A review of Ms***’s account was made. Ms*** opened the account with Merrick in March 2015. The first payment on the account was due on May 17, 2015. Ms*** has made payments on the account since it has been opened
The solicitation for the account
indicates that she must make at least the minimum payment due on time for the first months the account is openSince the first payment was due in May her credit line increase would not be added until November and then only after she has made the November payment on time
Ms*** will not be penalized because she paid early, however the credit line increase will not be added to her account until November as long as she meets all of the conditions to receive the increase
Merrick strives to respond quickly to account holders questions and occasionally supervisors are unavailable to speak to immediately. Messages are normally returned wihours from a supervisor’s voice mail message.
The late fee that was assessed the account has been waived as a courtesyMs*** should see this adjustment on her next statement

Mr*** opened an account with Merrick in August and has used the account for the purchase of goods and servicesAccording to the account history on February 24, Mr*** called Merrick regarding disputed charges on the account. The account notes indicate that he was
disputing a charge from Best Western in the amount of $from February 15, 2017. According to the notes Mr*** accepted a room rate higher than he usually received, but left the hotel after hours in the room without checking out or informing anyone he was leavingMerrick opened a billing dispute claim and began an investigationA request for additional information was sent to Mr*** on March 4, No reply to that request was receivedNevertheless, Merrick credited Mr***’ account for the charge of $on April 26, and closed its investigationA final resolution letter was sent to Mr*** on April 27, for this claim An investigation of the second billing dispute claim is being conducted and Merrick has granted provisional credits to the account while the investigation is pendingThe disputed charges were charged back to the merchantIf the investigation indicates that the disputed charges are unauthorized, the provisional credits will become permanentMerrick will notify Mr*** in writing of the final results of the investigation

Merrick Bank is in receipt of your complaint dated February
26, regarding settling a charged off accountThe cardholder accepted a
settlement offer and made the final payment on February 24, The payment
was credited to the account and the account was noted as Settled in Full
On
February 25, the cardholder requested a letter stating the account had been
settled and was advised the letter would be mailed in approximately two weeks
so the payment has time to clear her bankThe cardholder then spoke with a
supervisor who offered the cardholder to submit proof the payment had cleared
her bank and the letter would then be expedited once the proof was receivedNo
proof was received from the cardholder that the payment cleared her account for
the Settled in Full letter to be expeditedThe letter was sent to the address
on record on March 12,

Merrick Bank (“Merrick”) is
in receipt of your letter dated February 10, regarding the complaint filed
with your office by Mr*** regarding a billing dispute
A review of the issue regarding
the request for a billing dispute on a purchase of services by Mr***
was
made. On October 13, Mr*** contacted Merrick by mail
regarding a dispute of charges by Menards for the sum of $that was
billed to his Merrick account on October 3, 2015. Mr*** explained
that he purchased carpet from Menards that was shorter than the dimensions he
had requested and could not be properly installedMr*** further
explained he was unable to resolve the matter with the store manager.
A letter was sent to Mr
*** on October 14, acknowledging his dispute and requesting
information needed to document a billing dispute. On November 5, a
response was received from Mr*** however it did not contain the
required informationOn November 23, a call was placed to Mr***
but we were unable to reach him, as a result, an additional letter was sent
requesting he contact us regarding his dispute. On December 8, the
case was closed as no further contact had been made by Mr***
Mr*** contacted the Bank
on December 14, and a request was submitted for him to be called back
Unfortunately, since the case had been closed, he was not called back
Upon receipt of the complaint,
the chargeback has been requested and a provisional credit has been issued to
Mr***’s accountA letter has been sent to Mr*** explaining the
provisional creditThe merchant will be afforded the opportunity to accept or
reject the chargebackThis process can take up to daysIf the merchant
does not respond within that timeframe, the provisional credit will become
permanentHowever, if the merchant refuses the chargeback, the transaction
will be rebilled to Mr***’s account

Ms*** opened an account with Merrick in December and had used the account for the purchase of goods and services. In October and November Ms*** did not make the minimum payment due which resulted in a past due payment report to the credit reporting agencies. The
account was paid in full on February 22, The credit reporting history of the account is maintained by the credit reporting agenciesGood credit information can remain on a file indefinitely; derogatory information can remain on a file for 7-years. Merrick is required under the Fair Credit Reporting Act (“FCRA”) to accurately report the status of accounts it reports to the credit bureaus. The various status’ reported on MsYoung’s account were and are accurate for that given point in time and Merrick will not remove or alter that information. To do so would be a violation of FCRA

Merrick has never received any such request from Mr***. Please have him forward his deployment orders and we can evaluate the request for SCRA benefits for this account

Mr*** opened an account with Merrick in August and has used the account for the purchase of goods and services. All of Mr***’s payments made on the account have been made online or via the Merrick Bank mobile app. Merrick has credited all of the payments received on
the date they were made. Mr*** has set up a recurring monthly payment online for the minimum payment due on his account. There have been no late payments or late fees on Mr***’s account

Ms*** opened an account with Merrick in January and has used the account for the purchase of goods and services. The due date on the account is the 20th of each month. Ms*** made a payment via the telephone voice response unit (“VRU”) on February 20, in the amount of
$at 11:pm. Ms*** cancelled that payment on February 21, at 9:05pmIt is Merrick’s policy and procedure to post all payments the same day that they are received until 5:00pm ET. For electronic payments, we allow payments to be made up until 11:pm ET on the customers due date to avoid a late fee, however, payments made after 5:pm are processed the following business day. In Ms***’ situation, had she not cancelled it, her payment would have timely posted as of February 20th because it was made before the cutoff time period. Ms*** cancelled the payment, therefore the late fee assessed to her account remained on the account. If she makes the payment currently due before the next payment is due, Merrick will waive the late fee that has been assessed to her account

Ms*** opened an account with Merrick in December She has used the account for the purchase of goods and servicesMerrick grants credit line increases automatically for accounts which qualify for those increasesMerrick does not offer or grant credit line increases on request
Ms***’s prior email was forwarded to the credit department for reviewThe letter she received was as a result of her request for a credit line increase in that prior emailThe information taken into consideration was her account performance with MerrickThe credit bureau review occurs on accounts periodically for the reason stated above and had nothing to do with Ms***’s request nor was it considered in the rejection of that request Regarding the error message received when attempting to make a payment online, the Bank occasionally experiences scheduled but temporary system outages to perform system updates and maintenance, and this may be what was occurring when Ms*** attempted to make her paymentI was unable to pinpoint the exact time that this occurred but as a courtesy Merrick has waived the late fee that Ms*** incurred on the payment she was attempting to makeShe should see this adjustment on her next account statement

Merrick has no other response to this issue. Statements were sent and the obligation to abide by the cardholder agreement is clear

I am rejecting this response because: Merrick Bank has now came up with another reason not to grant my wife and I this ReliefOn the phone when speaking with customer service, my wife was told there was no record of me being on the account at allThen she was told that she had to prove that we were married in order for it to apply She was given wrong fax numbers just to turn in the paperwork that you asked for In your first response, I was told the same thing That there was no record of me being on the account at all and you were not reporting to my credit report at all Then I responded letting you know that you were reporting to my credit report You replied in two sentences that you were not reporting to my credit report because I was never on this account and it would not apply to my wife Then I send you proof...proof that you are reporting to my credit report and now the records that you initially stated never ever had me listed on the account at all, now have me as an authorized user and it doesn't apply because I am now an authorized user on an account in which you said initially that I never existed Shame on you Instead of granting something that we were told by you that we would qualify for if I was on the account (not how I was on the account, but on the account), you have provided excuse after excuse that has been refuted I am extremely disappointed in the dishonesty and underhandedness that was displayed throughout this process To reduce this rate and restore our credit based on the back story I gave you...knowing what we are going through being a disabled vet, doesn't cost you a thing She let you know each time why we were late and she was simply told: "We will note the account" To make us go back and forth with you to refute the things you say as you uncover "new" information is dishearteningWe've done everything that you asked for multiple times...I don't know what else to sayWow.

Ms*** applied for a secured card on April 14, Following receipt of her deposit of $on May 4, 2018, the account was approved and opened. On May 3, Ms*** called Merrick to inquire about when she would receive the card associated with the accountThe representative
who spoke to her explained that the physical card can take up to weeks to be receivedMs*** requested the refund of the deposit during that phone call The process to produce the plastic card takes 2-days after approval of the account and the additional days are for mailing time to the account holderMost cards are received by the account holder within 7-days. A credit department representative spoke to Ms*** on May 8, and she agreed to accept the accountThe representative told Ms*** she would send the card express so that she could have it by Friday May 11, 2018. Ms*** received the tracking number for the delivery during that same callThe Fed Ex tracking showed that Ms*** signed and received her card on May 11,

Ms*** opened an account with Merrick in May and has used the account for the purchase of goods and services. The account was charged off in June 2016, as a result of multiple payments that were returned due to non-sufficient fundsMs*** did make four payments on the
account, but all four of those payments were returnedMs*** submitted her application to Merrick via the InternetIn accordance with the Electronic Signatures in Global and National Commerce (E-SIGN) Act, an electronically submitted signature, contract or other record relating to such transaction is valid and enforceable and may not be denied legal validity solely because an electronic signature or electronic record was used in its formationMerrick will send a full validation of debt to the address listed on the complaint for Ms***The Fair Credit Reporting Act requires that, as a furnisher of information to consumer reporting agencies, we report complete and accurate information regarding a consumer’s account historyWe have reviewed Ms***’s account and determined that the information reported to the consumer reporting agencies is complete and accurate as of the date(s) we furnished itWithout additional facts, we are therefore unable to change the reporting

Ms*** contacted Merrick in November regarding a disputed charge with MacysThe dispute was honored but the Merchant, Macys has the ability to re-present the charge if they disagree with the charge back submitted by Merrick. This was explained to Ms*** in November
and again on December 8th when she contacted Merrick. Macys had until the 10th to dispute the charge back and that when that date came her credit balance would be refunded to her. I requested that the refund be expedited and sent over night courier to her today. Attached is a copy of the check that was sent to her which she should receive tomorrow via express courier

A copy of the application submitted by you on the internet was provided with the original reply. Merrick has no further reply to this issue

*** *** opened an account with Merrick in April and has used the account for the purchase of goods and services. The account is currently over limit but not past due. The balance owing on the account is $as of the last statement. According to the account history
Merrick has received no request from Ms*** for a settlement on this account. Merrick does have many payment plans and settlement options to assist account holders during financial hardships. Mr*** opened an account with Merrick in January 2013. He has used the account for the purchase of goods and services since that time. I requested a review of Mr***’s account to determine if the account would qualify for a lower rate and it appears that the account has

A review of Ms***’s account was conducted. Ms*** informed Merrick that there were fraudulent charges to her account in December The total amount of those charges was $***. The account ending in *** was closed and a new account ending in *** was issuedThe fraud
claim was investigated and ultimately acceptedThe fraud charges were credited to the new account ending *** and an adjustment to the interest charges were also made.I have attached copies of statements showing the sequence of removal of the charges between the accounts. Ms*** has received full credit for the charges that she indicated she did not make. The fraud claim was closed upon credit being made to the new account. There is no other action for Merrick to make in this claim. If Ms*** needs additional assistance she can contact us at ###-###-#### and we will make every effort to assist her further

Merrick’s records show that Ms*** opened a credit card account with Merrick in October Ms*** used the account to purchase goods and services until it became delinquent in March and was charged off for nonpayment in September 2017. Merrick uses several different
collection agencies to collect on the accounts after charge off. Ms***’s account has been placed with an agency called True Accord. She can contact them at 866-211-to discuss the account and how to pay off the balance owing I have attached the last statement generated for the account for Ms***’s reference
