Please note that GM Financial places a high priority on adhering to all state and federal lawsThe state of Tennessee does not require cure notices to be sent prior to submitting the account for repossessionOn December 2, 2015, the decision was made to place the vehicle out for repossession, as allowed by your contractAt this time the account was over days past dueThe account history was reviewed thoroughly and it has been determined that the handling of the account, including repossession, was in compliance with all state and federal lawsThe “Notice of Right to Redeem or Reinstate” and the “Notice of Our Plan to Sell Property” were mailed to your address of record on December 9, In accordance with the applicable law, the statutory notice provided information about how and when to secure any personal property left in the vehicle
Our records reflect that numerous efforts were made to contact you in regard to reinstating the vehicleFurther review of the account shows on December 8, 2015, GM Financial was notified by you that you did not intend to reinstate the unit
As outlined on page of your contract, if you choose not to redeem the unit, the Chevrolet Sonic will be sold at auctionUpon the sale of the vehicle, we will apply the money from the sale to the amount you owe after subtracting allowed expensesIf the money from the sale is not enough to pay the amount you owe, you must pay the remaining amount to GM Financial unless the law provides otherwise

Please understand that copies of deferment agreements are not a type of document that is normally requested as customers either maintain the e-mailed version or print copies of the document for their recordsApproval from upper management in several departments had to be obtained, prior to the issuance of copies via regular mail on May 23, Please allow 7-business days to receive the copies of the documents mentioned in our previous response. Please also understand how much you pay over the life of this loan is entirely dependent on how you’ve paid the monthly installmentsThe Total Sale Price shown in the Truth In Lending Disclosures assumes that all payments will be made as scheduledA review of your account payment history indicates that quite a few payments were paid significantly late and that you deferred monthly installments within the first year of your loan when the daily amount of interest was highest. As stated numerous times, that payment you are referring to (received on July 28, that was rescinded by my financial institution) is a completely separate issue and I will not be commenting on that. The payment that is in question is the other $payment that GM Financial processed on July 28, That is what this complaint is in relation to (complaint ID ***)Please process the refund for that payment ASAP due to the issues detailed in this complaint

On April 22, 2016, GM Financial received an application for credit submitted at Bel Air NissanYou have indicated that you are disputing the inquiries as unauthorized; and as a result, GM Financial has requested that the appropriate credit reporting agencies remove the GM Financial inquiry from your credit reportIn the event that the credit bureau reporting agencies are unable to delete the inquiry, we have asked that at a minimum that they convert the hard inquiry to a soft inquiryPlease be advised that it can take the credit reporting agencies four to six weeks to update your credit report

I am rejecting this response because: I contacted the business in regards to these payment plans, and was told upon both times of contact that these plans were no longer being continued, as one was set up in errorI dont understand how I was told by two different people that these payment plans were cancelled, and that there is no issue with a double payment being charged both times, especially after an entire months head notice, and I even spoke to a representative the day before my second payment was processedTherefor, this means that I was given incorrect information from both representatives I had spoken with (who also could not find any record of other people speaking to me) and therefor caused a multitude of hassling effectsIf the employees of the company cannot let their consumers know that a plan wasnt actually cancelled (a plan that the business itself had to cancel as stated by multiple employees) let alone tell me that the second payment was already PENDING to be processed therefor causing an overdraft of funds in my account, how can I believe in the reliability of any statements made by the company, let alone trust them with my funds in the future? I was given information by multiple employees, therefor effecting my financial situation for an extended period of time after with absolutely no resolution and now punishments for disputing through my bank directly, as I now have to way to make payments through that checking account to the business now as it is flagged unreliable and will be bounced, therefor costing me MORE money to open a new account to make a payment

I am rejecting this response because: They needed more infoI am providing the more infoI have attached a copy of my last statement. I made a payment on 6/for $and another one on 6/for $200. They have me as past due saying I owe $409.88. Saying I have a past due amount of $43.02. How can that be when the bill was for my monthly payment of $and I paid $400. I spoke to a rep and a manager who was extremely rude and unprofessional. I was really glad when GM gave me the loan but I don't know if I will ever get a loan through them again.

I want it to be clear that my issue does not have to do with your response regarding "inaccessibility" to my accountMy problem with GM Financial is that you accepted and cashed a payout check without bothering to link it to my accountMy problem with GM Financial is that when I interacted with staff, I was either told the problem was with my insurance carrier who issued the check (and to contact them about it) or, after it was clear GM Financial was the one who was wrong after I produced the cleared check, to simply waitI was dismissed at every pointI was not given a time period as to when my account would be correctedIn other words, I don't accept your response regarding "advance notifications regarding inaccessibility" being sent to meINACCESSIBILITY HAS NOTHING TO DO WITH IMPROPER RECORD KEEPING OF MY ACCOUNTHow dare you even suggest that it was MY oversight that led to this problemI, and anyone with common sense, knows GM Financial is fully to blame. I checked my account this morning on 1/31/It is showing my "next payment due" date of 2/26/- amount: $I want this corrected and it must show that there are no additional payment due datesI will continuously reject responses until this is correctedMy time has been wasted dealing with incompetence, so now I demand that my account reflect correctly.

I do not agree with GM Financials response.In the first place there was missed payments, that was after the bankruptcy was filed and the statements stopped comingTrue they were not allowed to send them to me, but my husband was on the loan as a co-borrower and never once called him or sent him notices at any missed paymentsWhen I realized I missed one I would make it up as can be seen by the attached spread sheetThe amounts taken under the GM column are from their records, the amount in my column is from my bank statementsAs also can be seen by the spread sheet is that the total I paid into GM financial is $15,142.30, taken from my bank statementsAccording to their records they credited me with $14,When I take my payment of $x months of the loan that comes to $12,How can this be so far off?Again why didn’t they inform my co-borrower that A) the car was under a bankruptcy order, B) payments are not being made would you please make them, C) a repossession order has been placed do you want to pay to stop it? No correspondence at all until they repossessed the carThen they tell him he can buy it back for $12,+Or have to pay the difference if it sells for less than is owedI do not understand all of the laws but I do understand math and this does not add upThis is not a suitable response to my complaint
