purchased the warranty. This purchase was put on a promotional plan of 12
months free financing if paid within 12 months. You state that your statements
were received via your email, you state that you did only look at the first
page that included your minimum payment and did not look at the third page that
showed the details of your promotional plans. You also state that you reach out
to the Bank and spoke to a representative and was advised to contact the Bank
to advise how much of your payment was to be added to the Bose system.
Additionally, you state that you made a payment late in November 2016 and
received a late fee. On January 21, 2017, a finance charge was applied to the
account. You are requesting that the finance charges be waived.Our records indicate on December 2, 2015, a
purchase of $599.95 posted to your account and was placed on a 12-month
deferred interest, payment required plan that expired on December 2, 2016. On
December 10, 2015, a purchase of $69.95 posted to your account and was placed
on a 12-month deferred interest, payment required plan that expired on December
10, 2016. For purchases on these plans, the customer is required to make payments
on the promotional plans balance based on the standard repayment terms for
their account. Interest is accrued (calculated, but not added to the balance),
and if the balances are not paid in full by the plan end date, the accrued
finance charges, which were calculated from the date of the original purchase,
will be added to the deferred balances, and these balances will be moved to the
customer’s revolving balance. Please be advised that information regarding your
promotional plans appeared on your monthly
billing statements, under the heading, “details of your plans”. Additionally,
beginning with the October 2016 billing statement, notification was provided
which advised your promotional plans was expiring soon. I have enclosed your
billing statements for your review. Please be advised
that a statement was issued to you on November 6, 2016, showing a balance of
$789.87 with a minimum payment of $43.00 due by December 2, 2016. Under the
“details of your plans” section of your statement, it stated that the
promotional balance of $309.81 needed to be paid in full by December 2, 2016,
and the promotional balance of $24.95 needed to be paid in full by December 10,
2016, to avoid paying accrued interest. The Bank received a
payment of $75.00 on December 2, 2016. As a result of the promotional balance
not being paid in full by the plan expiration date, the accrued interest of
$114.41 was assessed to your account on December 2, 2016, and the remaining
promotional balance of $243.48 was moved to revolving, which is subject to
normal monthly finance charges.Comenity Capital Bank did not find any errors
with the account. Therefore, we are unwilling to remove the finance charges, as
they are valid. In regard to the call placed to the Bank
regarding your Bose system promotional plan payment and how your payment is
allocated to this promo plan; if you would like to have more of your payment
allocated to the Bose system promotional plan, you may call the Bank and advise
the Bank of how much you would like to be allocated to the Bose system
promotional plan at that time.In regard to the
late fee assessed in November 2015; the online payment you made on November 2,
2016, for $50.00 was submitted at 9:50p.m. ET which missed the cutoff timeframe
of 8pm ET for same-day processing; therefore, the payment was not posted to
your account until the following day. Please be advised that our payment cut
off timeframes are disclosed on your monthly billing statement under a section
called "Payments". All fees are valid and they were assessed in
accordance to your Credit Card Agreement. As of the date of this letter, your account
balance has credit balance of $38.23. You may use this credit balance towards
you next purchase or contact me directly at the telephone number below to

You state that you contacted the Bank on two occasions regarding your purchase that was to be placed on a 12 month deferred promotional plan, and you received correspondence advising that your purchase was not disputed within 60 days. You are requesting the Bank clear the balance on your account. We would like to apologize for any inconvenience this matter may have caused you. You also state that when you made the purchase on that day you paid cash for the purchase. Additionally, you state that you disputed the charge for this purchase on your credit card and were advised to send in the receipt for this purchase to further investigate this matter. You are requesting the charge be removed from your account due to you no longer having the receipt for this payment. I am happy to share my findings. Bank records indicate that we responded to this complaint on August 26, 2015. Enclosed is a copy of the previous letter for your review. Please be advised that Comenity Bank and Avenue are two separate entities. The Bank is responsible for addressing questions related to your credit card while the Retailer, Avenue, is responsible for the handling of matters related to sales, merchandise processing, returns and shipping. After a review of the account I found that the account was opened on May 4, 2015, at the Avenue store located at [redacted]. At that time a purchase, in the amount of $42.00, was placed on the Avenue credit card. As no payments were received by the Bank, late fees and finance charges have been assessed to the account. As of the date of this letter, the account balance is $213.71 with a minimum payment of $55.00 due on November 13, 2015, and the account is five billings cycles past due. If the account exceeds six billing cycles past due, the account may be closed, written off and reported to the credit-reporting agencies as an unpaid debt. First of all your dates and information is wrong. You keep correcting ( according to you) all items on my ledger which is attached. When I contacted you I had a zero balance on my account I now have a $20.61 balance. You have not admitted any wrong doing, nor that you have taken an enormous amount of my time and lied repeatedly in your emails and now in this correspondance. Your solution is to try to charge me more than I owe than when I filed this dispute? You have provided no written statement on to why you have adjusted credits on my account after I filed this dispute. My payment history is as stated on my ledger from your bank, not per your Revdex.com response. You state that you contacted the Bank on two occasions regarding your purchase that was to be placed on a 12 month deferred promotional plan, and you received correspondence advising that your purchase was not disputed within 60 days. You are requesting the Bank clear the balance on your account. We would like to apologize for any inconvenience this matter may have caused you. You also state that when you made the purchase on that day you paid cash for the purchase. Additionally, you state that you disputed the charge for this purchase on your credit card and were advised to send in the receipt for this purchase to further investigate this matter. You are requesting the charge be removed from your account due to you no longer having the receipt for this payment. I am happy to share my findings. Bank records indicate that we responded to this complaint on August 26, 2015. Enclosed is a copy of the previous letter for your review. Please be advised that Comenity Bank and Avenue are two separate entities. The Bank is responsible for addressing questions related to your credit card while the Retailer, Avenue, is responsible for the handling of matters related to sales, merchandise processing, returns and shipping. After a review of the account I found that the account was opened on May 4, 2015, at the Avenue store located at [redacted]. At that time a purchase, in the amount of $42.00, was placed on the Avenue credit card. As no payments were received by the Bank, late fees and finance charges have been assessed to the account. As of the date of this letter, the account balance is $213.71 with a minimum payment of $55.00 due on November 13, 2015, and the account is five billings cycles past due. If the account exceeds six billing cycles past due, the account may be closed, written off and reported to the credit-reporting agencies as an unpaid debt. First of all your dates and information is wrong. You keep correcting ( according to you) all items on my ledger which is attached. When I contacted you I had a zero balance on my account I now have a $20.61 balance. You have not admitted any wrong doing, nor that you have taken an enormous amount of my time and lied repeatedly in your emails and now in this correspondance. Your solution is to try to charge me more than I owe than when I filed this dispute? You have provided no written statement on to why you have adjusted credits on my account after I filed this dispute. My payment history is as stated on my ledger from your bank, not per your Revdex.com response.
