I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this does not resolve my complaint.

Ms ***: In your letter, which I have referenced elsewhere, you note there were NO changes made to the account except the name change. Why then was a service charge only charged to that account after Mr ***s name was added. Also it has been found that if a bank is aware of the status of the account and the financial situation of the person involved a financial reversal can be done, which I will pursue through the courts if necessary, they put my in dire financial straits and the funds belonged to neither Jeff nor myself, of which I have documented proof. I have filed a claim through the federal reserve and spoken with an attorney and while you have right to offset, this is an unusual situation and I am confident a judge will not rule in your favor, particularly under the circumstances and the unethical way the bank handled this. The law is the law..but there is such a thing as case law or common law, even in federal courts...which change the laws or add addendums to them. Which on principle I am prepared to do..both with the account fees that you owe me since the savings account NEVER had a service fee removed until the month following the addition of *** name and I have documented proof which I submitted to you and now totals because you took back the the bank manager refunded. Then took my escrow savings from a joint account suspiciously waiting to close Mr ***s account until his fees reached the amount in my account. Your manager had the opportunity to advise Jeff to pay his account or else I could lose my escrow and was aware of the situation, and did nothing. Which is both unethical and borderlines on misappropriation of funds/ possible fraud. But this is for a judge to decideIn addition regarding the bank fees, I contacted the bank times and not one person told me at any time that account needed to have a balance. Not one, I would have closed the account and moved my funds elsewhereIt was an unfair banking practice, charging fees without my knowledge or consent and against our original agreement and *remember you stated the account never changed*, if so, you really need to review my prior savings bank statements, which I have publicly requested year end statements for 2012, 2011, 2010, and 2008. Your bank is blocking me from obtaining my statements. Please forward those to me as soon as possible since I am no longer able to obtain themMy request remains the same, forward for bank fees taken from account ending in in error, and for an offset based on the information I have given you to date. Regards, *** ***They have sent the same letter over and over, and it is FalseObviously they did not hear my phone calls to them, and are making statementsI stated I had no funds, because by that time I knew my funds were stolen! The lady on the phone asked me if I tried to take out $and I said no because by that time my bank account had negative funds from my money being stolen! This bank has been giving me the run around, and have made statements about what I reported on the phone and my Police report I filed! I work too hard for this to happen, and then have these corrupt banks do nothing for you!! I have a copy of the statement they sent me in the mail showing I had a balance, and they the money got taken out and I went negative! It's crazy, and sad to me that they do not want to refund me my stolen money! They are mistaken if they think I am paying back a balance that I did not take outMy money was stolen, and this bank takes zero liability for their customers! Worse bank hands down, and even worse customer serviceThey crippled my holidays, my daughters birthday, and much more, but what do they care!! I will not give up on letting everyone know that this bank is corrupt, bad service, and in there practices!

For your reference, details of the offer I reviewed appear below. Re: complaint against M&T Bank's ATM fees, Revdex.com complaint ID *** . I received the same response from M&T Bank that you sent me in your June 2, letter. Again, the DISCLOSURE AND AGREEMENT says "For transactions not conducted at M&T ATMs for each withdrawal made at a non-M&T ATM the fee is $Fee is not assessed if the account to which the transaction relates is a MyChoice Plus Checking account." The receipt from the non-M& T ATM I used (Bank Of America) I used clearly shows a "$ATM Owner Fee" but the M&T bank statement only shows an ATM Surcharge Rebate of $(it should be $to match the DISCLOSURE AND AGREEMENT). M&T Bank's June 2, 20171etter we both received says "However, the surcharge rebate is limited to a maximum rebate of $per transaction." This is what they ARE doing, but they are SUPPOSED to issue a rebate of $per transaction to match their DISCLOSURE AND AGREEMENTHence my complaintBanks are not allowed to publish one set of terms and conditions, but make their computers adhere to a different set of rules. M&T Bank Reverse Mortgage instead of LOC for *** *** In reply to M&T letter dated July 29, 2015, I am confusedThis letter states that they will
reinstate a LOC to pay off the reverse mortgageThis does mean she is stuck with allthe costs of the reverse mortgageHowever, as stated originally when inquiring about these productsIt is quite possible that a Reverse Mortgage will be required in the future when ***'s assets are depletedIn that case she would have all these costs again. I am inquiring as what other options can be availed to herCan we have the reverse mortgage charges removed, so she just has the open LOC? Can we have a promise in writing that when she needs a reverse mortgage, it will be done without any costsIf this is possible, we would want to be assured that if the bank was sold, it would still be validPlease review and advise on other options the bank is willing to take to correct this costlymistake. M&T alleged that I failed to make my May payment They received my a payment on June I was told because it was late it will reset my plan they raised my plan from a thousand and fifty dollars a month to dollars a month to make up for the June paymentI did not miss a payment in may, it was received late It was due on May 29th they didn't receive until 6/6/14. M&T Bank really did not waive any gees gor me becayse the overdraft fees that were put on my account in July should of never been put on thereI had the
money in my account but they heldmy funds without my knowledgeThey also nevet informed me og any exyra charges fot overdrafting besides the one overdraft feeAlso how am I supposed to pirchase anything with my account if you keep adding unnecessary extra chargesI can't make any transactions on a dead accountMeaning an account I can't use. This complaint has been satisfiedThey returned the overpayment. They can not tell me when this late charge occurred, but it still stays as a late charge but refunded the said amountThank you for your serviceIssue dropped

This matter is still being investigated and while M&T Bank has provisionally put $back into my checking account, they have not yet notified me as
to their decision. They are doing everything to convince me that this was my fault when I believed I was speaking to a former vendor who provided computer help to me and that they were refunding the money I had already paid them by putting the money back into my checking. They even had the correct amount. It was that person who fraudulently opened a Western Union account in my name and stole my money out of my checking account, NOT MEI later learned that it was sent to Senegal, Africa. I am years old and live on Social Security and this was a crushing blow for me. If they decide to refuse to permanently put the money back in my account, I will be devastated and at the same time, terribly angryI will let you know when they let me know. Thank you

In order to accept this complaint as resolved I would like it to be noted specifically by M&T all charges are removedThe letter states "advance funds"I feel this is a broad term used by the bank industryI'm not clear if M&T is removing the charges or simply "advancing funds' to be paid at a later date through the life of the loanThe letter states the late charges of $and a inspection fee of $will be removedI request the full amount of $be removed and stated as suchNote please, the mortgage was never included in the previous Chapter only a disputed amount claimed by M&T was includedDischarge letter was previously submittedI request on paperwork to Revdex.com filed in this complaint a copy of the letter to be sent to credit agencies, a present payoff mortgage balance and the payoff mortgage balance after these charges are removed. My present mortgage statement for April lists an amount due of $I also request an attached mortgage statement on the Revdex.com record to show an Amount Due of the present increased mortgage payment of $for April or May when this complaint is hopefully resolved

This is in response to a letter that I have received on 11/16/from Melissa M*** from Office of the Customer Advocate office of M&T

In the letter it was mentioned that I am not M&T bank customer (Attached file)However, I believe I am M&T bank customer and as a proof, I have attached the file for reference that shows up on my current bank statementThis is a reference copy of a transaction that I have made dated 11/01/using M&T bank's ATM machine located in NYCI have purchased a product from M&T bankIn this case, the product was for $cash amount using my debit card from M&T bankHowever, it states that I have been charged $It appears that I have been charged a fee of $for using M&T ATM machineThe fee is amounted to 9.25% for $cash that was taken out from the M7T ATM machineI am disputing the fees
As I understand, there will be fees for using M&T ATM machineHowever, I believe that almost 10% fees for one time withdrawal is not justifiableThis is more than 50% of what I usually get charged for from other bank accountsThe fees should not exceed more than $3.00/$In this case I am disputing ($9.25-3.25) = $fees and I believe I am entitled to receive that money backA financial institution should not charge $fees for $cash withdrawal
Also, I am asking Revdex.com to take steps so that M&T bank or any other business shop charging such a large amount of fee fees for a nominal withdrawal for a ATM machine
I would appreciate if this letter would consider both of my options 1) return me $fee 2) Ask M&T bank to stop charge such larger fees

My complaint is and will remain that I think it is deplorable that a bank would charge their customers $to expedite a new card when they are victims of fraudThe bank offers no temp card or any relief to their customers as victimsI believe when the bank is aware of fraud that they send customer expedited card free of charge to not victimize the customer again, Regards, *** ***

now realize this was a mistakeI never told Ms*** that my granddaughter was allowed to make the purchases in fact I have said over and over again that I never authorized themI called in on Saturday the 27th and reported the fraudulent charges when I finally noticed themI have never or would I have ever given anyone access to wipe out my accountthat was my whole life savingsI did say I have allowed her to use it before but that was for prom and graduation clothesthe access of charges she did where mot to my knowledgeI went to branch and talk to Mr*** *** about the incident as well and he was under the the impression that the banks fraud dept should have been alerted once my spending habits changed but every representative I have talk to has informed me that its not there responsibility to monitor my money but I know this isn't correctI wrote to the CEO of the bank but surprisingly the letter was never received and then I recied that fraudulent letter from Ms***
