I have reviewed the response made by the business in reference to complaint ID 10826706, and have determined that this does not resolve my complaint. ...
For your reference, details of the offer I reviewed appear below. First of all, all the stated data is not only incorrect but a downright lie. Misinformation was provided by the bank and what I stated to Cindy R[redacted] and what was agreed to by her was that ALL, not only three NSF fees were to be reversed This was due to the misinformation provided by thir rep and teller. Secondly, the fees to date have Been reversed and taken right back by the bank. This NSF situation was caused solely by M&T Bank and instead of taking accountability they are looking to hide their tracks. I am presently filing with the Attorney General's office and consulting an attorney. [redacted]

For your reference, details of the offer I reviewed appear below. M & T Bank does not acknowledge that their representative caused us financial strain by providing inaccurate information regarding our mortgage. She did in fact say on a recorded line that Cenlar had paid us up until our next mortgage payment would would be due on the 28th of July. PERIOD. As I mentioned, I did not make this up, I did not intentionally put our family in financial strain. We were AHEAD on our mortgage payments and had never been late. No compensation has been made on there part to help with the strain that they have caused. They have ignored the fact we were given the wrong information about our payments due upon transfer, and have only given us the same information that we already have. This issue, in case they missed my multiple points is regarding the wrong information about our payments due upon acquiring our loan from another lender - not the bi-weekly draft. There is no sincerity- just words. Regards, [redacted]

[redacted] I do not accept the response, it is not my fault that all I wanted to do was make some extra cash and love to shop, so I received a check to go and evaluate a store. I have all the emails and texts that I received.. All I want is my $10. and my account back. If it was my fault it would be a different story. I can send all if needed.

reference, details of the offer I reviewed appear below. I indicated in writing that I do not want overdrafts to be authorized. I signed the document. Therefore I was under the impression that if I ever was unable to cover a transaction, it would be declined and there would be no overdraft fee. In my opinion, M&T Bank is shady, greedy for money, and misleads it's depositors. I will be closing my account as a result. I also indicated in my complaint that I am willing to speak to the media. I will be doing so to let the public know how dishonest M&T Bank is and how they run their business. Regards, [redacted]
Requesting a policy change so that M&T acts like a reputable financial institution rather than a Loan Shark. Action Request: When a problem occurs that the M &T contact client by phone, leaving a reasonable message, and contact number so that any problem can be resolved fairly. They...
had called before when they wanted me to refinance, so why not again? Notes: I sent an early payment which the bank returned, then stated a policy never mentioned before about post dated checks. My original loan was with [redacted] and I never had any problems. This company (M&T) is a unknown financial institution to be researched. How they got my account has still not been explained. If they had cashed it, the check, the money was in the bank since I was sending the payment early because I was going to be traveling. Instead they recorded that they did not receive the payment and put it on my credit report. Costing me long term problems. I wish them (M&T) to act like a reputable institution and give my loan back to [redacted]!! If not possible, to act like an American company instead of a foreign bank. Decency. Thank you, [redacted]Please keep all data on their file. I don't want this to happen to others.

Here are clear details for M&T Bank to investigate further. 08/05 298.62 Payment deducted out of [redacted] Bank Account. 08/06 298.62 Payment deducted out of [redacted] bank account. Your records show that only one of these payments was received. [redacted] bank account shows that both payments were deducted and nothing credited back. No actual reversal back into [redacted] bank account occurred. I have statements and account balances showing the balance was decreased each time by $298.62 from the [redacted] bank account. A dispute was opened to find out where the payment went. The dispute was closed with $298.62 returned to [redacted] bank in November 2015. However, this was not a complete investigation as to where the additional funds(298.62) went. A payment was simply returned to the [redacted] bank account causing the loan payment to be one month behind. If both payments made were credited to the loan account, as should be, then the loan would be on time. The additional $298.62 made in the beginning of August is still missing and according to the tracking # provided by [redacted] bank went to M&T bank. As for the account showing a reversal, I have a printout of the loan activity statement where each month the account shows a reversal. No one is sure what the reversal means including representatives from M&T. They assume that it is reversed back to [redacted] bank for insufficient funds. My son was told once by M&T Bank that the payment goes through another step where it gets credited to the auto loan and probably that is the term used for the transaction.(Not sure if this is correct, but this is what he was told). The claim by M&T Bank that the July payment was returned for insufficient funds is incorrect. At the time the first payment was made in early August, the account had quite enough funds, so that when the auto deduction occurred again the second time in the beginning of August, it deducted funds again. Please review all paperwork consisting of statements, account balances, tracking numbers, and letters explaining the issue sent multiple times to Consumer Asset Management. One of the payments made in August is still missing and is at M&T bank based on the Company ID, but not credited to the auto loan. I was told by M&T during their investigation that it went into a non-existing loan account. If your investigation can focus on tracking where that one payment went, recovering it, and crediting it to the auto loan, this issue will be resolved. It did not get returned or reversed back to the [redacted] Bank account. If you are unable to get the records from Consumer Asset Management, I will be happy to send them to whoever is investigating this. I am looking for a resolution to this and the resolution is not that I am missing a payment, it is where in M&T Bank did my extra payment made in early August went. Once it is found, it should be credited to the auto loan.

I want Mt to allow me an interest of only payment for the March payment and commit to no negative report to any credit bureau since they know that money from the involved insurance companies is forthcoming

For your reference, details of the offer I reviewed appear below. I don't accept this explanation as they do not acknowledge that they are illegally citing the Patriot Act as an excuse to make customers come into the branch to deal with dormant accounts. Furthermore they now say they don't close dormant accounts, that is the reason they gave why they could not deal with this matter on the phone. They caused me to leave work early and it was completely unnecessary Regards, [redacted]

The attachments provided by M&T Bank did not provide the answer, whether the default beneficiary was spouse or estate, which could have been conclusive and avoid the need for probate. Their representative erroneously claimed it had to be the estate under the law and refused us access to their legal department to clarify that error and understand the basis of their position. Their responses were non-responsive require further repeated inquiry on behalf of our client.
Due to the above, we opened an estate administration and our client incurred expenses greater than the value of the asset held with M&T.
M&T neglected to provide a response to our proposed resolve to this matter.

For your reference, details of the offer I reviewed appear below. Jason [redacted] , the author of the business's reply letter, is consistent with M & T Bank's erroneous position that I and / or my insurance agent are at fault for failing to provide proof of insurance renewal by the deadline. Mr. [redacted] has not acknowledged that the fault lies with M & T, not with my insurance agent or me. Nor did he promise that the committed errors he wrongly denies and ignores will not be repeated. For your reference, details of the offer I reviewed appear below. My issue with the following response is that my refund request explicated requested for the refund to be returned to me. In the fax request I provided my contact information in case there were any questions/concerns. If the bank was not going to honor my refund request, then I would expect that the next action would be not to refund me. Instead, the bank refunded the person who paid last (my ex-husband). When I spoke with the representatives waiting to get my refund returned everyone assured me that I would be the one getting the refund back. However, that was not the case the the refund was returned to my ex-husband. Once it was realized that the refund was returned to my ex-husband I was even told that the monies would be returned to me. This did not happen either. To make this correct I am still requesting my refund sent back to me from the bank since it was given to the incorrect person (my ex-husband). Regards, [redacted]

For your reference, details of the offer I reviewed appear below. If you do not want customers to use the $200 sign up bonus promotion code then give the customer a 'courtesy' message saying this on the sign up page. It's really just that simple. It's banks like yours that make people put their money in shoeboxes. You honestly give banking in general a bad name. I will say thank you though for closing this bank account and I still reject that you are not giving me the $200 sign up bonus that was stated I would get during the opening of the bank account. I will be leaving my review of your shady business practices on every website that has your banks name attached to it.

your reference, details of the offer I reviewed appear below. I still view this entire process as extremely high risk for myself as a homeowner as I may potentially have a lien filed against my property if insurance funds are not released in a timely fashion by M&T Bank after completion of work. A contractor has a limited window of time in order to file a lien on a property after completion of work in Oklahoma and not receiving payment in full. I still feel that I, as a homeowner, am at the mercy of M&T Bank scheduling the inspection and releasing the funds in a timely fashion before a lien or court action could potentially be filed by the Contractor against me as I will be the person signing the contract for work with the Contractor. The follow-through with M&T Bank has been non-existent thus far and I have received conflicting and obviously inaccurate information every time I call. I had requested a copy of the denial of my request for exemption from the express monitoring; I have yet to receive the requested letter. I have been told that M&T Bank would deduct the inspection fee from insurance proceeds several times, but I have also been told that I wouldn't be responsible for paying the inspection fee. A rep also stated they would fax a statement to my wife stating that they would waive the inspection fee. That of course didn't happen. All M&T Bank customer service reps state they are right and the other M&T Bank reps my wife and I talk to are wrong and giving us bad information. Further, I do not agree to the Current Account Statement Terms and Conditions as I view this as an addendum to the original mortgage document and these new terms and conditions offer no further consideration other than access to insurance proceeds to pay the Contractor. Signing this document modifying the original terms of the contract (mortgage) and granting additional rights to the lien holder to tap insurance proceeds for undefined fees and expenses without any consideration as a precondition to releasing insurance proceeds is not in my best interest to sign and acknowledge. Though I am not behind in my mortgage, nor have I been behind in mortgage payments, there is too much open ended language involved: one specific example is "including cost fees or any expenses associated with our account". M&T Bank does not clearly articulate what the cost fees or expenses are. The document also states that remaining funds will be paid to the outstanding principle balance of the mortgage. Then states in the next sentence that once the loan is brought current and all fees and expenses are paid, any remaining proceeds will be returned promptly to the mortgagor(s). The only way these remaining funds could be paid to the mortgagor is if the mortgage were paid off. The language in the sentence states outstanding principle balance meaning any balance of the mortgage and not the past due or principle payment balance. This is contradictory language unless the mortgage is paid off. Regards, [redacted]
I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below. M&T Bank still responding the same information which I understand, as they said y the prior and actual letter, a foreclosure process was stopped, by me sending the balance necessary to bring my account updated, this payment was done before any process of foreclosure was in place, M&T Bank charged me with the attorney's fees of almost $2,000 thousand Dollars, that's the amount I am claiming to be returned to me since, no lawyer ever contacted me about any foreclosure, I don't even know which lawyer or firm was taking care of what M&T claim as a foreclosure process, I received a communication from M&T Bank, saying that I may be going into foreclosure but I PAID ALL THE LATE FEES AND LATE PAYMENTS ON FEBRUARY 2017 stop sending me the same letter please send me copies of the lawyer notification, or court orders or date of beginning of foreclosure Regards,

The following reasons why M & T Banks reply does not make sense and thus we do not accept the reply.1) On 1/10/2017 a service charge of 100.51 was taken out of the account. This service charge has no explanation as to why it was applied to our account.2) On 01/17/2017 the account had a withdraw by a phone pymt to capital one in the amount of $30.00. This payment was not authorized for this account, the bank had been notified of the mistake prior and has nothing to resolve it.3) Further on 2/8/2017 another service fee was withdrawn this on in the amount of $100.90 from the account with no explanation.4) Finally, I could have just discussed this with M T bank but their reply letter does not provide an email and phone point of contact for the person handling this matter at M T bank instead it provides info on their collection company. Again, showing they have no interest in fixing their mistakes, just I should just shut up and pay them is the attitude.5) this reply does not explain how account went from 109.18 (01/23/2017) overdrawn to the stated 194.53 on the letter.6) Also, I called the number given M T for MRS BPO three times today and no answers. You are just placed a waiting line for the next rep and no one picks up.7) The letter states a letter was sent on 05/24/2017 we have no such letter, another mistake by MT bank I guess.8) Finally got someone at MRS BPO but they were unable to assist me due to the fact M T bank did not put on the letter the MRS BPO account number. MRS BPO instructed me to contact MT bank back for the required info, such as the account number.9) I did receive a letter today from MRS BPO, so I called them, gave them the account number and they will not talk to me since I am not listed on my account at MRS BPO. M T bank did not put my name on my business account instead they put the wrong name on the account. They placed my wife’s name who is just listed on the account so she can do business transactions in my absence. Again, another example of MT banks continuing mistakes! So, M & T takes money for their mistakes, does not correct them, does not even explain them and does not provide the required information so we can get the collection company to explain them. What an effective way to make unhappy customers! I had and still offer to cover the $30.00 payment but not the $164.53 in fees due to M & T issues and mistakes. If I made the mistake I would expect to pay the fee, but since M T made the mistake they should cover the fee.Regards,[redacted]
