Lender is saying car is behind but not contacted to make payment. Just made payment on 11-1-19
I purchased a Jeep Grand Cherokee in June 2018. Santander was selected because of credit issues. I have been out of work due to illness and I spoke with the lender in many occasions and they stated they notated my account but collection calls continued. Last night with no notice the car was taken from my residence and it tore my driveway up. Have no clue who the company was that repossessed the car. It is my only means of transportation as I have three children that have to be taken care of also. I am wanting to get this back but based on the reviews it looks like they aren't willing to work with anyone.

Desired Outcome

I want my car returned to me with the balance to be updated correctly and then also be compensated for the damage to our property

Our records indicate that, a letter titled, "Notice of Right to Cure" (RTC) dated September 8, 2019, was mailed to you at the address on file, stating that the account was in default and if not cured by September 17, 2019, we would take possession of the vehicle associated with the account.

Please note a payment of $455.48 was received on November 1, 2019, however the full default amount was not cured, and the vehicle was repossessed on November 23, 2019, when the account was 97 days past due. After the repossession, a letter titled "Notice of Our Plan to Sell Property" (NOI) dated November 24, 2019 was mailed to you at the address on file, explaining that the vehicle would be sold sometime after December 8, 2019, but also gave you the opportunity to redeem the vehicle.

In addition, we have attempted to contact you several times regarding the delinquency of your account prior to the repossession of the vehicle, with no success along with sending you monthly billing statements advising of the amount due on the account.

Our records further indicate that you contacted our office on November 25, 2019 after the repossession and were advised in order to reinstate and redeem the vehicle, the account balance must be paid in full. In an effort to assist you with the redemption of your vehicle, we have placed a hold at auction until December 19, 2019. Please contact our office at the number below if you choose to redeem your vehicle.

In reference to damage to your driveway during repossession, please contact our office in order to make a claim. At this time, we respectfully decline your request for compensation.

Enclosed is a copy of the Contract, Payment History, RTC and NOI for your records.

If I could give 0 stars as well I would. I bought my car in July 2017. I was only given the choice of one car due to my credit at the time after being in a car accident the previous December. I was out of work from June 2018 to October 2018. I called Santander to see if they could help me in any way like tack everything on to the end of the loan. They said they could not and I ended up with 5 late payments on the account, they will also not remove the late payments as I sent a goodwill letter to them. I ended up getting the account current but even after that, it started showing on my statements that I owed $800 and my normal car payment is $328. I have looked through all of my statements from July 2017 until now and cannot for the life of me figure out why the amount owed was so much after I got everything current. I am pretty sure they owe me money. They are literally the worst company ever. I just want to get my car paid off so I can move and try to continue working on my credit. I will never use them again.

In reference to your concern that you have been requesting the Contract for over five (5) months, in addition to calling over ten (10) times to get this matter resolved, our records indicate that each time communication was made with our Customer Service Department, the request to send your Contract via mail and fax was submitted and completed accordingly.

After a review of the account, our records indicate on July 3, 2019, contact was made with our Customer Service Department, advising a copy of the Contract was needed, due to a state change. During that time a fax number (309) 686-7898 was provided in addition to mailing a copy to the address on file, which is the same address in the complaint. During this time I was not able to ensure that my credit card was place on auto bill. This was a very difficult time in my life, and I am asking for forgiveness. Our records indicate that on August 28, 2017 you entered into a Retail Installment Sale Contract (Contract) with Toyota of *** (Dealership) in connection with the purchase of a 2014 Dodge Dart (Vehicle). The amount financed was $15,618.40 at an annual percentage rate (APR) of 23.19%. The payment schedule called for 72 monthly payments of $407.36 each month, with the first payment due on October 12, 2017. The Contract was assigned to Santander.

We apologize if the terms or conditions of the Contract were not explained to you by the Dealership when you financed the Vehicle. It is the customer's responsibility to review the terms of any contract before signing.

Santander sets interest rates based on many factors including but not limited to the current value of the vehicle, the applicants' credit worthiness, and their credit rating. Santander proposes funding for the applicant which they can either accept or reject at the time of their application. We have confirmed that the APR reflected on the Contract is within the allowable state limits.

After a review of the account, we have determined that the reduction of the principal balance is accurate. In the agreed upon auto finance Contract, it shows that the account is calculated using the Simple Interest Method. This means the balance accrues interest on a daily basis and assumes the customer will make their payment on the regularly scheduled payment due date.

When a payment is received, the accrued interest must be satisfied first, and the remainder of the payment is applied toward principal and/or fees owed on the account. The amount of interest accrued will vary based on the amount of the principal balance and the number of days between payments.

Over the life of the account you requested and were granted three (3) monthly payment extensions and one due date change In addition, seven (7) payments were not paid within 10 days of the scheduled due date, which caused late fees to be assessed. In some months, either a partial payment or no payment was received.

Please note that interest does not stop accruing when there has been payment assistance granted on the account or when payments are not received or are received late. There is no grace period for the accrual of interest.

Due to the payment assistance and payment pattern, more interest accrued between payments, causing the principal balance owed to reduce more slowly. If payments had been submitted in a timely manner, according to the contracted payment schedule, the principal balance would have been less.

Our records indicate that on April 22, 2019 the Vehicle was repossessed when the account was 131 days past due. On April 23, 2019, a payment in the amount of $2,391.68 was received to redeem the Vehicle.

Please be advised that Santander does not refinance, or negotiate the balance owed on its existing accounts. You make seek alternate financing with a financial institution of your choice.

We respectfully decline your request for Santander to either buy out the Contract or to be placed in a different Contract.

As of the date of this response, the account is current and the next payment is due on December 27, 2019. Enclosed are copies of the Contract, Contract Assignment and Payment History.

As a US Army combat veteran I am completely offended of how I get treated by this Financial Institution at the time of purchase I was kind of in a rush to get a vehicle due to mine being totaled. At the dealership I asked what my rate was they beat around the bush and said it was below 10% which I was cool with I asked who it was financed with they said Chrysler capital which I wasn't familiar with I asked if it was in house financing or primary or secondary financing. They said it was primary which is a LIE because after research I found out its owned by SANTANDER which had I known I would never financed with. Which the dealership practices isn't their fault I agree. However called Chrysler capital to see my interest rate which they transfer you around multiple times and different departments each one saying they cant give me that info finally get to one who has to mail me it. Long story short I found out they gave me 19% percent rate which is ridiculous when they lied and said it was below 10.Now to further extent I am veteran who takes care of a disabled mother as well as two sisters all 3 cant work due to age and disability. So over almost 5 years of the loan I have been a little late about 4-5 times in the whole 5 years but lets just say 5 times due to my situation and balancing bills. Which I caught up to date now my most recent time being late the 4th or 5th was 2 months ago. Now I go to make a payment instead of my payment $600 being doubled $1200 due to missed payment I some how owe 4x as much saying $2800 I asked how they say I have $600 in late fees. I said What I get Charged $200 every time im late they said no 30 dollars I said that doesn't add up that would mean I have been late over 20 times in the course of the loan which lets make this clear havent. That being said I said that makes 1800 dollars asked where did the other 600 come from. Meanwhile two months ago everything was correct. Then they started to say I have been paying the previous months and not the current months since 9 months ago they have said I have been playing catch up. Which is false because as I previous state the payment I made 3 months ago before I was late everything was correct and up to date. Since that conversation 3 weeks ago I made a 600 dollar payment a week ago and called and made another 600 payment today and the balance is 2400 which doesn't make sense mathematically at all BEWARE PREDATORY LENDING I WILL NEVER FINANCE THROUGH CHRYSLER CAPITAL EVER AGAIN . THEY MAKE UP THINGS AND TRY TO MAKE PAY RIDICULOUS FEES AND DO NOT UPDATE BALANCES CORRECTLY

Our records indicate that on August 28, 2017 you entered into a Retail Installment Sale Contract (Contract) with Toyota of *** (Dealership) in connection with the purchase of a 2014 Dodge Dart (Vehicle). The amount financed was $15,618.40 at an annual percentage rate (APR) of 23.19%. The payment schedule called for 72 monthly payments of $407.36 each month, with the first payment due on October 12, 2017. The Contract was assigned to Santander.

We apologize if the terms or conditions of the Contract were not explained to you by the Dealership when you financed the Vehicle. It is the customer's responsibility to review the terms of any contract before signing.

Santander sets interest rates based on many factors including but not limited to the current value of the vehicle, the applicants' credit worthiness, and their credit rating. Santander proposes funding for the applicant which they can either accept or reject at the time of their application. We have confirmed that the APR reflected on the Contract is within the allowable state limits.

After a review of the account, we have determined that the reduction of the principal balance is accurate. In the agreed upon auto finance Contract, it shows that the account is calculated using the Simple Interest Method. This means the balance accrues interest on a daily basis and assumes the customer will make their payment on the regularly scheduled payment due date.

When a payment is received, the accrued interest must be satisfied first, and the remainder of the payment is applied toward principal and/or fees owed on the account. The amount of interest accrued will vary based on the amount of the principal balance and the number of days between payments.

Over the life of the account you requested and were granted three (3) monthly payment extensions and one due date change In addition, seven (7) payments were not paid within 10 days of the scheduled due date, which caused late fees to be assessed. In some months, either a partial payment or no payment was received.

Please note that interest does not stop accruing when there has been payment assistance granted on the account or when payments are not received or are received late. There is no grace period for the accrual of interest.

Due to the payment assistance and payment pattern, more interest accrued between payments, causing the principal balance owed to reduce more slowly. If payments had been submitted in a timely manner, according to the contracted payment schedule, the principal balance would have been less.

Our records indicate that on April 22, 2019 the Vehicle was repossessed when the account was 131 days past due. On April 23, 2019, a payment in the amount of $2,391.68 was received to redeem the Vehicle.

Please be advised that Santander does not refinance, or negotiate the balance owed on its existing accounts. You make seek alternate financing with a financial institution of your choice.

We respectfully decline your request for Santander to either buy out the Contract or to be placed in a different Contract.

As of the date of this response, the account is current and the next payment is due on December 27, 2019. Enclosed are copies of the Contract, Contract Assignment and Payment History.

They are thieves and they charge ridiculous interest rates. They don't empathize with you at all and make you feel like a complete failure. Don't EVER use them.

Today 11/14/19 my car got repoed. I called Santander to see what I owed to get my car back. I got behind about a two months in payments and said they have tried to contact me first off they never tried to contact me in the last two weeks and sent a notice about it being that close. I talked with them a couple weeks ago and they said they would work with me and they lied. When I called they told me I had back payment of $900 something and that is all I had to pay to get my car back today when I called back to make the payment they then changed their store and I was told I had to pay the full loan of over 16 thousand dollars or I wouldn't get my car. This is the first time the car has been repoed and I have done my research the first time they are suppose to allowed you to pay the back payment to become current and then if it happens a second time then you have to pay it all up front. My credit is shot now because of have a car repoed. They don't work with you and they lie to you. They are doing it illegally and hurt customers. DO NOT USE THEM AT ALL. I NOW HAVE TO PAY THEM OFF BECAUSE THEY ARE GREEDY AND UNWILLING TO WORK WITH THEIR CUSTOMES.

My account is past due but they are call 3 to 5 times a day. Even after leaving a message they continue to call. And if they are collecting money that is against the FDCPA. You cannot continue to call after message was left. The only way to stop calls is to secure a payment. They offer no payment arrangements really for people in financial situations. And I feel as if im being harassed. I want and need my car and would love to be current but life happens. Harassing someone does not make it any easier and it has escallated my depression and anxiety and I had to go to the doctor for help.

Desired Outcome

I would like a credit made to my auto loan of at least one payment as i have had to pay 500.00 to go to doctor since i do not have insurance and now i cant pay my loan payment
