never came back. Would we be able to go after that customer because of a verbal statement? The answer is no. We offer to purchase vehicles found online on a daily basis. However, if there is no contract, we are not legally bound to purchase the vehicle. If the vehicle's purchase price had been set as you say, we would have kept the vehicle, written a purchase contract, inspected the vehicle and consummated the deal. This was clearly not the case. Instead you wanted to keep the vehicle, add additional miles and further depreciate the vehicle and then have us buy it at a later date. This is not acceptable. I'm sorry that you purchased a vehicle before you sold your Eclipse. However, in your complaint you stated that you turned down many offers on this vehicle. However, you filled out the entire application and signed it acknowledging that your credit would be ran. Because you filled out the entire report and signed it we cannot legally remove the inquiry. I have been trying to get them to fix the car and I called them today and they now want me to bring the car into their shop to have it looked at. When a customer trades in a vehicle and we transfer it to the auction, it is still titled in the owners name. Dealerships do not and cannot transfer the trade vehicles into the dealership's name. Once it is sold at the auction, the purchaser is to title the vehicle in the new owners name...
once it is sold. If that did not happen, you would have to work with the auction to provide you the details of who the vehicle was sold to. That information is then passed to the respective city in which there were tickets and they would transfer the tickets off of your name. You will also have to provide your purchase contract from Russ Darrow showing that you sold the vehicle and are no longer the legal owner. As for the vehicle that you purchased, we cannot do anything about that loan since we are not the bank. While I understand your frustration regarding this, the information that you stated pertaining to the rental contract and subsequent bill are inaccurate. The rental contract that you attached clearly shows that there is a $25/day rental charge for the vehicle. The vehicle was given to you on 12/31/16 and was supposed to be returned by 1/3/17. This did not happen. Even if the tech did or didn't find anything wrong with your vehicle, there was still a contract which you signed, agreeing to the rental charges. The accumulated days and actual charges are not shown on this contract because you were just presented with the vehicle and there were no days accrued or rental charges accrued until 24 hours would pass. We provide rental vehicles based on manufacturer payment or if the service we are providing the customer exceeds $1500. You do not fall under either one of these exceptions. You stated that you and your father didn't believe that there was nothing wrong and requested a second look at the vehicle. I am sorry that you feel that we are not being truthful with you however, if your friend works at a dealership, they use the same WI Buyer's Guide as we do, that specifically state that the dealer does not ensure vehicle will pass state emission test where required. We as a dealership must make sure that the vehicle is equipped with emission equipment, but that is it. Also, you had the right to take the vehicle for a third party inspection prior to purchase, but you chose to purchase the vehicle without doing that. I have attached the receipts from Napleton Kia where the repair was done. I brought the car in for warning lights that were flashing. They looked at the car and said that a repair was improperly made to a sensor on the left front wheel, and that the warranty would not cover this. I don't know if they were working off the original warranty or the Certified Pre-owned warranty. Both should have still been honored, so it should not have mattered. Up until this incident, I have had good dealings with Russ Darrow Kia in Madison, but it was impractical for me to continue to take it there since I live in Chicago. The warranty should have covered this repair. The car had ONLY been serviced at Russ Darrow Kia until I took it to Napleton Kia on Feb 24th 2018 , Furthermore, the car has not been in an accident since I have owned it, and Russ Darrow Kia did not reveal one in the Carfax or verbally. If I had known that his would have been such a big issue, I would have taken the car back to Russ Darrow Kia. But the warranty covers ALL Kia dealers , so it really shouldn't matter where I took the car. Please consider reimbursing me for this repair. Napleton has also refused to pay.

I have reviewed your complaint and spoke with the master tech who looked at the transmission tube issue and he stated the following:I can’t imagine a scenario where it could be broken in the manor it was from doing an oil change. He concurred that it makes sense that GM would have a recall on...
it given the point of failure. He also spoke with a GM tech he knows at another dealership who is very familiar with this as a problem. There are many times that we at Chrysler have vehicles that fail for the same reason as a recall that may not match the vin# range or date range on a vehicle under the guidelines of the recall. Yet it has the same part fail for the same reason. As you can see, this is a known issue and could not have been caused during an oil change. Also, I am being told that if this was an issue that would have happened during the oil change process, you would have had direct immediate issues, however, you were able to drive the vehicle in excess of 500 miles with no issue.I have been told that you need to seek assistance at a GM dealership to see if they will broaden the recall to include your vehicle.[redacted], Corporate Paralegal
One when you buy an auto you pay a service fee and before you drive ths auto off the lot the sales person says they take the auto to check it over so everything works(so they say ) and yes if the auto sits on the lot thing may happens that is why it should be looked over before delivery.This dealership just wants to take your money and send you down the road!! We were approached by a salesperson who introduced himself, we responded that we are [redacted] and Sue. No one ever asked for our last name or other information so that they could record it for their records. So the paralegal response is totally unacceptable, we were at the Russ Darrow dealership on February 18, 2017 in response to an advertisement that we received in the mail.
