Ms. [redacted] opened an account with Merrick in October 1. 2015 and the card associated with the account was sent to her on November 1, 2015, . On November 20, 2015 Ms. [redacted] contacted Merrick by phone inquiring about when she should receive the card. The notes on the account do not...
indicate that she requested that a new card be sent to her. There is also no indication that Merrick received any returned mail.
Upon receipt of this complaint I requested that a new card be sent to Ms. [redacted] at no charge. The card was sent to her application address which is the same address as on the complaint. She will receive it tomorrow via express courier.
If Ms. [redacted] does not receive the card tomorrow she can contact us at ###-###-#### and find out why it was not delivered.
In March 2017 Ms. [redacted] requested help with her account and she was approved for an Account Restructure Program (“ARP”) offered by Merrick. A letter dated March 13, 2017 was sent to her which outlined the program and how it worked. Ms. [redacted] made her first payment under the program,...
but that payment was returned unpaid. This is the reason that her account was charged off and the online access to her account was blocked. Ms. [redacted] replaced the returned payment within 3 days. Therefore, Merrick has made an exception and reinstated Ms. Winter’s account into the ARP. The credit reporting has been updated to remove the charge off previously submitted. However, Ms. [redacted] will need to make 2 payments of $17 each under the program before June 10, 2017 to avoid being removed from the ARP again. The changes to the credit bureau reporting can take up to 30 days. If Ms. [redacted] has questions she may contact Merrick customer service at 800-253-2322.

I am rejecting this response because:Per Merrick's response: "On June 22, 2016 Ms. [redacted] made an additional payment on the account for $758.43 which was the balance remaining after the May 2016 settlement payment. The account status was updated with the credit reporting agencies to “paid in full” at that time."Despite clearly showing a June 22, 2016 update on the attached credit report excerpts, this account is not reporting as paid in full and/or closed with ANY of the 3 major credit bureaus (please refer to 3 attachments). This is inaccurate and frustrating.

A review of Mr. [redacted] account was conducted. Mr. [redacted] opened the account in November 2010 and has used the account for the purchase of goods and services. On November 21, 2015 Mr. [redacted] informed Merrick of the fraud on his account. An affidavit of fraud was sent to the...
address of record on November 30, 2015. Merrick received the executed affidavit back via fax on December 2, 2015. Merrick has issues a temporary credit to the account in the amount of $34.99, and an investigation into the fraud claim has begun. Once the investigation is completed Mr. [redacted] will be informed of the results and if the claim is accepted the credit will become permanent. An adjustment to any finance charges will be made at that time.

A review of Mr. [redacted] account was made. In October he was late making the payment that was due on the 23rd of October that payment was not received until November 5, 2015. This resulted in a late fee being assessed to the account. Mr. [redacted] called and spoke to two...
different representatives of Merrick bank regarding the late payment. Mr. [redacted] requested that the late fee be waived and the first representative waived the fee. However, the payment made was not the full minimum payment due and because of this another late fee was assessed to the account in December. Mr. [redacted] will need to make the full minimum payment due each month to avoid additional late fees from being assessed to the account. It is Merrick’s policy to waive one late fee in a year. Mr. [redacted] account will not be eligible for any additional late fee waivers for 1 year from November. I have enclosed statements for his review.
Merrick has several accounts with a similar name. But none with this address. Please provide an account number, SSN and any other names the account might be under. Merrick will then research and respond to this issue. Thank you

excess of 6 percent per year that is incurred by a servicemember, or the servicemember and the servicemember’s spouse jointly, before the servicemember enters military service shall not bear interest at a rate in excess of 6 percent per year during the period of military service. Ms. [redacted]’s account is not eligible for this benefit because she is not a servicemember and her husband who is in the military is not on the account. If Ms. [redacted] is having difficulty making the payments on the account Merrick has many payment plans; all of which require the account to be closed to new purchases and some of which have low interest rates and fees. Ms. [redacted] can contact customer service at 800-253-2322 to find out what options are available to her for this account.
The issue is that the payment was claimed to be unauthorized by Ms. [redacted]'s sister via a letter from Bank of America. The reply is correct and the account will remain blocked to payments made from that bank account.

I am rejecting this response because: There is no possibility that I submitted a totally different account number that has no relevance nor any similarity to any of my accounts, plus I have afterwords seen a lot of complains online that Merrick Bank changes the account information after submitting payment online. account had a returned payment in July 2017. For the months of August 2017 through February 2018 a payment was made for less than the minimum payment due or a payment was not received at all. This is the reason for the late fees assessed to the account. The address on the account was updated in December 2017 to the current address in Worcester MA during a phone call with Ms. [redacted]. Merrick is obligated by law to post payments when it receives them (not when they are sent), and it is Merrick’s policy and practice to post payments to accounts as of the date they are received. Merrick has found that the US Postal Service is frequently slower than our cardholders expect when delivering payments to our processing center. Merrick performs recurring periodic audits of our payment processor and these audits have shown that delivery times by the USPS vary significantly and unpredictably. In addition to making payments via regular mail, please know that Merrick Bank offers the following payment options free of charge which may be beneficial to Ms. [redacted]. As stated in the response we have done a through search for this payment. We had engaged the lock box vendor to search as well and they have stated that none of the batch coding on the check is consistent with their process. We cannot find what we never received. One Main will need to have Bank of America tell them who submitted this check for payment. It was NOT Merrick.
I will request a further review of this request. I cannot guarantee there will be any change in the reporting status but I will request a reconsideration.

of each month. The Merrick representatives who spoke with her explained that according to the account records it had always been the 1st. Ms. [redacted] requested a due date change and the due date was changed to the 16th of each month beginning in January 2016. Ms. [redacted] requested that the late fee for November be waived due to the due date confusion. The representative who spoke to her explained that he would request a waiver of that late fee in the amount of $38.00 but could not guarantee that it would be waived. The request for the fee waiver was declined. Upon receipt of this complaint I have, as a courtesy waived the late fee assessed to the account in the amount of $38.00. Ms. [redacted] will need to make the December payment on or before the 1st of December as shown on her statement. After that payment the due date will be the 16th of each month. I am rejecting this response because: The letter simply states the account had been closed but didn't give me a opportunity to use the account to avoid adverse affects on my credit report which looks at total available credit balance and average length of time on each account to factor into a FICO score. Furthermore the cardholder agreement I have does not state that the account can be closed due to inactivity only for past due balances or no payment.

Merrick has reviewed Mr. [redacted]’s account. Mr. [redacted] opened the account with Merrick in December 2013. The last payment received on the account was on September 9, 2016 for the amount of $75.00. Merrick has received no other payments from Mr. [redacted]. Mr. [redacted] may...
provide Merrick copies of the cashed money orders so we can research further. Once we have received those copies, front and back of the cashed money orders we can determine whether those payments have been received, or have been applied to a different account. Without those copies there is nothing Merrick can do to resolve Mr. [redacted]’s issue. When Mr. [redacted] has the copies of the money orders he can fax those to us. Please call us at 800-253-2322 for the correct fax number to send the copies for research. If Mr. [redacted] discovers that the payments were never cashed, he can request that they be reissued to him. He can then send those reissued payments to Merrick.

I am rejecting this response because:
I sent the theft avidavit back and you can check your cal records I spoke with a guy and I informed him that I never received anything else form your company after I sent the avidavit back he stated your company never received it. What proof will I have to show I did not open this account. I was just made aware of the account when I informed your company that I was not aware of the account that's when the forms were sent to me that I returned. Your sending statements that goods were purchased that I did not make.

I am rejecting this response because: I made payments on line after March 2017 and I continued to make payments until I was locked out of my account and I called and was never able to get back in my account to make any additional payments. No one ever sent me a bill in the mail either. SO this account was never delinquent on purpose by any means and I wont pay anything if its in collection because it has no reason to be in collection! Makes me think Merrick Bank makes it impossible for its customers to make payments so they can charge late fees and then over the limit fees and then send them to collection - how convenient. Why was I locked out of my account? Why was a bill never sent to me? Why did it take me filing a complaint with the Revdex.com to get anyone from Merrick Bank to respond to me? I dont know what company is sending me emails but they obviously for my email from Merrick Bank and they are asking me to pay them. Wont happen. I will only pay Merrick Bank.
