Ms. [redacted] opened an account with Merrick in June 2015 and has used the account for the purchase of goods and services. The due date on the account is the 28th of each month.  Ms. [redacted] contacted Merrick on August 26, 2017 regarding a payment she indicated she mailed on August 11, 2017. ...

The notes on the account indicate that the representative who spoke to her told her Merrick had not received that payment as of that date.  When I reviewed the account on September 1, 2017 Merrick had still not received that payment via the USPS. Once that payment is received, Merrick will post it to her account and Ms. [redacted] can contact Merrick after the payment is posted and request a late fee waiver.   Merrick is obligated by law to post payments when it receives them (not when they are sent), and it is Merrick’s policy and practice to post payments to accounts as of the date they are received. Merrick has found that the US Postal Service is frequently slower than our cardholders expect when delivering payments to our processing center. Merrick performs recurring periodic audits of our payment processor and these audits have shown that delivery times by the USPS vary significantly and unpredictably.   In addition to making payments via regular mail, please know that Merrick Bank offers the following payment options free of charge which may be beneficial to you.  You may schedule one-time or recurring payments at no cost to you 24 hours a day, 7 days per week:   ·         Phone – Call 1-800-253-2322 to make a payment through our automated system ·         Online – visit www.merrickbank.com/cardholdercenter to make a one-time payment or setup recurring payments   You can also have payments expedited by using the following options. As stated.  there is no payment after charge off so Mr. [redacted] will need to submit proof of that payment.  I have provided the Merrick fax number for that proof.

A review of Ms. [redacted]’s account was conducted.  Ms. [redacted] expressed concern over the retention of the payment information when she has made a payment via the automated phone system.  Merrick retains this information as a courtesy to the account holders. This is done so that if the...

account holder does not have their banking account information available the system will tell the caller the bank name and the account ending information.  If the account holder enters new information the previously retained information is deleted and replaced with the new information.   The statements sent to account holders do contain the full account numbers.  However there is no other account identifying information such as the security code or the expiration date on the statements. These and other pieces of information would be necessary for anyone to use the account without authorization from the account holder.  If Ms. [redacted] is concerned about receiving physical paper statements she can sign up for paperless statements and those will be available for her to view on the cardholder website whenever she wishes.  If Ms. [redacted] were to suspect any unauthorized activity on her account she should contact us right away so that we can investigate any issue and help get it resolved quickly.  If Ms. [redacted] needs assistance with the cardholder website or signing up for paperless statements she can contact us at 800-253-2322 for help.

Mr. [redacted] opened an account from Merrick in May 2013.  He used the account for the purchase of goods and services.  The account became delinquent and subsequently was charged-off in February 2014.  Mr. [redacted] agreed to pay $[redacted] on the account balance of $[redacted].  Merrick...

received and posted that to the account in March, 2014.  The account status was updated to settled for less than the full balance was a charge off.  This is the reporting on the account today. Merrick does not accept payment for credit bureau deletions.
The history of the account is maintained by the credit reporting agencies.  Good credit information can remain on a file indefinitely; derogatory information can remain on a file for 7-11 years. 
Merrick is required under the Fair Credit Reporting Act (“FCRA”) to accurately report the status of accounts it reports to the credit bureaus.  The various status’ reported on Mr. [redacted]’s account were and are accurate for that given point in time and Merrick will not remove or alter that information.  To do so would be a violation of FCRA and Bank policy.   I have enclosed a copy of what is being reported to all three bureaus for Mr. [redacted]’s information.

Ms. [redacted] opened a Visa credit card account with Merrick in December 2014.  In accordance with the Cardholder Agreement, Ms. [redacted] agreed to pay the Annual Fee(s) each year the account is open with an outstanding balance. If the account is closed with an outstanding balance, Merrick will...

charge the Annual Fee each month there is an outstanding balance.   Section 7 also addresses interest accrual and states:   7. How to Avoid Paying Interest on New Purchases. You will not be charged interest on new Purchases during a Billing Cycle if you paid the entire New Balance, if any, shown on the Billing Statement on or before the Payment Due Date   If Ms. [redacted] does not wish to pay fees or interest on the account she may pay the balance in full to avoid those assessments to the account.  If she cannot pay the balance in full at this time, she can continue to pay off the balance monthly under the terms and conditions of the cardholder agreement.

I am rejecting this response because I made it VERY clear to the rep the reason I was calling was to make sure the payment would go thru due to my bank notifying me about the account being frozen!!!! Good to know what type of company this is going forward though.

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me in the credit of $80 credit back to my account, I do disagree with their findings as I did supply sufficient information to charge back as I did with one of their competitors with no problems. Nonetheless, I will await my next statement to see the credit reflected back to my account, if not I will be back in contact for their failure to follow-up with the proposed settlement.

Ms. [redacted] opened an account in May 2016 and has used the account for the purchase of goods and services. The payments on the account are due on the 14th of each month. The most recent payment received and credited to the account on December 14, 2017 and no interest is charged on the paid amount...

after that date. However, the corresponding credit line is not immediately available because Ms. [redacted]’s previous payment was returned unpaid. Because of the previous returned payment, Merrick’s policy is to delay opening up the credit line for several days to mitigate the risk that the current payment may be returned unpaid.   Under Section 10 of the cardholder agreement titled “About the Credit Limits on the Account” it states as follows:   We may in our sole discretion decline to permit use of a portion of the credit limit equal to the amount of the payment or credit for up to 11 days from the date posted. This delay in increasing your available credit will not affect the proper crediting of your payment or credit to Purchase, Cash Advances, and finance charges, and will not alter the calculation of finance charges.   The additional credit will be available to Ms. [redacted] on or before December 20, 2017.

A review of Ms. B[redacted]’s account was conducted.  Ms. B[redacted] informed Merrick that her card for the account was misplaced on June 17, 2015.  Merrick closed that account and re-opened a new one for her.  When this occurs on an account the old account history is moved to the new...

account number but that takes approximately 1-3 business days for the internal process to be completed and the information to be sent to the credit reporting agencies.  During that period of time neither account shows any history. 
 
A new card was sent to her and she received and activated it on or about the 20th of June.  Ms. B[redacted] called Merrick regarding the missing credit reporting on July 6, 2015.  In the normal course of business the account is reporting to the credit reporting agencies on the cycle date, which for Ms. B[redacted]’s account is the 16th or 17th of the month.  In cases where the card is lost or stolen and a new account established the reporting is sent out when the new account is activated or within 2 business days of that activation.  When Ms. B[redacted] called on the 6th the new account reporting had been sent to the credit bureaus and then it was sent again on the 7th after she called.  This is the reason that the current month reported early. Once the statement for the account cycles everything for that period of time gets reported.
 
How and why the credit reporting agencies show the information provided to them by Merrick is not something Merrick has control over.  Once the information gets sent the different reporting agencies show the information sent to them in different formats. 
 
Merrick is reporting the status of the account accurately when the report is submitted to the agencies.  The information is taken directly from the account and submitted to the credit reporting agencies.  Merrick is required to do so by bank policy and the FCRA.
 
I have attached copies of what is being reported along with statements reviewed for this reply.

I am rejecting this response because:The response is simply inaccurate.  According to the FCRA ACT 609, if you do NO have a Consumer Contract signed by me, then you do NO have permission to report to the credit bureaus.  And Merrick Bank, you do NOT have a Consumer Contract with my signature on it.  So, what you are doing is AGAINST the FCRA ACT 609, which is Federal Law.  According to the FCRA, since you are refusing to remove the reporting, I can file a complaint with my States Attorney Generals Office as well as the Federal Trade Commission due to your negligence.  Remove the reporting ASAP, or I will file complaints.

A review of Ms. [redacted]'s account was made.  Ms. [redacted] opened an account with Merrick in January 2015 and used the account for the purchase of goods and services.  Ms. [redacted] stopped making payments on the account in September 2014.  Prior to that time she had made sporadic payments on the...

account.  The last payment received on the account was for $75 received and posted to the account on September 11, 2014.  The account was charged off for non payment in March 2015.  If Ms. [redacted] would like to discuss payment or settlement options for this account she can contact us at ###-###-####.  The representative there can discuss what options are available for Ms. [redacted] to settle this debt. I have attached copies of statements reviewed for this reply.

Merrick’s records show that Ms. [redacted] opened a credit card account with Merrick on [date]. Ms. [redacted] used the account to purchase goods and services until it became delinquent August 2015. The date of first delinquency determines how long an account will be reported by the consumer reporting...

agencies. Derogatory reports can remain on a file at the consumer reporting agencies for 7-11 years after the date of first delinquency.  Merrick has responded to several disputes Ms. [redacted] submitted through the consumer reporting agencies. The status of the account as reported is correct and accurate according to Merrick’s records and will not be deleted or modified. To do so would be a violation of the Fair Credit Reporting Act. I have attached redacted copies of the application and statements for the account.

Mr. [redacted] agreed to this fee and the way it is charged when he opened the account.  As stated he can choose to keep the card and the fees associated with it or close it and pay off the balance.
