For your reference, details of the offer I reviewed appear below.  The bank clearly shows that I've been enrolled in the biweekly payment plan since 2013 and has failed to apply the payments properly for the entire term they have held my mortgage. This is a huge amount of extra interest that has now been accrued to my account because the bank felt that it was ok to hold my payment until the full amount was paid? What sense does this make? If the bank is unwilling to correct this error after I've contacted them directly and through the Revdex.com, my next step will be to contact the North Carolina Banking Commission. I hope this will be unesscary and that the bank will take the honest steps to correct this mistake. I look forward to hearing back soon. Regards,  [redacted]

For your reference, details of the offer I reviewed appear below.  Dear Mr. W[redacted], I am in receipt of your response and as of 05/18/2018 I believe M & T Bank still has not resolved my issue.  You have all the information in your possession yet it still has not been corrected. Since January I have been making the payments of $1,282.57 up until the most recent one I paid for May 2018 for $1,282.57. As stated in my prior communication to your online banking team, I was not aware of the escrow shortage as the communication was not received. Please conduct your research in more details and you will find that in February 2018 I agreed to pay the escrow shortage difference of so called amount of $302.74 along with the mortgage adjusted payment of $1,282.57 for a total of $1,585.31 reference number [redacted]. Bay View Loan Servicing insisted that they could take my payment over the phone at no additional charge and assured me that it was the only amount coming out of my account. I agreed to make the payment with the rep and on 02/14/18 noticed on my bank account that I was charged a higher amount of $1,602.31 which I never authorized and was a difference of the $17.00. I tirelessly reached out to Bay View Loan Servicing and kept getting the runaround. On 02/20/2018 Elizabeth A[redacted] at Bay View Loan Servicing, told me I had to fax her copies of my bank statement to show proof before I can get my MONEY ($17.00) back! She told me there was no ETA. After 4 requests and a month later on 03/12/2018, Nicole at Bay View Loan Servicing told me that there was no record of a request for refund. I then received several letters from M&T Bank informing me that Bay View Loan Servicing was no longer servicing my loan, so I then contacted M&T Bank and was advised that a request would be put in for me to get a check. So, to reiterate, it was not until February 2018 after questioning the spike in my payment amount, I was made aware of the escrow shortage and resolved it right away or so I thought your team took care of it. Obviously, we wouldn’t be here today if they had handled my account and applied my payments correctly. So kindly, check your figures and recorded calls to your company when they took the payment in February which included the balance of the escrow shortage. You further stated that a refund check was sent to my address, “letter dated 04/19/18”. Please note as of 05/17/2018 the refund check for $17.00 which you quoted being disbursed to me, has still NOT been received. I am very frustrated at this point. For your reference, details of the offer I reviewed appear below.   It’s the way the company handled everything. My grandmother worked with  them and worked with them, attempted to set up payment plans to get the  car back on track so they didn’t take it. There was no notice of repossession actions taken. The collection agencies didn’t forward her  in regards to any of it, the first time she had any notification was a hit to her credit report afterwards. And the collection agencies harassed her, there was many unsuccessful attempts, but we told them all to stop contacting us. And by law not one of them followed through with  our request. In my opinion M&T bank should be disgusted how they  handled this, they didn’t even give a 93 year old woman a chance. Now  she’s passed, I’m therefor responsible for a charge off for the company. That they’re still hitting me for “late payments” and additional fees.  There is no additional documentation to prove my stance, but I will be contacting a lawyer to take further legal action against the company. improved customer service as my choice of words appeared to be different from theirs.   I DO NOT  work at M&T, therefore, when I use the word STOP, it means to STOP, to not proceed any further! They need to train their employees to ask the appropriate questions to customers so that our meanings of chosen words mean the same thing! I find that this resolution is satisfactory to me, with the exception of their customer service training!  Regards,  [redacted]

The response seems to be blaming me and I feel they are not willing to work with me. The company states they called me several times. Well calls can be missed, I work in surgery and cant answer my phone during the day. If they had left a message I would have responded. Also, they have no problem emailing me special offers so they could have sent an email. Secondly they are claiming to have generated a mortgage statement on 9/21 which would have had the past due balance which would have alerted me. I didnt get that statenent. I have a copy of a statement for October which has no past due balance. Thirdly they are claiming to have sent a certified letter which was returned unclaimed. I never received a notification that I had a certified letter waiting for me at the post office. I certainly would know because my fiance gets them all the time. So if it was returned back to them how can I know anything is wrong with my account? This was a one time incident that I feel they should forgive due to the fraudulent activity on the checking account from which the payment was made. I have a statement from the bank in regards to the fraudulent activity. I took care of the issue as soon as I realized there was an issue and would like the late status removed from my credit report.  [redacted]

I was told that this is normal practes to have them charge that much for a check that is drawn on there bank.  But I have had other banks that have only charged my $5 to cash a checkthat was drawn on their bank.  This is unfair to me as a customer and is not fair to the public and the people that work and recieve checks from their employers.  The bank takes a percentage of the money that I work for just to cash a payroll check.  I have contacted the employer that the check was written from and they even agree that it is unacceptable for the bank to charge that much. The teller would not have been able to see if the check I deposited had an account with out enough funds but the teller would have been able to tell me that the check hasn't finished being cleared and there was still a chance for it to be bounced. When I went to the teller to deposit the check, I was told it would take 2 days to clear. Your teller gave me misinformation. The check was not cleared. Your teller could have warned me that there was still possibility of the money bouncing as I was withdrawing the money that was only available because I deposited the check. As a bank your responsibility should be to protect your clients, not to allow them to be scammed by foreign entities. As a bank you should have contacted the other bank before making the money available or at least give me warning that the check could still bounce. If you aren't protecting your clients then you are coming short as a bank, making your clients vulnerable to a lot of attacks. People go to banks because they feel they should be able to trust the tellers and their money will be safe and secure and that the bank won't give them access to money that isn't available. It really baffles me that it cleared everywhere but still bounced. The fault goes on your banking policies and your teller for misinforming me. I would not have withdrawn the money if I wasn't told by the teller it was abaiavail. I wouldn't have withdrawn the money if I knew it could still bounce. I would not have withdrawn the money if the teller told me the check was suspicious. I would not have withdrawn the money if the teller told me that they didn't finish the process for clearing the check but put the money in my account anyway. I would not have withdrawn the check if it wasn't for your bank's unprotective policies and negligent tellers.Regards, [redacted]

For your reference, details of the offer I reviewed appear below.  Although the money was finally deposited after a very lengthy time this does not help the fact that I missed my summer vacation with my kids and almost had my insurance cancelled. Nor do I understand why if the bank already knee there was an issue with the atm why was it not placed out of order? The only reason I got my card back the same day was because the repair man whom they already called happened to show up while I was there. I know this location was trying to help and supposedly it was the back office holding things up but this whole entire ordeal was one of the most ridiculous things I have ever dealt with and am I in no way shape or form satisfied with the response. You can apologize all you want. I am the one that had to live thru this and just an apology is not going to cut it.

Also I can provide proof of past payments made over the phone after the 25th that were accepted by normal customer service agents on a Saturday and posted that day..... I am attaching 2 documents. First is a copy of my phone records
showing where I did call in on December 29th (That you were unable to
locate). The second attachment shows a copy of a check from Saturday
09/30/17. On this date (a Saturday) (also while asset management
department is closed) I called in and they took my payment with no
problem. The payment posted on that same day (A Saturday) not the next
business day. I would be more then happy to provide other examples of
this if need be. So by you saying it would not have posted on the 29th
or the 30th is wrong.  There is NO reason my payment should
not have been accepted on the 29th or the 30th. If a customer is calling
to pay you money that is owed there is no reason for it to be denied
other then the simple fact of deliberately making them wait until it is
30 days past due to report to the credit bureau.

For your reference, details of the offer I reviewed appear below.  You guys post transactions in the order you want.  You should have cleared my $50.00 deposit on 04/18/2016 as well as the $128.68 [redacted] transaction and not delay the deposit. You are manipulating transactions, I never have this problem with my other bank which post transactions chronologically even if they are showing as pending. In addition, they don't send me text message  accounts update after midnight.  On 04/16/16: I made an online payment of
$100.00 to my [redacted] credit line. M&T  posted that transaction on
04/18/2016.
On 04/17/2016: -     1st
transaction 7:58Am: $50.00 sent for deposit in CHK9171.
-       
2nd transaction 12:07 Pm:  I made a debit
payment of $128.68 at [redacted] store.
On 04/19/2016: at 1:46AM, I received a text Alert
Stating: “M&T Alert: CHK9171 is below
$2.00. Available balance is -$0.71
as of 1:46AM on 04/19/16. May not reflect all transactions.”
As of 04/18/2016 in the late night, [redacted] transaction
and [redacted] transaction are first posted in the night batch but my $50.00
deposit ( which should be posted too on the same date) is still shown as
pending leading the overdraft 04/19/2016. 
I took a screenshot of my account on 04/19/2016 at 7:23 AM, the $50.00 is still shown as pending
but my available balance is $49.29 however my total balance is -$0.71. Why the $50.00 deposit is was not cleared
at the same time as the [redacted] transaction on 04/18/2016 which came second?  [redacted]

month of December alone. M&t  kept on sending the wrong document
holding up the payment from [redacted] auto insurance. M&t kept on sending
the full amount due on the vehicle and not the letter of guarantee.
[redacted] request this letter on the 11th, 12th, and 13th of december 2017
and twice more toward the end of the month. Then they requested it  on 
january 2nd, 5th, and 11th of 2018. My vehicle was totaled on december
7th 2017.   M&t took over 30 days to provide my insurance company
the correct information. Then after receiving the payment made me call
the gap insurance that was through them. I payed M&t money for gap
insurance I should   not be the one bugging the 3rd party insurance
company. It took over 3 months and 2 car payments before my gap
insurance was payed off. I would not have occurred so many overdrafts
had I had my money from the overpayment on the car. 3 months for any
business is a little ridiculous  . I want the overdrafts refunded. If
you need any information about the dates please contact my insurance

The response does not address the issues of my complaint.  At no time were the payments 90 days late or in a forclosure process.  Many of the functions described in the datail were performed after August 3, 2015 when the account was made current.  Also, the claim that they eliminated the 52.95 service charge without authorization on the account is a bold face lie.  They don't allow you to do anything material with the account until they have the documentation.  Furthermore, I have not even received the refund of $52.95 for the late charges.  This company continues to try to justify entering my brother's property without authorization, billing our family for them protecting "their interest" and outright lying about authorization while having absolutely no regard for the family of a lost love one.  You could call this business's behavior sociopathic.  I dealt with the power company, Cell phone company,  insurance companies, water softener rental, and health care companies.  Every one of them were sympathetic and I had no problems with.  M & T Mortgage was playing a game of "seeing how much they could take advantage of our misfortune."  I gave them my cell phone number the first time I called.  They didn't even bother contacting me once about any of these matters.  They even admitted that they remove the late fees on August 3, then they recharged them in closing.  That is pure evidence of scandalous behavior.  What's worse, I haven't even received that payment that they promised.  They have my address in St. Cloud.  It is written on both complaints that I have filed.  I will not let M & T Mortgage get away with cheating my family and my mission is to make sure they don't do this to any one else that has lost a loved one.  Regards, [redacted]

After numerous calls in which first I was told it would go back into my account and then a series of lies saying the check would be mailed to me, the refund was FINALLY deposited back into my account.. I would NEVER recommend this bank to anyone and for sure I will make sure I never deal with them again.  The issue is closed to me now that I have the money back. Consumer filed a new complaint referencing this old ID#.  I filed a complaint against M&T Bank over their failed repayment plan system. To resolve the issue M&T recognized their error, agreed to remove all late fees for the timeframe involved, agreed to report me to the credit bureaus as current for the past 18 months and offered me a Loan Modification Package. I though this was fair and accepted their offer. I completed the loan modification and returned it. While I awaited a decision I held my 08/29/15 payment since I did not know how much was be due. I thought I had a good chance of getting the modification since they scheduled an appraisal of my home. When I didn't get a decision I called and was told that I was denied. I made the 08/15 payment that day. I was told that I could have been considered for a refinance if I had not mad the 08/29/15 payment late. First of all, that was never an offer, second of all if they made me current for the last 12 months 08/15 should not have been considered because it was not paid 30 days late. I feel like they intended to help me at all. I don't want something for nothing. I am a single mom who has been struggling to keep my home for the last 12 years. I just need some help. To make matters worst, I have reached out to another financial institution who was trying to assist me. The problem now is that my credit reports shows my M&T account as 30 days late for the past 12 months. That has taken my credit score down to below 600 and now they cant help me. I called M&T and was told that they only showed one late payment and that was for 08/15. I was transferred to customer service who said they show me as late 5 times in the last 12 months even though they have agreed that I paid as agreed during the repayment plan. The rep advised me that he could not see any agreement to report me as current during the repayment period and advised to take my complaint to the credit bureau for investigation. He said he was not removing anything or reporting anything that he did not see. When asked who would be able to see the info he said whoever was involved. I give up!!. Not only are they not going to help, but they are now preventing me from getting help from any other source. I believe they just want to take my home.  Correction to a credit report   If M&T had explained that by making me current, I was eligible to refinance and offered refinance as an option I would never had filled out the loan modification package. I don't think they should count the 08/15 payment as late since they never sent me the denial. I had to call them for the decision. I held the payment hoping that the modified amount would be less. I would like the lateness removed for 08/15. I would like to have my information reported to the credit bureau as current for the timeframe of the repayment plan as they agreed so I can try to get help from another bank.

The following is a complete falsehood.The representative reviewed your request and informed you that your external bank account ending -4710 was currently suspended in the Bank to Bank Transfers service, and as a result, the transfers were unable to be processed. As part of M&T's due diligence and for your protection, after you submitted the transfer request online, M&T contacted [redacted] Bank to verify that the account ending -4710 was owned by you. Because [redacted] Bank refused to verify the account ownership, M&T cancelled the transfers and suspended the account. I was never advised of the above and infact I went through the M&T verification process with [redacted] bank which was successful. I'm sorry but M&T Bank is the most inefficient bank.

The letter that the PR wrote regarding Nancy E. and this matter did not resolve what happened.. I am very displeased with the handling of my business and resulting complaint..and even more disatisfied with the unprofessionalism and chain of command process as noone acknowleged my responses or information that I provided. Ive been a faithful customer of M and T Bank for years and am considering pulling all my interests and investments from this bank to do business with another bank.  Regards,  [redacted]
