I am rejecting this response because:I still feel I was done wrong and not notified in a timely matter, and even when I was notified I paid the balance of fees in full IMMEDIATELY. Our entire payment history with this account has always been paid on time and in fullIts not like I am a customer that abuses our priveleges. This same situation has happed to other customers that have reported on Revdex.com as well, and they removed the delinquency from that parties creditSo why should I be treated differently? This is the only thing affecting our perfect credit and is now putting our family at risk of being homeless due to denials due to this delinquency

A review of Mr***’s account was conducted. Mr*** opened the account in February and has used the account for the purchase of goods and services. In August, Mr*** informed Merrick of the fraud on his account. An investigation into the fraud was
conducted. The merchant who was the subject of the alleged fraud was *** Car Rental. Mr*** explained to Merrick when the claim was opened that he had rented a car from ***, had returned it in a hurry and did not have a receipt showing that the car was returned. *** billed his Merrick account for additional time until they recovered the car and considered it returned. Mr*** could not supply any documentation to support that the card was returned on the date he claimed. Instead Mr*** filed a police report claiming identity theft against ***
*** agreed to issue a courtesy credit in the amount of $but Mr*** was not satisfied with that result. The credit from *** was never received for Mr***’s account so Merrick issued a charge back for that amount for the reason of “credit not processed.” The credit became final in September.
It is unclear where Mr***’s claim of a fraud balance or $results from. He has never made such a claim to MerrickTherefore we are unable to address that issue
I reviewed the calls recorded on Mr***’s account. None of the calls were harassing or argumentative. All of the calls were a result from Mr*** calling Merrick regarding his dispute with ***. All of the representatives attempted to explain that there was nothing else Merrick could to regarding this particular claim. Mr*** was not happy with that result. Mr*** claimed during the calls that the statements sent on the account, which are required by regulation were harassment as well as email notifications for his account where also harassment according to him
Mr*** has not made any payments on the account since July 2015. The last payment received was July 15, 2015. Merrick has not refused payment on the account.
Mr*** has used the account and the credit associated with it. He is obligated to pay the account balance that he legally owes. Merrick has followed the card brand rules and Bank policy in processing Mr***’s fraud claimHis only recourse now lies with *** if he still believes they owe him a credit on the account. Merrick has exhausted its ability to help further with this issue

A review of Mr***’s account was conducted. This review included the calls from September made on the account. Merrick apologizes that Mr*** did not have a positive customer service experience. On the second call it was clear that Mr*** was distressed by the
interaction with the customer service representative. The call appeared to have ended before the representative could complete an explanation about why account information could not be provided to his wife without a written request Merrick’s procedure is to request a power of attorney when the account owner is asking Merrick to allow someone other than themselves to assist with the account in some manner. This is to protect the account owners personal financial information from being obtained by someone who is not directly authorized by the account owner Ms*** explained that Mr*** had not received the EMV card that has been issued on the accountBased upon Mr***’s complaint Merrick has reissued the EMV card that had been previously sent to him. We have closed the old account and reissued the card under a new account number. Merrick has sent this new card to Mr*** at the address of record via Fed Ex and he should receive it in 2-days Mr*** can add his wife as an authorized user to the account or he can send us a letter signed and notarized by Mr***, stating that his wife is authorized to obtain information and make payments on the account. Merrick takes account holder complaints very seriously. We apologize again that Mr*** did not have a positive experience when he contacted us
Mr*** opened an account with Merrick in May, 2012. Mr***’s account has had a zero balance and there has been no activity for a year or more. Merrick’s decision to close the account was based upon the inactivity of the account and no other reasonThe cardholder agreement between
Mr*** and Merrick allows either party to close the account at any time, and allows Merrick to do so for any reason without prior notice. Merrick will not reopen ***’s account
Ms*** opened an account with Merrick in July 2015. She has used the account for the purchase of goods and servicesOn April 15, Ms*** contacted Merrick to dispute some charges on her account. After receiving information regarding the charges in question Merrick issued a

A review of the account has been conducted. It is Merrick’s procedure to review accounts
and automatically give credit line increases to those accounts which
qualify. One of the criteria that
Merrick is required to consider is the “ability to pay”This means that we
look at the
account performance here at Merrick along with credit bureau data, and
the debt to income ratio for the accounts being reviewed
If the accounts being reviewed meet that criteria review and
the other factors considered Merrick will automatically give a credit line
increase in varying amounts to those accounts.
If an account does not meet the criteria review then those account will
be re-considered in a later reviewThe timing of those reviews is usually
every quarter or no later than yearly for every account
In Mr***’s case his account has not met the criteria
reviewed for a credit line increase.
This does not mean he won’t get one in the future, but it will depend on
the factors being considered
Merrick does not give “on demand” credit line increasesMr
*** will be notified by email or regular mail if or when the account has been
given an increase

When Mr*** called Merrick on September 25, and requested a fee waiver for the returned payment fee the representative explained that they would make the request but that they could not guarantee it would be waived. The request was declined and the fee remained on the accountOn
November 1, Mr*** called back the representative explained they would again request that the fee be waived. According to the account notes the $fee was waived on November 2, 2016. Mr*** should see this adjustment on his next statement

of June and the July payment was received after the due dateThe credit reporting for the account is correct and accurate according to the history of the account. Merrick will not delete or change the reporting for the account. To do so would be a violation of the Fair Credit Reporting Act and the Bank’s policyThere have been no issues with the Bank’s payment website in the last months

I am rejecting this response because: This additional fee was NOT explained to me or else I would have never used the cash advance I have numerous other credit cards with outstanding credit ratings on each of them I have since making this complaint "cut up" the card from this company Obviously I'll never use Merchant Bank's card again to make any more charges I'll continue to make payments until this card is paid in full but again I reiterate that to be charged a higher rate of interest and fees until there's a balance is highway robbery and I won't do business with them or anyone like them going forwardJust another way for them to rob their clients of their hard earned money It should be illegal for them to subject people to such high interest rates and then on top of that find another way of ripping off the consumer

A review of Mr***’s account was conducted. Mr*** opened an account with Merrick in May and has used the account for the purchase of goods and services. The due date on the account is the 18th of each month. Merrick received the June payment on the 19th and Mr*** was
assessed a late fee. A representative who assisted Mr*** when he called on June 22nd, waived that late feeThe statement dated June 23, shows that the fee was waivedA fee waiver does not reduce the minimum payment due for the month in which the fee is assessedIt will reduce the following month’s minimum paymentMr*** made a payment for less than the minimum payment due in JulySubsequently that payment was returned unpaid by Mr***’s bank. An additional late fee was assessed to the account because of the returned payment The retuned payment from July is the reason for the increase in the minimum payment due. The payment due for August is $This amount will need to be remitted by August 18th in order to avoid any additional late fees
Mr*** agreed to the fees when he opened and used the account. Merrick has waived the fee and there is no other action available for this account

because: I hoped that we could reach a reasonable agreementBut I see that you all feel you can justify a predatory practice by cutting and pasting statements that dont comply with law How can I be late or default on a debt if I never received a bill? I paid my account in full and had no intention on using this high interest credit card any further. Yes, I have moved over the years but my email address and phone number have remained the sameI have had my mail forwarded each time I moved and have not had trouble getting statements. I regret that I was unaware of the monthly fee or that Norton Anti-virus had authorized a charge on my account. However, you have an obligation to send me a bill for my debtYou have continued to report this credit line to to the credit bureau for many years as a charge off; you have an obligation to send notice of such reportingYou have reported for years without a call, email, or statementI have never heard of a debt going to collection without the creditor calling to collect the debtBut your intentions were not to make me aware of the debt but to ruin my credit quietly until I noticed and then attempt to collect the debt without exerting any effortThis is as predatory and illegalAnd honestly its just unnecessaryI would have been happy to pay the debt. I have made a very reasonable request that in exchange for payment of a bill that I was never supplied that you correct my credit report to reflect no late payments after my account was paid in full. It cost you nothing to do thisI dont have a history of late payments with you all or anyone else for that matter that would be lost if this account was deleted. I have filed complaints with the attorney general for your state, the Consumer Financial Protection Agency, as well as the Utah Department of Financial InstitutionsI have cc'd MsEva Rees who is the Supervisor of Consumer Credit and Compliance for the Utah Department of Financial Institutions because I would like her to see Merrick Banks response I hope you will escalate my complaint to your company leadership
