I'm sorry that it took you so long to figure out the issue and try to come to a reasonable resolution.  The vehicle you purchased was dealer traded with another dealer in the Appleton area, not a Russ Darrow.  The vehicle that was suppose to be brought up from a local Russ Darrow store was...

unavailable and as such, an alternate like vehicle was obtained.  The mileage that was put into the system was the vehicle from the Russ Darrow dealer and not the ultimate dealer that the vehicle came from.  There was a lack of communication in relation to the mileage with the sales team and the finance manager who had you sign out the documents.  As such, there seems to be an mileage discrepancy of approximately 750 miles.  In these types of matters, I use the Wisconsin DOT calculation for mileage discrepancies.  I also spoke with a DOT Investigator to confirm that I was using the correct mileage rate of $.20/mile.  He stated that the range is from $.15-$.25/mile, so I averaged the rate and came up with $.20/mile.  As such, I will offer to send you either a $150 Russ Darrow Gift card or a check made payable to you for $150.Please let me know which you would like to accept.[redacted], Corporate Paralegal

I have reviewed your complaint with the Service and Parts Manager at the dealership and have determined that we ordered the correct memory card from Kia directly, based on the VIN.  We delivered the memory card to you, installed it and showed you how to work it.  At the time you left the...

I am sorry that you did not have a positive service appointment in June at the new Russ Darrow Volkswagon store.  I did reach out to the service manager Mark at EVS and he stated that he would not be participating in anything relating to your vehicle.  Russ Darrow also will be taking the...

same position as the vehicle is 15 years old and has in excess of 190k miles.  Parts over time break down and become normal maintenance items.  This seems to be the case.  As a potential resolution, if you would like for Russ Darrow to fix the stripped plug, there are two options.  We could try and re-thread the plug and that would cost approximately $150.  If that does not work the only other fix would be to swap out the oil pan, which would run about $500.  We would offer you a 15% discount on the parts for whatever service you would like to try.Outside of that, Russ Darrow and or Motorville is unable to accept expired Castro oil checks.  We do not get reimbursed for expired checks.Please let me know if you would like to utilize the discount that I have offered.[redacted], Corporate Paralegal

I'm sorry for the lack of communication you received in regards to getting the product cancellation refunds submitted to your lender.  However, you stated that you started the process on or about January 12th and left numerous messages for an employee in the cancellation department.  The...

person that you stated you called was on an extended medical leave and would not have handled the cancellations for this particular Russ Darrow store.  In any event, the first cancellation check for the Tire contract and service contract was cancelled and a prorated refund check was sent to PNC Bank on or about 1/31/16 and was cashed by PNC on 3/18/16.  The prorated refund percentage's are given to Russ Darrow by the warranty company and are refunded based on that criteria.  Also, please take into account any cancellation for any reason outside of the free look period (first 30 days after purchase) are charged a cancellation fee, i.e. $25/tire contract and $50/service contract.  The amount of this refund was $1490.54.  The second cancellation check for the Credit Life was cancelled and a prorated refund check was sent to PNC Bank on or about 2/9/16 and cashed by PNC on 2/23/16.  There was no cancellation fee for this warranty.  The amount of the this refund was $1045.74.  The combined refund amount was $2,536.28.  I am unsure how you calculated a higher refund amount without the proration percentages from the respective warranty companies.  Also, while I can sympathize with you as it relates to the remaining balance on the loan, warranty refunds can take up to 90 days to be sent out to the respective lenders.  In your case all refunds were sent out within 30 days, albeit not cashed by your lender, but we cannot be responsible for any charges you incurred since the day of reporting the information to us.[redacted], Corporate Paralegal

According to the site, my complaint is closed but I did respond to the offer given by Russ Darrow. I asked the amount of the pending refund. I don't see this or a response from them posted. Nonetheless, I did not receive any refund and it is past the 10 days I was asked to wait. I logged on this morning to reach out again but see the complaint is closed. How do I proceed? Can this be reopened?  Can I file another complaint? It does not look like this company has any intention of giving me my money back or honoring our contract. I just don't understand how this is legal.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.The response by [redacted] Peiper was to question whether she should address the problem or not.That's not a response, that's dodging the issue.If she would have read the letter, or bothered to communicate with me at all, [redacted] would have realized that the Dealership (Russ Darrow Mazda Madison) and it's GM Mr. [redacted], has blown off this complaint since day 1. She would have also realized that even though I filled out the complaint form on-line the night of day 1, that I had to hunt down Mr. Lawler myself 1 week after filing the complaint. When I did get his attention, he had me check the unit into Russ Darrow Kia on the west side. By that time I noticed that not only was the paint pealing badly on the roof (and had rusted), but that the drivers side fender had rusted off the lower body and the left tail light was not functional. When I picked up the vehicle 1 week later, nothing was done about the tail light, I was told that all the fender needed was "a screw".In our phone call prior to me picking up the vehicle, he started the phone call by belittling my concerns and telling me that the vehicle was 11 years old. Mr. Lawler offered to "participate" for 1/2 of the "His cost" for repairing of the roof (I would end up paying an additional $750 for the vehicle and have only part of the problems repaired). After 5 or 6 times of him belittling my concerns and telling me that the fender only needs a screw, I lost my patience with him also. There has been no further communication though I have sent him a few letters - one which I informed him I was reporting Russ Darrow to the Revdex.com.To re-cap my "Opinion" at this point:I am very disappointed in Russ Darrow - all of them.It is clear to me that Russ Darrow GM's don't know anything about the product they sell, or about treating Customer's with respect. This seems to be a policy which reaches all the way to the top of Management. It has been over a month since this process started. Mr. [redacted] was rude to me. Mr Lawler was dismissive. And I have a vehicle that, though it runs well, has rust problems (I ended up fixing the electrical problem myself).I bought the vehicle in a rain storm. That was a mistake because I was unable to see the paint damage on the roof. I took it back 1 hour from the time of pickup because I saw the damage when I got it home. My [redacted] was dismissive and rude "What do you want me to do about it, you bought it AS-IS"...". The rusted fender and non-functional tail light were hidden damage. And even though the safety checklist showed all lights to be functional, Mr. Lawler refused to acknowledge that the unit went off the lot in this condition.I trusted that Russ Darrow had the integrity to stand behind vehicle purchases, so I purchased from them.The Gold card I was given actually gave me the option to trade for a different vehicle on day 1, but I was told it was for oil changes and a discount on parts. Neither Mr. [redacted] or Mr. Lawler addressed this option. They just wanted the unit to go down the road and stay there.What would make me satisfied:I expect Russ Darrow to come to the table with an offer to repair all the rust problems with the vehicle, or to give me a cash settlement that would even up the value of what I paid for the Vehicle and what KBB Retail is for the vehicle. In my complaint, I stated $1,500 would be a reasonable number.And I expect that all GMs and upper Management go through an intensive course in Customer Satisfaction. It is very clear to me that this is not the same group of people that I bought a Plymouth Caravan from years ago. Buying and owning a car should be a fun experience. Customers should be treated with respect and as if they know something.
