Mr. [redacted] opened an account with Merrick in August 2012 and has used the account for the purchase of goods and services. The due date on the account is the 5th of each month. According to the account history Mr. [redacted] signed up for recurring payments on May 12, 2017. Prior to that...
date he had made one time online payments via the cardholder website. The payments that were due for April 5 and May 5, 2017 were not received by the due date. This caused the account to incur late fees and a 30 day past due report was sent to the credit reporting agencies. Once the payments were made, the fees associated with those late payments were waived as a courtesy. However, according to the account history the credit reporting is correct and accurate. Merrick will not change or remove that report as the Bank is required to accurately report on it accounts.
As stated Ms. [redacted] can have the account removed if she send in the requested information.
If Ms. [redacted] would like to attach a copy of the letter she says she previously sent I can investigate what occurred with that correspondence. Otherwise, Merrick has no further response to this issue.
Merrick Bank cannot find any account under Mr. [redacted]'s name as the owner or authorized user. Mr. [redacted] will need to provide an account number and the name of the account holder for further research. Merrick's records do not indicate any credit reporting being submitted under...

Merrick does not give on demand credits or credit line increases. We apologize that you felt you did not receive the kind of service you expected.
Merrick has replied to this issue with all of the information available in the account history and through the audits it has conducted on the mail delivery at the Dallas location. There is no further information or reply that Merrick has to this matter. We have accommodated the request for the late fee waiver and provided alternate methods to make payments.
A review of Mr. [redacted]’s account was conducted. Merrick sent Mr. [redacted]’s a “pre-screened offer for an account and he accepted that account in June 2015. The on line transaction dispute process that Mr. [redacted] speaks about in the complaint has never been available. This was a process...
that was in the development stages and should not have appeared on Merrick’s website until fully completed. This occurred through an internal error. Merrick apologizes to Mr. [redacted] if this process was a deciding factor in his acceptance of the offer of credit. Unfortunately it is not available and will not be available for some time to come.
Merrick does not offer compensation for such issues as this. If Mr. [redacted] is dis-satisfied with the account or any of the aspects of the account with Merrick he can contact customer service and close the account and pay the balance. Ms. [redacted] opened an account with Merrick in October 2014 and has used the account for the purchase of goods and services. On January 19, 2017 Merrick received a request from Ms. [redacted]’s debt management company to include the Merrick account in the payment plan she had initiated with...
them. Merrick agreed to do so. On March 20, 2017 Ms. [redacted] contacted Merrick and explained that the debt management company had included the Merrick account in error. The representative explained to her that the company would need to send Merrick a “drop letter” on their letterhead before Merrick would consider reinstating the account. Ms. [redacted] was given the fax number to have the debt management company send the letter. Merrick has not received that letter from Ms. [redacted]’s debt management company. The due date on Ms. [redacted]’s account in the 23rd of each month. Payments received on the account were all made online via Merrick’s cardholder website. Payments made online via Merrick’s cardholder website before 12am ET are posted as of the date they are received. Ms. [redacted] made payments past the due date for the months of January 2016, June 2016 and August 2016. Merrick has waived one late fee in the amount of $37.00 as a courtesy. Ms. [redacted] should see this on her next statement. Once Ms. [redacted]’s debt management company sends Merrick the letter requested, Merrick will consider reinstatement of the account.

I am rejecting this response because: Merrick is lying. On all Agency Reports the credit card is shown as open! And Merrick has repeatedly marked as missed payments. Its not my responsibility to have to reach out to Merrick to try and work out what is going on. Further more, Merrick did not make any efforts to contact me. I can not log into an account or access anyone at Merrick to confirm anything. I am willing to make a settlement payment if Merrick corrects all agencies and restores the fact that I have not missed any payments between July 2014 and now.

I am rejecting this response because:Yes they made offers but never followed through on their end. I have called numerous times and the last time they said they had no idea what I was talking about. According to my records with all the late fees they were suppose to reverse due to the offers and having problems making payments to them I owe nothing. The slkast payment of 140 should of been it. I am out of town and can't get on to make another payment to make it look good even though I don't owe anything. All late fees need to be reversed then we can go from there. Not my fault their system fails and even when I call they give you a hard time do t know what you are saying because most of the time they don't speak English. I can't help that. Also I have called numerous times for a card. And nothing. I don't want it shut off because that lowers your credit. I mean look I haven't had a card I'm trying to pay it off but they failed to follow through. I feel it's fair to still have all charges revered late fees due to them not following through and go from there. Not my fault and I shouldnt be penalized once again.

Mr. [redacted]’s dispute was received on 03/01/17. The dispute was for $300.00 of the $805.29 posted on 02/26/17. Merrick sent a letter to Mr. [redacted] on 03/01/17 to acknowledge receipt of his dispute. Merrick requested a copy of the sales draft from the merchant on 03/07/17 and also...
submitted a chargeback in the amount of $300 to the merchant’s bank. Merrick sent another letter to Mr. [redacted] on 03/08/17 to request additional information about his disputed charge. We did not receive a response to the 03/08/17 letter. The merchant, Thrifty Car Rental, has reported to Merrick that it billed Mr. [redacted] a $300.00 cleaning fee under the terms of its rental agreement with Mr. [redacted]. We placed a call Mr. [redacted] on 03/23/17 to explain the results of our investigation but did not make direct contact. We sent a third letter to Mr. [redacted] to request he call us regarding his dispute. The merchant’s bank accepted our chargeback and Merrick issued a permanent credit to Mr. [redacted] and informed Mr. [redacted] of this via a letter to Mr. [redacted] on 05/08/17.

I am rejecting this response because:This is false. I have yet to see a contract from your company that states that I have a contract with your company. Once again, I am asking for the CURRENT contract I have with your company with my name on it. If you cannot provide this information you MUST delete this information from my credit reports immediately as I have no legal binding contract with your company.

The payment was late, not received until 11-7-15 when it was due on 10-23-15, that is why there was a late fee, the fee was waived as a courtesy and not because of the payment being made. There was no payment received for the November payment as of the December statement cycle, that is why there was a late fee on the December statement. The statements show the facts of this matter and should be reviewed by Mr. [redacted]

The account records indicate that the last four payments made on the account were made using US Postal Service money orders and received via the US Postal Service. All four...
payments were posted to the account as of the date they were received from the US Postal Service. Ms. [redacted] also made one on-line payment during the past four months. Ms. [redacted]’s account has received one late fee since the account was opened in October 2015. There have been no other late fees assessed to the account. Ms. [redacted] indicates in her complaint that she transferred the balance on her Merrick account to another lender. However, Merrick has never received a payment on the account from anyone but Ms. [redacted]. If she did initiate a balance transfer she may wish to contact the company with whom she initiated that transaction to investigate whether it has remitted payment to Merrick for the account balance. If it has, Ms. [redacted] can request a copy of the payment sent to Merrick. Once Merrick has that information from Ms. [redacted], we can research the payment to assure it was applied properly. It is Merrick’s policy and practice to post payments to accounts as of the date they are received. Payments received via USPS by 5pm CT and online payments received by 12am ET will be posted as of the date they are received.
Ms. [redacted] opened a Visa credit card account with Merrick in July 2015. The marketing materials she received disclosed the annual fee. Shortly after Ms. [redacted]’s application was approved, Merrick forwarded Ms. [redacted] the credit card plastic and a copy of the cardholder agreement (including a...
pricing appendix which discloses the fees applicable to the account). The pricing appendix, like the marketing materials, disclosed the assessment of the annual fee. The first year annual fee is assessed to the account in one lump sum and each following year the annual fee is assessed monthly at the sum of $3.00. Ms. [redacted] closed her account in [month, year]. In accordance with the Cardholder Agreement, Ms. [redacted] agreed to pay the Annual Fee(s) for each year the account is open and for each year in which there is an outstanding balance on the account. When Ms. [redacted] closed the account, there was an outstanding balance. Nevertheless, as a courtesy Merrick has waived the $3.00 annual fee assessed to the account prior to Ms. [redacted] closing the account.
A review of Mr. [redacted]’s account was conducted. Mr. [redacted] opened an account with Merrick in March 2016. The payment that was returned was the first payment made on the account. The rejection by Mr. [redacted]’s bank for the payment made on April 25, 2016 for [redacted] was retuned...
on April 26, 2016. The return code on the rejection is [redacted] which means “Invalid Account Number”. This was the code placed on the return by his bank [redacted]. Because the payment was returned there was a returned item fee of [redacted] assessed to the account. The payment was made online but any return of a payment whether online or by any other means that is rejected for payment the account will incur a returned item fee. The fee will not be waived for this reason. When Mr. [redacted] opened the account he was provided a pricing appendix. He agreed to pay the fees including returned item/check fees that are associated with the account as shown in the pricing appendix.
Ms. [redacted] accepted an offer of a Visa credit card from Merrick in January, 2015. Her payment due date is the 27th of each month. The statements for her account cycle on the 2th or the 3th of the month. Ms. [redacted] has paid in advance of the statement cycle for May, 2015.

no pre-payments on revolving accounts any payments received prior to the statement cycle date will be applied to the most recent statement. In this case the payments have been applied as an extra principal payment for the prior months’ cycle.
The statement cycling and due date of the account are standard industry practice for a revolving account and are in compliance with the CARD Act.
The cardholder agreement under Section 4 indicates the following;
…you must pay at least the Minimum payment shown on the Billing statement by the Payment Due Date. Even if you pay more than the Minimum payment in one Billing Cycle, you still must pay the full Minimum Payment in future Billing Cycles…
Because of the manner in which Ms. [redacted] made the April/May payment she received a late fee for April because the payment was received after the 27th and one for May because she made the payment on the cycle date for that month which was the 2nd.
Merrick has as a courtesy waived the two late fees on the account in the amount of $65.00. We have also “re-aged” the account so that now it is due for June 27th payment and that amount is $35.00. Ms. [redacted] will need to make that payment on or before the 27th of June to avoid another late fee being assessed to the account. Ms. [redacted] will see the adjustments described on her next statement.
California has a state law that requires a notice, but even in those instances Merrick still closes the account and we do not reopen them. The reply sent is the final reply.
You opened an account with Merrick in July 2014. You have used the account for the purchase of goods and services. The payments received on your account on May 23, 2017 and May 26, 2017 in the amounts of $200 and $300 respectively were retuned unpaid by Key Bank. The payments received...
on your account on June 23, 2017 and July 25, 2017 in the amounts of $1000 and $500 respectively were also returned unpaid by Key Bank. These returned payments constitute a risk to Merrick and that is the reason your account was charged off on July 28, 2017. The credit reporting on the account is correct and accurate according to the account history and Merrick will not change or delete that information. To do so would be a violation of the Fair Credit Reporting Act and Bank policy.
