest, which means the interest is calculated only on the amount you borrow with no compounding. Section 108 of the Truth in Lending Act contains the administrative enforcement provisions for that Act. Sections 112, 113, 130, 131, and 134 contain provisions relating to liability for failure to comply with the requirements of the Truth in Lending Act and the regulation. Section 1204(c) of title XII of the Competitive Equality Banking Act of 1987, Public Law XXX-XX, 101 Stat. 552, incorporates by reference administrative enforcement and civil liability provisions of sections 108 and 130 of the Truth in Lending Act. The multiple failure to disclose to any person any information required under this part or part D or E of this subchapter to be disclosed in connection with a single account under an open end consumer credit plan, other single consumer credit sale, consumer loan, consumer lease, or other extension of consumer credit, shall entitle the person to a single recovery under this section but continued failure to disclose after a recovery has been granted shall give rise to rights to additional recoveries. This subsection does not bar any remedy permitted by section 1635 of this title.

Accounting practices Fraudulent
Checked my account statement online for the last 6 months. accounting information regarding my loan is incorrect and shows a higher amount due than what is actually due at this time. possible money laundering and fraudulent activity happening as money is not accounted for based on statements they have provided which do not match my financal statements from bank and accountant. Spoke to FBI to report suspicious activity and was advised to also file a complaint with attorney general of NY and TX including IRS to investigate issue. Also requested all statements regarding my auto loan to be sent via email/ mail and Santander employee stated they " delete files and only keep items for one year" which was recorded on phone line. Statement given by Santander Consumer states I owe total amount of $10754.19 as of 08/17/2019. Accountant stated I should only owe a total amount of $9436.15 as of 08/17/2019. The amount of $1318.04 has been conclusive to not be accounted for that should have gone towards principle amount due. Some statements produced by Santander are blank. Statements also show on several occasions total amount of monthly payment went to interest only futhermore Based on a fixed rate stated in contract that can not be applicable and is conclusive that is predatory lending which is illegal and fraudulent.

Desired Outcome

For account to be appropriately credited before litigation arises. Accounting practices are fraudulent. I have contacted FBI, IRS, Attorney General, my attorney, and my accountant and will go to all media outlets i find appropriate if account is not fixed within guidelines asked of by the Revdex.com.

We have received your complaint submitted through the Revdex.com (Revdex.com), regarding the above-referenced Santander Consumer USA Inc. (Santander) account. Thank you for allowing us the opportunity to address your concerns.

Our records indicate that on April 20, 2017, you entered into a Retail Installment Contract - Simple Finance Charge (Contract) to purchase a 2015 Chevrolet Cruze (Vehicle). The amount financed was $12,728.15, at an annual percentage rate (APR) of 19.77%. The Contract disclosed a term of 72 monthly payments in the amount of $303.18 each, which began on May 20, 2017. The Contract was assigned to Santander.

In regard the total amount paid on the Vehicle thus far, we refer you to the Federal Truth-in-Lending Disclosures on Page 1 of the Contract. Under the section titled "Finance Charge", the dollar amount that the credit will cost you, is $9,100.81, plus the "Amount Financed" of $12,728.15, equals the amount paid under the section titled "Total of Payments", which reflects the amount of $21,828.96. This is the amount you would have paid if all payments had been made according to the payment schedule set forth in the Contract.

After a review of the account, we have determined that the reduction of the principal balance is accurate. In the agreed upon Contract, it shows that the account is calculated using the Simple Interest Method. This means the balance accrues interest on a daily basis and assumes the customer will make their payment on the regularly scheduled payment due date.

The amount of interest accrued daily can vary based on the amount of the principal balance and the number of days between payments. When a payment is received, the outstanding accrued interest must be satisfied first, then the remainder of the payment is applied toward principal and any fees owed on the account.

Over the life of the account you requested and were granted 2 monthly payment extensions and 1 due date change. In addition 21 payments were not paid within 10 days of the scheduled due date, which caused late fees to be assessed to the account. Due to the repossession of the Vehicle on November 23, 2018, repossession fees were also assessed to the account.

Please note that interest does not stop accruing when there has been payment assistance granted on the account or when payments are late. There is no grace period for the accrual of interest.

Due to the payment assistance and payment pattern, more interest accrued between payments, causing the principal balance to reduce more slowly. If payments had been received according to the contracted payment schedule of 72 months, the principal balance would be less.

We regret any miscommunication regarding your billing statements or if you received billing statements which were blank. Enclosed are copies of the requested billing statements from *** 31, 2017 through August 20, 2019.

We respectfully decline to adjust the remaining balance owed on the account as the balance owed is accurate and payments have been applied according to the Contract.

Enclosed is a copy of the Contract, Billing Statements, Notice of Right to Reinstate and Right to Redeem and payment history for your records.

Took out an auto loan with Santander Consumer USA. I believe (along with several others) they are embezzling money from their customers. Over the entire length of my loan each statement I receive from Santander Consumer shows the principle and interest have fluctuated each month. Some months 100% of my monthly payment goes directly to interest and none to principle. I have researched countless hours and speaking to many accounting professionals regarding my loan and it was founded that my current payoff balance is not what it should be. It is actually higher than what it is supposed to be at this time. I have supporting documents stating my claim. I have reached out to Santander Consumer regarding my previous statements that I could not acquire online and I was told directly on a recorded line "They delete all loan records after 1 year" I can not obtain any financial records regarding my loan prior to one year from present time. My loan is only 2 years old at this time. As a result I will be owing thousands of dollars at the end of the loan life. This is due to them charging more interest that what is stated in their contract (taking more money and putting it towards interest and not principle.) These loans are fixed rate loans. auto loans use simple interest, which means the interest is calculated only on the amount you borrow with no compounding. Section 108 of the Truth in Lending Act contains the administrative enforcement provisions for that Act. Sections 112, 113, 130, 131, and 134 contain provisions relating to liability for failure to comply with the requirements of the Truth in Lending Act and the regulation. Section 1204(c) of title XII of the Competitive Equality Banking Act of 1987, Public Law XXX-XX, 101 Stat. 552, incorporates by reference administrative enforcement and civil liability provisions of sections 108 and 130 of the Truth in Lending Act. The multiple failure to disclose to any person any information required under this part or part D or E of this subchapter to be disclosed in connection with a single account under an open end consumer credit plan, other single consumer credit sale, consumer loan, consumer lease, or other extension of consumer credit, shall entitle the person to a single recovery under this section but continued failure to disclose after a recovery has been granted shall give rise to rights to additional recoveries. This subsection does not bar any remedy permitted by section 1635 of this title.

As stated on your Contract, the account is calculated using the Simple Interest Method and is not calculculated using a fixed rate. In addition, interest is not compounded daily on the account. This means the balance accrues interest on a daily basis and assumes the customer will make their payment on the regularly scheduled payment due date. The daily interest rate on the account is calculated at an APR of 19.77%. Your daily interest rate is calculated using the following formula:

(Principal Balance x Contract Interest Rate) / 365 = Daily Interest

The amount of interest accrued daily can vary based on the amount of the principal balance and the number of days between payments. When a payment is received, the outstanding accrued interest must be satisfied first, then the remainder of the payment is applied toward principal and any fees owed on the account.

Over the life of the account you requested and were granted 2 monthly payment extensions and 1 due date change. In addition 21 payments were not paid within 10 days of the scheduled due date, which caused late fees to be assessed to the account. In some months, other than the extension term, no payment was received or the payment received was less than the contracted monthly amount. In addition, 2 payments were returned by your financial institution for non-sufficient funds.

Please note that interest does not stop accruing when there has been payment assistance granted on the account or when payments are late. There is no grace period for the accrual of interest.

Due to the payment assistance and payment pattern, more interest accrued between payments, causing the principal balance to reduce more slowly. If payments had been received according to the contracted payment schedule of 72 months, the principal balance would be less.

Please be advised that in our previous response we provided you with all of the account documents, including all of the billing statements since the inception of the account. We regret any miscommunication regarding this matter.
