Dear Shilpa Jagannathan:   Comenity Bank (Bank) has received your correspondence regarding the above-referenced account. Comenity Bank issues the LOVELOFT credit card. We are here to answer your questions and assist with your concerns.   We understand from your complaint that in...

September 2016, you made a purchase in the amount of $160.65. You state you paid $160.65, on September 6, 2016, as this was the balance you were informed to pay on this date. You state you called the Bank in November 2016 to close the account and were informed by customer service the balance was zero. You were not sent billing statements for the months of September 2016, through November 2016; however, you received a bill dated December 17, 2016, with a balance. You state the Bank now claims the account had a late payment charge since September 2016 and that you were sent billing statements for the above-referenced months. You request the Bank to accept our error and remove the delinquency reported from your credit report. I am happy to share my findings.   The account shows that the billing statements were issued via postal mail. The Bank has no record of any correspondence being returned as undeliverable.    We have reviewed the concerns in your correspondence, as well as the applicable telephone conversations.   When you contacted the Bank on September 6, 2016, to make the payment of $160.65, there was a pay by phone fee of $9.00. Typically, when a customer is paying the balance in full, the fee is included in the payment amount. However, the fee was not added to your payment; therefore, it was charged on the next bill.   On November 8, 2016, when you returned the Bank’s call, the representative advised you the account was charged a late fee due to the pay by phone fee not being paid. Additionally, you were advised due to this matter, the balance of $34.00 would be credited and you would owe nothing further. You were then transferred to customer service to close the account. However, an adjustment was not made to bring the balance to zero and the account was assessed additional Bank fees.   The payment in the amount of $54.00 posted to the account on December 16, 2016, which brought the balance to zero. Prior to this payment, the account was reported as 60 days past due.   Due to the Bank’s error, we have credited the account $54.00 and issued a refund check of $54.00. Please allow 14 days to receive the refund, which will arrive under separate cover. In addition, we have removed the delinquencies reported for November 2016 and December 2016. Please allow the credit reporting agencies 45 days to update their records. We apologize for any inconvenience this matter may have caused you.   I hope you have found this information to be helpful. If you have any questions or concerns, please feel free to contact me at ###-###-####.                                         ... At the end of the promotional period, any balance remaining on the plan is added to the regular revolving balance. The minimum monthlypayment calculations for this plan is less than the minimum monthly payment calculation for the regularrevolving balance (generally 1 %).Furthermore, on March 16, 2014, a purchase of $81.99 posted to your account and on March 17,2014, apurchase of $699.01 posted to your account. Both purchases were placed on a 12 Month DeferredInterest, 1% Payment Required Plan, which was scheduled to expire on March 17, 2015 and March 18,2015. For purchases on this plan, interest is accrued (calculated, but not added to the balance). If thebalance is not paid in full by the plan end date, the accrued finance charges, which are calculated fromthe date of the original purchase, are added to the deferred balance, and this balance is moved to therevolving balance. As a result of this balance not being paid in full, the remaining balance of$285.00 was moved to your revolving balance. Please be advised that you were not assessed anyaccrued interest for this purchase; however, as a result of this balance being moved from a waivedinterest promotional plan to the revolving balance, finance charges would be assessed monthly, shouldthe balance not be paid in full. Dear Ms. [redacted]We received your additional complaint, submitted to the Revdex.com, regarding the above-noted account. Comenity Bank issues VICTORIA’S SECRET credit card accounts, and we are here to answer your account related questions. The complaint was forwarded to my attention, and I appreciate the opportunity to address your concerns. We understand that you are not satisfied with our previous resolution. You are requesting that the Bank delete the account from your credit profile, instead of updating the information, as you believe this leaves a negative impact on your credit profile. We are happy to explain our position.Comenity Bank is obligated to report factual data to the national credit-reporting agencies. As previously communicated, we found discrepancies in the reporting of the account and we submitted notification to Equifax to ensure the updates needed were corrected, as this is the credit bureau you indicated was reporting incorrect information. The Bank is unwilling to delete the account from your credit profile, as it is valid; however, please note that we submitted information to all credit-reporting agencies to ensure their records were updated. This may take 45 days for them to update their records. We understand that our customers may experience circumstances beyond their control, which may cause their accounts to become past due. As an option, you may want to consider submitting a consumer statement to the credit-reporting agencies, explaining the reason(s) why the account became past due.
