I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.Thank you for the responseI would like to address some inaccuracies in your messageYour employees took pictures of the car but the pictures DID NOT depict the scratch and the pre inspection sheet had a fraudulent signatureI had never seen the damage and you did not have proper documentation showing the damage existed prior and that is what triggered this chain of events and complaintHad you followed proper protocol and were able to show me that the damage (which I had never seen) was notated prior to working on my car, then we wouldn’t be having this issue right nowI also probably would have never noticed the fraudulent signature and Russ Darrow would probably continue to engage in unethical business practices. I disagree with you and do not feel that the body shop went above and beyondThe body shop actually monopolized my time, forged my signature and were not helpful in trying to resolve this issueThe deductible paid was done so prior to learning of the fraud that occurred and as a result, I couldn’t trust the body work you completed on my car and I had to take it to another dealership to check your workAs a business and contractually, Russ Darrow employees should be held accountable, follow protocols, and have integrityI find your lack of accountability objectionableThis complaint goes way beyond whether work was completed or not completedThe core of the issue is the fraud and deceit that occurred on the very initial documentation which had a negative downstream effectMy signature represents my name, my values and my honorMy signature will be used to sign medical records, write prescriptions and other important documentsRuss Darrow has devalued the significance behind my signature and fail to see the impact of their deceit. Dishonesty and devaluing of signatures should not be rewarded or approved. So, for my "troubles" and the deceit that occurred with my signature, please take some accountability and refund the $deductible that I paid.

I am sorry you feel Russ Darrow broke a tab on your glove box during a routine oil change, however, this would be next to impossible. The tool that they use to gain access to the filter is a plastic tool which slides in and releases immediately. There is no jarring or pulling on any part
of the glove box. The part is a maintenance item and can fail at any point. The amount of items in the glove box can also cause the failure of this piece. There is no telling what happened, especially since you brought this to our attention approximately months after the oil change. Also, when you brought this to our attention, we gave you an estimate in excess of $1,000. In lieu of you paying to replace the entire glove box, we put a screw in place of the tab which as of your last service, last week, was still in full operating standards with no issues.*** ***, Corporate Paralegal

Regards,
*** ***I have attached a fraud alert notice that shows I have a fraud alert on my SS#, before running my SS# they are required to ask me more information which they never didAnd they did not tell me they were handing over my SS# to other lenders

This matter was an issue from the beginning - insurance was involved for part of the claim. The issue started with his aftermarket alarm caused issues that were not related to the minor collision damage and he wanted everything covered by the insurance, which they denied. He was dealing
with multiple people because it was in the shop and body shop for unrelated issuesThe deductibles were part of different entities that did not coincide with one another. The vehicle was fixed by all parties and all related monies were disbursed to the correct Russ Darrow entity

I'm sorry that you feel Russ Darrow is responsible to notify you about the history of the car, even though we were not in control of the vehicle and would have no way of knowing if it isn't reported to any third party that we do business with, i.e CarFax. The State of Wisconsin mandates we disclosed any material history pertaining to the vehicle that we have direct knowledge of. If the vehicle was involved in an accident on our lot, that would be direct knowledge and disclosable material history. Russ Darrow does not imply or state any warranty on the vehicle. You did have the right to take the vehicle to an offsite third party inspection. You chose not to look into the vehicle before purchasing it. As for Russ Darrow selling rentals, this is common practice as 1/of all vehicles on the road were previous rentals. If the vehicle would have been a rental and we would have notification of such, the rental usage box would have been marked on the WI Buyer's Guide, which is a very important document that the customer must read and ask questions if they do not understand each part. Also, as for the purchase date, it was in May of and not in like you stated in your response. You have had the vehicle for approximately months and by your own omission, months before you even noticed anything. Anything could have happened between the day you purchased the vehicle and the first indication of any damage as noted by you. I am being told that when you brought the vehicle in, it was in noticeable disrepair. You would have never purchased the vehicle in the shape in which you brought it back to the dealership.*** ***, Corporate Paralegal

I'm sorry that you feel we have not handled your insurance claim to your satisfaction, however, Russ Darrow can only do as they are told by the insurance company, American Family. Your issues should be directed at American Family as they are the ones that direct the work that is to be done to
your car and what parts are able to be installed. *** ***, Corporate Paralegal

I'm sorry that you are not happy with your choice of vehicles purchased from Russ Darrow. We cannot guarantee any vehicle that we sell since we did not manufacture the vehicles. We do sell service contracts for mechanical failures that might come up while you own the vehicle. As
for the vehicle being a lemon, that is untrue and legally incorrect. A lemon is derived from a new vehicle that has not been previously titled before. You purchased this vehicle used with no implied or stated warranty, which is the legal standard in Wisconsin. We are required to perform a through safety inspection on the vehicle, however, it is considered a visual inspection. If we see something wrong with the vehicle we have a duty to look into it, but not take apart that component. As for a test drive we are required to "drive" the vehicle, not take on an extended high MPH test drive. The vehicle is driven around the lot. This is what the DOT mandates the dealership to do. As for the service contract not covering certain components of your vehicle...we are not the provider or owner of the warranty company. We sell their products but we cannot approve or decline any service, that is outside of our control. If you choose to cancel the warranty you can make that claim through Russ Darrow and we will have the provided cancel the warranty.I'm sorry that we will be unable to assist in any mechanical issues you experience with your vehicle. *** ***, Corporate Paralegal

This will confirm our conversation, wherein I will start the cancellation process immediately. You should see a principal payment on our account within buisness days

I'm sorry that you are experiencing an issue with the vehicle that you purchased from the Nissan location. Please provide me with specific issues relating to the vehicle that is the basis for your complaint. Also, please provide any outside estimates or documentation that you have
received relating to the mechanical issues with the vehicle. Once I receive this information, I will look into everything and provide a response based on facts.*** ***, Corporate Paralegal

Thank you for bringing this to my attention. I have left you a message to talk about an agreeable resolution. Please contact me at your earliest possible convenience.*** ***, Corporate Paralegal###-###-####/direct
