This is to serve as a formal response by American Credit Acceptance, LLC (“ACA”) to the complaint filed by [redacted] with the Revdex.com case number [redacted].     ACA has reviewed the complaint submitted by [redacted].  ACA apologizes for the confusion this situation has caused and appreciated Ms. [redacted]’s business.  We also apologize for any rudeness Ms. [redacted] experience when speaking with ACA associates.   Interest does accrue daily, but Ms. [redacted] will only be charged interest while there is a balance on the loan.   Ms. [redacted]’s complaint mentions a payment of $4 per day. We would like to clarify this for Ms. [redacted]. Currently, Ms. [redacted]’s per day interest is $3.94. This is not additional interest,  but rather the amount of interest accruing per day based on the contractual Annual Percentage Rate of 20.70% and the current principal balance of $6,958.32.  As Ms. [redacted] makes regular on-time monthly payments, her principal balance will be reduced, and her per day interest rate (also known as “interest per diem”) will also be reduced.   She will not be charged for future interest, there is no prepayment penalty, and interest stops on the day the loan is paid in full.  Attached is a copy of the contract and a copy of ACA’s Simple Interest FAQ Flyer which provides information on how simple interest is calculated.  If Ms. [redacted] has any questions, we can be reached at 864-[redacted] or [redacted]acacceptance.com.      Keith K[redacted] Customer Experience Manager

On March 2, 2018, ACA sent a copy of our reporting to Ms. [redacted] for her review. All account information has been reported accurately to the consumer reporting agencies (CRAs). April 2015 month ended 30+ days past due because there was only a partial payment made on 4/15/2015 and another full payment was not made until 5/4/2015.  ACA reports only the most recent 25 months of payment history. Accordingly, the April 2015 late mark is no longer reporting on Ms. [redacted] credit reports because it is past the 25 month payment history. Any reporting of payment history prior to  25 month is beyond ACA’s control.

7/23/2013, a 2006 Dodge Charger, was taken by Mr. [redacted] to a repair shop and was abandoned there by the customer.  ACA chose not to pay for the repairs or to recover the vehicle from the shop.  On 6/17/2016, the repair shop, [redacted] Nissan, was awarded the abandoned vehicle in court which nullified ACA’s lien but had no effect on the amount of money Mr. [redacted] owed to ACA.  At this time, ACA would be willing to settle the matter for an amount far less than the current payoff of $14,633.95.  If Mr. [redacted] is interested in discussing a settlement, he can contact Karen R[redacted] at 864-[redacted] or Keith K[redacted] at 864-[redacted].  He can also email us at [redacted]acacceptance.com.           Keith K[redacted] Customer Experience Manager

obtained the payoff quote from our website, and the funds were received and applied a week later on 7/10/2017.  The payoff submitted did not include the additional interest that accrued from the time he obtained the payoff to the day ACA received the payoff, which left a small balance of $67.51. (Normally, when customers call in, they are quoted a 10-day payoff, which is valid for 10 days).  We spoke to Mr. [redacted] on 7/11/2017, and at that time he asked ACA to waive the small remaining balance due to personal circumstances.  ACA agreed to waive the small remaining balance of $67.51 as a courtesy and sent the paid papers and title to the customer.  On 10/10/2017, ACA received the refund check from the customer’s GAP cancellation and applied part of the funds to the balance that was waived which was now $71.04 due to accrued interest. I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint. I was aware they took off the fees for the most recent payment but they also changed what was applied to the principal balance in result of that change. This has been a fee on my account for a very long period of time so that means all of my payments over the last year have been applied incorrectly. Resulting in higher interest payments and extra fees I should not have been charged. Just taking off the fee this tijme does not resolve my issue.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  And now it shows I owe 40 payments and it should only be 35 at this point. Something is not right. The late fees showed even when I should have been at a zero balance making it to where not all my payment applied to my interest or principal balance.
