Complaint: ***I am rejecting this response because: The actual complaint was not addressedFirst of all thank you, Merrick Bank for your responseNow, my concern is not that Merrick closed the accountAs Merrick Bank stated in there response, they attempted to draw a $payment, when there was only a balance on the accountThat is when I contacted my bank and reported that the amount removed from my account was not owedHad I been notified that Merrick Bank was going to close the account, I would not have made any further charges on the accountMy complaint is that after closing the account, Merrick Bank refused payment several times, until my account was over days past dueBefore this, I had not a single late payment on my credit report, in years! I was forced to open another checking account, just to pay Merrick Bank! Ms*** opened an account with Merrick in February and has used the account for the purchase of goods and services. On August 15, Ms*** called Merrick and spoke to a representative in the dispute department about a transaction that she had made on March 29, with a
company who she thought would assist her with her student loans. Merrick received a letter regarding that transaction on October 20, indicating that the merchant had mis-represented themselves. Ms*** explained that she had contacted the merchant on July 29, and cancelled the service, she also requested a refund from the merchant during that callThe merchant declined to provide a refund according to Ms*** The Fair Credit Billing Act (“FCBA”) requires an account holder to notify the Bank within days of the time a transaction appears on a periodic statement that they are disputing the transaction. Ms*** did not do so, she did not contact Merrick until months after the initial transaction appeared on her billing statement. Also, Ms*** indicated that she made the transaction, but was dissatisfied with the service. This does not constitute a billing error Ms***’s remedy lay with the merchant regarding this issue. There is no further action Merrick can do to assist Ms***

Mr*** opened an account with Merrick in July and has used the account for the purchase of goods and services On March 6, Mr*** called Merrick and reported his credit card account had unauthorized charges on itMr*** stated that there were unauthorized charges on
the account but that the card was in his possessionOn April 4, the charges that Mr*** indicated were unauthorized were removed from the account and provisional credits for the amount of the alleged unauthorized charges were made to the account. Merrick sent Mr*** a letter indicating those credits were provisional while it investigated his claimOn April 12, Mr*** called and indicated there were additional unauthorized charges appearing on his accountThose transactions were also removed from the account and provisional credits were applied to the account for the additional amounts On April 13, a letter indicating that the credits were now permanent was sent to Mr***Mr*** will not be responsible for any of the unauthorized charges on the accountIf he has any additional questions, he may call our security department at 877-487-

Mr*** opened an account with Merrick in October and has used the account for the purchase of goods and services. Mr***’s account would have qualified for a doubled credit line when he made seven on-time payments on the accountIn January a payment made on the account was
returned unpaidMr*** promptly replaced that payment. Because he did so Merrick has made an exception to its policy and granted the credit line increase for Mr***’s account The account now has a credit line of $1200.00. Mr*** should have access to this additional credit as of April 11,
Mr*** opened an account with Merrick in July and has used the account for the purchase of goods and services. The due date on the account is the 13th of each month. The June payment was not received until the 14th of JuneNevertheless, that late fee was waived as Mr***
notes in his complaint. Merrick did not receive the July payment until the 15th of July which caused another late fee to be assessed to the accountA minimum payment is due each month there is a balance owing on the accountA fee waiver does not reduce the minimum payment due in the month the fees were waived, but that waiver does reduce the following month’s minimum payment dueAs of the date of this response Merrick has not received the August payment due on the account. Mr*** account has had the maximum number of late fees waived allowed by Merrick’s policyNo further late fees will be waived for months from the last fee waiver

A review of the account was conductedMr*** has had an annual fee on the account since he opened the account in October 2015. The first year the fee is assessed to the account in one lump sum and each following year the fee is assessed monthly. This information is disclosed on the
pricing appendix that was sent to Mr*** when the account was opened. In addition, the billing statements sent to Mr*** include a notice that the monthly portion of the annual fee will be assessed prior to the assessment of that fee. In accordance with the Cardholder Agreement, Mr*** agreed to pay the Annual Fee(s) for each year the account is open and for each year in which there is an outstanding balance on the account. The Cardholder agreement sets forth the terms as follows: If your account is closed but you fail to pay off the full account balance, you agree to pay the amount of the Annual Fee and applicable fees billed to your account for each month there is an outstanding balance. Merrick will not waive the annual fee. If Mr*** does not wish to pay the fee he can close the account and pay the balance of the account in full
Merrick’s records show that Ms*** opened a credit card account with Merrick in July Ms*** used the account to purchase goods and services until it became delinquent in August and was charged off for nonpayment in March 2016. Prior to the account’s delinquent status,
payments were being made via online payment system from a Bank of America accountMerrick did respond to four credit bureau disputes received via the credit reporting agencies between January and March 2017. Merrick responded to those credit bureau disputes by conducting an investigation and sending the response back to the credit reporting agencies as required by the Fair Credit Reporting ActThe date of first delinquency determines how long an account will be reported by the credit reporting agencies. That date for Ms***’s account is August 28, 2015. Derogatory reports can remain on a file for 7-yearsThe status of the account as reported is correct and accurate according to Merrick’s records and will not be deleted or modified. To do so would be a violation of the Fair Credit Reporting ActAs validation of the debt, I have enclosed copies of statements reviewed, and the application submittedIf Ms*** still does not have any knowledge of this debt and feels as though the account may have been opened without her knowledge or consent then she will need to contact our Fraud and Security Department at 1-800-215-

Mr*** opened a Visa credit card account with Merrick in September The terms of the cardholder agreement which govern the account, and which were disclosed in marketing materials and again when Merrick sent Mr*** the card, are that an annual fee is charged while the account
is open or has an unpaid balance. I have included a copy of the cardholder agreement applicable to Mr***’s account for your reviewUnder those terms the first year annual fee is assessed at the time the card is issued, and subsequent annual fees are billed 1/monthlyTherefore, even though Mr*** paid the balance on his account, the annual fee continued to accrue monthly, because the account was still open For the months of June, July and August, there were no payments received on the balance owing on the account. This caused negative credit reporting on Mr***’s account. In September Mr*** brought the account current and it has been current since that time The credit reporting for the account is correct and accurate according to the records for the account. Merrick will not delete or modify the reporting
