It is ACA’s policy to report its accounts to the three major credit reporting agencies. ACA must report accurately, and we are doing so with regard to Ms. [redacted] account.
ACA is not a party to divorce decrees, which are between the spouses and the family court. The divorce decree did not allow or obligate ACA to alter the parties to the Retail Installment Contract.

interest loan with ACA. Interest accrues on a daily basis and is based on the current principal balance of the account. Interest starts accruing on the date of the contract and continues until the account is paid off. We will be sending Ms. [redacted] some information on how interest is accruing on her account which we hope will clarify the matter. We will also be sending her the information she requested concerning paying off the account if she chooses to go that route. ACA sends out statements as a courtesy, as they are not required by

The payment Ms. [redacted] made on 10/31/2017 was applied to the account and covered the payment due for 10/28/2017, and partially covered the interest that had been accruing since 8/12/2017. She did receive two payment extensions for August and September, 2017 payments. These were applied to the account on 9/1/2017. They extended the payment due dates, but did not stop interest from accruing (see attached extension document). [redacted] Federal Credit Union contacted ACA on 11/2/2017 requesting a 10-day payoff quote. Therefore, this quote was requested after the 10/31/2017 payment had applied to the account. The 10-day payoff quote of $22,355.51 was stated, and was good through 11/12/2017. A payoff check for this amount was applied to the account on 11/13/2017. A copy of the payoff check is attached. ACA has reviewed Mr. [redacted]’s response, but the Revdex.com is not the appropriate place to debate the state laws which Mr. [redacted] mentions. The settlement offer we presented is reasonable and is still available until June 12, 2017 if the customer is interested.

Once sold at auction, the funds were applied according to the contract, which left a deficiency balance on the account. The attached deficiency balance letter outlines how the funds were applied to the account. It should also be noted that interest continues to accrue on the account at the contract rate of 28% which is also in accordance with the contract. We do have an option to settle if Mr. [redacted] would like to consider this possibility. We would analyze the situation and try to come to an agreeable amount. generally between the divorcing spouses and the family court. Therefore, ACA is not subject to the divorce order. The vehicle was sold at auction on 12/16/2016, and the proceeds of sale ($7,200) were applied to the account on 12/21/2016. ACA has confirmed that all state-law required notices were mailed to the last known addresses ACA had on file for Ms. [redacted] and Mr. [redacted]. These Notices include a Notice of Default letter mailed 9/28/2016, a Notice of Right to Reinstate and Notice of Our Plan to Sell Property mailed 11/14/2016, and an Explanation of Deficiency Balance letter mailed on 12/22/2016. The account holders are responsible for keeping ACA informed of their current addresses. ACA does make courtesy collection calls and attempts to reach our customers based on the contact information we have. Our information shows we did have a conversation with the Ms. [redacted] and she was aware of the situation with the vehicle. ACA has a procedure whereby deficiency balance accounts can be settled for less than the full amount owed. Ms. [redacted] or Mr. [redacted] may call ACA’s Customer Service department at 866-[redacted] during regular business hours to discuss settlement of the deficiency balance. If the account is settled under this procedure, ACA will report to the CRAs that the account was settled for less than the full balance owed.
