I'm sorry that there have been issues with the vehicle, however at the time of the sale to our customer the vehicle went through a WI Safety Inspection and anything that the technician found on the this inspection was either fixed or notated. It is my understanding that you purchased this vehicle from our customer, so we would not have any liability to you. Also, the vehicle is sold as is with no implied or stated warranty. I'm sorry I did not touch on all aspects of your complaint. As for the CarFax, this is a courtesy that we provide to our customers. All vehicles have a CarFax folder at their respective dealership for the customer to view. As with our internet advertising, there is also a link to the CarFax report. I cannot say if a report was requested or not as I was not there at the time of the transaction. As for your mechanical issue, a starter can go at any time with no warning. If this would have been an issue from the day you purchased the vehicle, you would not have been able to drive it for weeks before the problem surfaced. This is why we sell warranties on vehicles, which you opted out on. There was an additional disclosure that would have been signed saying that you understand that you are waiving your right to a service contract and will be liable for all repairs and maintenance on the vehicle from the day of purchase and forward.*** ***, Corporate Paralegal

For your reference, details of the offer I reviewed appear below.It appears that Russ Darrow was quick to dismiss my complaint without fully reading itThey stated that I waited six days to call Russ Darrow back after missing a phone call on January 5thI clearly stated that I called the day after, on January 6th when I was put on hold for minutes because they could not find me in their systemBecause I was at work and cannot take all that time to sit on hold waiting for them, I called back again on Saturday, January 7thI was not satisfied with their answer of not being able to find anything wrong with my car and my dad called them as well on January 7thThey agreed to keep looking for something wrong and said they would call backI never received another phone call, so I called again on January 11th and then picked up my car on January 12thThere are two screenshots of calls between myself and Russ Darrow and my dad and Russ DarrowThis shows the dates and times of outgoing and incoming calls from them. In addition, Russ Darrow stated that they did not charge me for repair or servicesIf they would have, we would have a bigger problem as my car is still under warranty.I have attached the emails between myself and *** *** of Russ Darrow where I ask multiple times for the agreement that I signed stating that I would be charged for car rentalShe finally provided me with my agreement which does not state anything about being chargedThe rental agreement is also attached.The original bill sent to me in the mail in March is attachedThis does not state at all what the charges areI called when I received the bill and was then told that the charges were for car rental*** *** did email me an additional bill with the breakdown of charges per date

I have reviewed your complaint with applicable managers and respond as follows:You came into the dealership to trade in a lease that you were in with Nissan and lease a new Kia on February 26, 2016. A deal was put together and you agreed to the contractual terms under the agreement, which
included all payments due under the lease agreement. The down payment that was collected by the dealership included your first lease payment for the term of February 26, through March 25, 2016, with the next payment due on March 26, in the amount of $278.22. Russ Darrow did not agree to make your second payment on your behalf. No where in the contract does it state that we would be providing you with this. the payment that was sent by Russ Darrow to Kia in the amount of $was an overage from the payoff of your Nissan lease. This money was sent and should have offset your March payment, thereby reducing the payment amount down to $81.73, which would be paid by you. As you know since you had previously leased a vehicle, payments start as of the day you lease, not 30-days after contract. If there was anything misstated in relation to your 2nd payment it would have been that the payment was not due until March 26th and not April, which is a five day difference.I'm sorry that you feel we owe you anything, but we simply do not.Thank you,*** *** Corporate Paralegal
I'm sorry that you had issues during the purchase of your vehicle. In order to answer your numerous questions contained in your complaint, I will go line by line so as not to forget any portion.You stated that you had financing set up with an outside lender. Russ Darrow offers
numerous lending options to our customers and sometimes when a customer brings in outside financing, we will try and beat that offer, with the customers permission. You filled out a credit application giving Russ Darrow permission to run your credit and try and find a better rate. Had you not filled out the credit application, we would not have had access to your personal information and we would not have ran your credit. Since I was not present at the time of the transaction, I cannot state with any certainty the way in which you agreed to provide this information.You stated that the whole sales process is misleading. The sales person can only talk about the vehicle, not about financing or aftermarket warranties that can be purchased. The finance manager would go over the different warranties and packages available on your vehicle and the pricing since it is formulated by the different companies we utilize based on the age of the vehicle and the mileage. And with any warranties, the prices are always negotiable and the finance manager can change the pricing based on the needs or wants of the customer.You stated that once you purchased the vehicle you noticed rust and some small dings on the vehicle. It is the customers responsibility to look over the vehicle, test drive the vehicle and take the vehicle for a third party inspection to make sure that they are purchasing a vehicle they feel comfortable with. All negotiations on the vehicle must take place before the contracts are signed. Once the contracts are signed the vehicle is the customers responsibility. This happens all to often that the customer signs all contracts and then comes back to the dealership and says, well I found this... The rust and or dings are not disclosable information that needs to be documented on the safety inspection. As these are not mechanical components of the vehicle. These types of issues can be seen by the customer as they would not be hidden issues.You stated that you left with an empty gas tank. All vehicles, whether new or used are sold with 1/tank of gas. If there was a gift card promotion available to you, this is something that needs to be brought up at the time of test drive/purchase. You stated that we signed you up for Equity4U. This is a contract that can be utilized to offset the interest you pay on the contract. This is something that you would have elected to sign up for by signing a contract and providing all necessary bank account information. This is also a cancellable product that you can stop at any time. I am sorry that you feel frustrated with every single aspect of the purchase of your vehicle. I will be sending you a good will gesture that I hope you will be able to utilize. It is not Russ Darrow's intention to make a customer feel like this.
