Dear [redacted]:    Comenity Capital Bank (Bank) has received your correspondence regarding the above-referenced account. Comenity Capital Bank issues the Overstock Store credit card. We are here to answer your questions and assist with your concerns.         You state the Bank has reported the above-referenced account to the credit reporting agencies as being more than 30 days past due, which is not true. You further state you paid this account in full several days before it was reported as late. You are requesting to have your credit report corrected to reflect as not late with a zero balance.   We have reviewed your account and we are happy to share our findings.       Please keep in mind that when payments are not received, are received after the due date, or are made for less than the minimum required, a late fee may be assessed to the account, as explained in the Credit Card Agreement. Additionally, if an account is two or more billing periods past due, the delinquency may be reported to the credit reporting agencies.   On March 9, 2017, a billing statement was issued reflecting a balance of $542.26, and a minimum payment of $28.00, due by April 4, 2017. A payment of $30.00 posted to the account on April 6, 2017.   On April 8, 2017, a billing statement was issued reflecting a balance of $551.68, and a minimum payment of $28.00, due by May 4, 2017. As no payment was received, the account fell one billing period past due.         On May 9, 2017, a billing statement was issued reflecting a balance of $975.07, and a minimum payment of $77.00, due by June 4, 2017. A payment of $77.00 posted to the account on May 16, 2017; however, as the payment was returned from your financial institution due to insufficient funds, a debit of $77.00 posted to the account on May 24, 2017. As a result, the account fell two billing periods past due, and was reported to the credit bureaus as a 30 day delinquency.      On June 10, 2017, a payment of $1,034.21 posted to the account, and resulted in a zero balance.   We understand your concern regarding your credit report. We have verified we are reporting the account payment information correctly to the credit reporting agencies, as we are required by law.   On June 22, 2017, we sent a request to the credit reporting agencies to update the reporting of the account to reflect a zero balance. $10.00 birthday coupons.   You both attempted to use them on purchases at the retailer and were told that in order to use them you had to make a purchase for more than $10.00.  You are asking that we issue $20.00 in gift certificates to compensate you both for not being allowed to use the two birthday coupons.   Please understand that Comenity Bank and VICTORIA’S SECRET are two separate entities.  Comenity Bank is responsible for addressing questions related to your credit card account, while the retailer is responsible for handling matters related to sales, merchandise processing, returns, and shipping. appreciate the opportunity to assist you.Your complaint states that you paid your bill on the correct day and we are sending claims that the payment did not process. You also state that fraudulent payments are trying to be received. You would like the account to be credited the correct amount.Bank records indicate that you scheduled an online payment for $83.16 on May 6, 2015. On May 12, 2015, this payment was returned by your financial institution due to insufficient funds. As such, the amount was debited back to your Victoria’s Secret/PINK account balance, and the account was charged a $25.00 returned payment fee. On May 13, 2015, you scheduled an additional payment online for $156.36, and this payment was returned on May 19, 2015, by your financial institution due to insufficient funds. As such, the amount was debited back to your Victoria’s Secret/PINK account balance, and the account was charged a $25.00 returned payment fee. Additionally, because of the two returned payments in the last 90 days, your charging privileges have been suspended.If you believe that you are a victim of fraud regarding your banking account, we encourage you to contact your financial institution and file a fraud claim so that they can investigate on your behalf. If they find that the payments stated above were fraud, please have your financial institution send us a letter to the address listed above, or send by fax to my attention at ###-###-####. After receiving, we would be happy to remove the returned payment fees and reinstate your Victoria’s Secret/PINK account.Additional review of your account reflects that you made a fraud claim on December 31, 2014, stating that you never made a purchase of $182.62 by catalogue. the non-receipt of merchandise, shipping charges and bank fees which created an unpaid balance on your account. We also understand your request to cease further collections on the account. I’ve reviewed your account and I am happy to explain my findings. Please note Comenity Bank and Jessica London® are two separate entities. The Bank issues and is responsible for addressing questions related to your credit card account. Jessica London® is responsible for handling matters related to sales, merchandise processing, returns and shipping. Bank records indicate that you charged $148.14 to your account on October 26, 2016. The order was cancelled and the account was issued credit of $131.03, which was less the return label fee and shipping and handling charges. Per Jessica London’s shipping and handling policy, shipping charges are non-refundable. The Bank issued you a billing statement on November 10, 2016, with a balance of $24.61, and a payment due on December 6, 2016. As payment was not made, the account was charged a late fee and finance charge. You contacted the Bank via secure messages on Account Center in which we closed the account as you requested. Additionally, a dispute was filed on your behalf, which takes up to 60 days to resolve. Please be advised that as a result of this complaint, this letter will serve as a response to your Revdex.com complaint and your billing dispute; you will not receive a separate letter. On December 22, 2016, Jessica London issued a $7.50 credit to refund the return label fee. Although no Bank errors were found, in the interest of customer service, we issued credits totaling $39.11 to remove the balance from your account. Per your request, a "cease and desist" status has been placed on your account. This cease and desist request will stop all future collection calls, but it will also suspend authorizations for new purchases on all of your accounts since we will be unable to contact you. I was led to believe false information, and the employees that did this need to be retrained. If you won’t raze the credit limit to be the $2.100 like I was false led to believe it was, I think everything I have been through deserves a customer service adjustment to the account to bring it under the credit limit. That’s a $386.00 good will adjustment on the banks part. This would be the right thing to do.

I have reached out to Comenity twice about this and not once have they mentioned I would need to now follow up with Bon Ton separately until now. Bon Ton nor Comenity can present a confirmed signature on delivery so it is quite suspicious that they keep stating it was delivered, my family member never received the package and they have no confirmed signature upon delivery how is that a confirmed delivery. I am still being charged for a package I have not received and therefore would like to continue with my complaint I will be sure to add a complaint against Bon Ton as well after following up with them in the morning if this issue is not resolved.

They closed my accounts without my notice. They can reopen the accounts . I know this because they opened them up the last time they did this to me over the same issue... Why then could you reopen them but now you can't. I think you are a scam. I will be going into the stores and I will tell everyone I know how I was treated.  your policy all of a sudden...? it is a bad one. You will only cause businesses to lose in the end.If you look I have always paid my bills. I will win in the end of this. [redacted]

You are requesting that the Bank issue a credit for the late fee and send you a refund check. We understand your concerns, and apologize for any frustration this may have caused you. Our records indicate that on April 6, 2017, the Bank issued a statement showing a balance of $300.68 with a minimum payment of $25.00 due by May 2, 2017. The Bank received a payment of $300.68 on May 4, 2017. we never  were told  percent of interest, before or after comenity bank came on the scene........we never purchased anything from roamans,.........we never consented to the interest charged.....we are only paying for articles purchased and we do not accept the rate of interest, which we still do not know what it is.......we requested a paper statement from woman within, to no avail.......we are not paying another penny, until we have a paper statement, and have decided what will pay them....woman within is not honest.......thankyou......

contacted the Bank on December 16, 2016, and informed the representative you wanted to make a payment for the minimum due on your account. You state that the representative advised you that the minimum payment due on your account was $30.00 and you provided her with your bank account information to have the payment processed. However, when you made your payment in January 2017, you realized that your account was assessed a late fee. Furthermore, you state as a result of being told the incorrect information in December 2016, your account became delinquent for December 2016 and January 2017. You further state that you were hospitalized in the beginning of February 2017 and had set up a payment arrangement. However, you state the way the arrangement was set up by the representative caused your account to be over 30 days past due and a delinquency to be reported on your credit bureau report. You are requesting that the phone call made on December 16, 2016, be reviewed, the late fees reversed, and for the delinquency from March 2017 to be removed from your report. I understand your concerns, and apologize for any confusion or frustration this may have caused you. Bank records indicate on October 21, 2016, a statement was issued to you showing a balance of $447.94 with a minimum payment of $27.00 due by November 16, 2016. The Bank did not receive a payment by the due date and as a result, a late fee was assessed to your account. On November 20, 2016, a statement was issued to you showing a balance of $484.42 with a payment of $47.00 due by December 16, 2016. The Bank received a payment of $30.00; however, as a result of the payment being made for less than the required minimum payment due, a late fee was assessed to your account. On December 21, 2016, a statement was issued to you showing a balance of $501.94 with a minimum payment of $42.00 due by January 16, 2017. The Bank received a payment of $20.00 on January 11, 2017, and a payment of $22.00 on January 13, 2017. Thank you for those payments. On January 21, 2017, a statement was issued to you showing a balance of $470.52 with a minimum payment of $27.00 due by February 16, 2017. The Bank did not receive a payment and as a result, a late fee was assessed to your account. Your account became one billing period past due. On February 18, 2017, a statement was issued to you showing a balance of $506.86 with a minimum payment of $52.00 due by March 16, 2017. The Bank did not receive a payment and as a result, a late fee was assessed to your account. Your account became two billing periods past due and as a result, it was reported as 30 days delinquent to the national credit-reporting agencies. Bank records further indicate that on March 24, 2017, you were contacted by the Bank regarding the status of your account. At that time your account received a courtesy late fee credit, and a payment of $150.00 was scheduled for April 7, 2017. Please be advised that the Bank has no record of a payment arrangement set up for you for the month of February 2017. Furthermore, the Bank reviewed all applicable telephone calls and Comenity Bank has not found any errors on your account, and we are unwilling to waive any additional fees, as they are valid. We understand your concern regarding your credit report. We have verified we are reporting the account correctly to the credit reporting agencies as we are required by law. To provide the best customer service possible, we offer multiple ways to make a payment. Choose a payment method that's right for you. In-store: If the retailer listed on your card has a store near you, you may be able to drop off your payment in the store so it can be applied to your account on the same day.
