Maronda indicated that they would repair the concrete on a "one time basis" . Although I accept Maronda replacing the concrete, I am concerned about their indicating this will only be on a "one time basis". The reason for this request to begin with is because their last repair was not made correctly. If the repair is not made correctly by Maronda this time, I would not want them indicating that they only agreed to One time only. I would appreciate if Maronda would simply indicate that they will replace the concrete.

Dear Mrs [redacted] I have been able to review the complaint made by the homeowner and review our information in our systems. Our production supervisor has met with the homeowner on the concrete issue. I have attached a picture of the concrete in question. At the time of the...
meeting our production supervisor explained the concrete and that it does not fall within the warranty guidelines and would not be being replaced. They did however make some changes in yard or grading of the home. The concrete issues has been closed. As the homeowner has confirmed the HVAC system is functioning properly, but is a comfort level problem. I have confirmed with our HVAC testing company that the unit is the correct size for the central return air systems used in the homes. Dear Mrs. [redacted], This is a follow up to this complaint. I have met with the homeowner today at the residence and preformed a few tests for the following issues. Maronda Homes did a water test and found a point if entry of water. Maronda Homes will be setting up to correct this...
issue and we have relayed this information to the homeowner. Maronda Homes has also preformed an HVAC check. The system was operating properly and the temperatures in the home where all within spec. There was a difference of 2 degrees between floors and rooms as well as thermostat readings. It was found there was higher humidity in certain rooms. The homeowner did evaluate the test with us in each room. I confirmed this afternoon that the correct units are installed in the home and at this point no further action is needed. I spoke to the homeowner about his lawn and Maronda Homes did remove most/all of the material in the yard at this point. We are awaiting to see if any should return. I want to confirm that if there is an issue with the exhaust fan or water damage is discovered, Maronda agrees to restore/replace any item or items that are damaged. Also, in regards to the grass/yard, I will contact customer service for top soil and seed. However, I would like bagged top soil and bagged seed. I do not want a pile of top soil dropped in my driveway. I want to be assured that we do not receive "dirt" with rocks and tree branches in it. As for the basement screen, I'm not sure how long it takes to get a screen from the manufacturer, but it has been "on order" since the end of November 2016. I hope it arrives soon!

For your reference, details of the offer I reviewed appear below.It has been five days (the time the Revdex.com said I have to respond) since Maronda's response to my complaint and Bob said the supervisor would contact me within 48hrs and that has NOT happened as I had suspected. Maronda's response to my complaint is the same thing they have been telling me for the past 4 months. I do want the glass door that they have installed ASAP and I am not sure how long a reorder takes but the other door and shelves should of been in months ago. This problem can be resolved in a matter of a half an hour if they would just get the supplies. As for the griddle...I ordered my own and Bob was right it does not come with one so I am willing to consider that issue resolved...Please have someone contact me to install the glass cabinet door and then when the other door and shelves are installed I will consider this matter closed. Until then I am not satisfied and I am particularly upset that Bob said they would call me within 48 hours and they didn't...typical!

Without first seeing the problem by preforming a water test and interior block scope we will not dig up the foundation. I was able to review the outside of the home and the grading is correct. I am willing to review this issue again, but form the pictures it appears there is leftover effervescence. Prior to entering into the agreement with Maronda, Mr. E[redacted] directed us to FBC Mortgage for a pre-approval, stating that "we will pay $10,000.00 of your closing costs if you use our company". I am in the industry and certainly could have discussed financing options with a number of other lenders at that point, but given that inducement of the closing cost concession together with the pre-approval, we proceeded.For purposes of background, our financial history includes a Chapter 7 Bankruptcy Discharge in October 2014, due to our business failure, all of which was disclosed to both Maronda and FBC Mortgage prior to entering into the contract. FBC did approve us for FHA financing, but the total price caused the financing requirements to exceed FHA limitations. In order to proceed, we require conventional FNMA financing; the pre-approval was supplemented with an approval for conventional financing, per the enclosed email, and that email was submitted to us prior to our execution of the agreement Maronda was fully aware of our requirements and the lender's representations.At the time of signing the contract, including the hand money contingency, Mr. E[redacted] stated "you don't have to worry about this, you have a pre-approval". When I expressed concern regarding the financing, he stated "i'm not worried about it; I'll find someone to do the mortgage if they can't do it". These statements were made in the presence of my husband and both of my children, one of which is of the age of majority.While Maronda is relying on the 30-day clause in the hand money contingency, you will note from the enclosed denial from FBC, Maronda's company, that the denial is dated February 2, 2017 (we received it on February 11, 2017), well beyond the 30-day time frame in the agreement. I'll note for the record that FBC subsequently stated to me that the denial should not have been sent; we wrote some explanation letters and were informed on February 26, 2017, that they could not provide the financing we needed. Since we used "Maronda's company" and the rejection was not even issued until well beyond the 30-day period, we did not have a reasonable opportunity to terminate the agreement according to the contingency clause upon which Maronda is relying in order to retain our funds.We did inform Maronda of this situation at the time of the final denial on February 26,2017. We were informed at that time that we 'probably' would not get our money back. From that time until the date Maronda notified us of their intent to put the property back on the market, we have contacted no less than 35 lenders. Each of those lenders was, of course, willing to provide FHA financing, and each stated that no lender would be able to provide the financing promised by Maronda's mortgage company.Most of these lenders were able to make that determination without 10 minutes, while it took FBC, "Maronda's company" over 3 months to make that same determination. It's not difficult to conclude that it was done intentionally.I have reviewed the records of the Revdex.com, and while I didn't look at all 60+ complaints posted against Maronda within the past 3 years, I did include screenshots of 2 that I found relatively easily. These complaints are similar in nature to our issue, which demonstrates a pattern of deceptive business practices, notwithstanding the other complaints related to other issues.I certainly have other avenues of recourse in order to recover my deposit, and Maronda's been informed of my intent to exercise those options. At this point, the explanation provided is insufficient and clearly misleading by omission of ail of the pertinent facts for me to consider this matter resolved. Other consumers should certainly be made aware of the practices of these companies in order to be able to fully protect themselves from their clearly unfair and deceptive practices.Once again, I do not consider this matter to be resolved based on the foregoing. Maronda clearly advertises a 10 year guarantee on structure. I equate warranty with repair. Maronda has the tools and manpower to fix this, and this is the solution that best protects our family and investment.

Dear Mrs. [redacted]I have been able to review the customers issues with our service manager who was at the home, as well as our flooring contractor. As of this letter, our flooring contractor is reaching out the padding manufacture again to find information for the claim. The claim has been submitted,...
and the manufacture should reach out to us before weeks end. At that point I can forward any information over the customer. The window in the lower level of the home is installed correctly. This is a hopper style window as installed in all of our basement homes to meet code. The window has been checked by our service manager and is properly installed and sealed on the exterior. Maronda Homes does not install other styles of windows in this situation, nor do we schedule inspections with the manufacture. Should the homeowner wish to do this, the information is in the homeowners guide /Warranty manual they received at closing. Our production supervisor has been able to review the driveway as well as my self, and a picture is included for reference. The area in question appears to be the very edge of the driveway where it meets the yard. This may be caused by settlement and would need to be filled and sealed according to the warranty manual. This is typically a maintenance item, but I would be willing to have our service manager stop at the home and fill the crack with asphalt filler. I did not see any other issues with driveway at that time. I have spoken to our roofer in the area and he will stop at the home by 3/16/16 as long as the weather allows to make repairs to the flashing. Our service manager has been to the home and addressed to the best of our ability the HVAC vent noises. The HVAC duct work when the unit is turned on, The ducts are expanding and contracting causing a ticking/clicking noise. There is nothing further that can be done as the metal expanding makes this noise and the unit is operating properly. We have tried to make some changes for the customer. Dear Mrs. [redacted], Maronda Homes was able to return to the home and assess these issues. Maronda Homes is willing to Attempt to correct the squeaks again on a one time basis, as this is not a a typical warranty issue. This would be done from the underside of the floor as to not disturb the flooring. During settlement of the home it is possible that two boards have contact each other and causing the squeak. We cannot guarantee the sounds will be illuminated. While at the home we did a water test and confirmed the water is running from the broken caulking at the second story window and running the length of the stone and falling between the entry door and the storm door. This is a homeowner maintenance item that needs to be corrected. Again in the first few years of the home as it settles and dry out it is possible for these areas to shrink and cause the caulking to crack, and those areas need to be kept up on. We did show this area to the homeowner while we where there for the evaluation. If time permits we can, as a courtesy, seal this area but will be considered a maintenance from that point. Dear Mrs. [redacted], I have had a chance to review the lots in question, and spoke with our production supervisor for any original issues. After review of the sidewalk I was able to see a discoloration in the surface of the concrete. I was not able to see a boot print or depression, but was...
raining and was not sure if it was a color mark only. We will have our service manager contact the homeowner and if wanted we will apply a sealer to the concrete to even the color out. What can happen, and appears in this case, is that the lime and water mixed on top of the concrete and caused a color variance of the top coat. This should wear evenly over time, but we are willing to make the above correction if wanted. We will also look at the front steps for the homeowner, and if warranted we can make a correction. As for the driveway, it is the correct size and length according to the prints. Each unit is done differently, and is required to be to the end of the unit, not to the end of the retaining wall. Dear Mrs. [redacted], I have had a chance to review the lots in question, and spoke with our production supervisor for any original issues. After review of the sidewalk I was able to see a discoloration in the surface of the concrete. I was not able to see a boot print or depression, but was...
raining and was not sure if it was a color mark only. We will have our service manager contact the homeowner and if wanted we will apply a sealer to the concrete to even the color out. What can happen, and appears in this case, is that the lime and water mixed on top of the concrete and caused a color variance of the top coat. This should wear evenly over time, but we are willing to make the above correction if wanted. We will also look at the front steps for the homeowner, and if warranted we can make a correction. As for the driveway, it is the correct size and length according to the prints. Each unit is done differently, and is required to be to the end of the unit, not to the end of the retaining wall.
