I am rejecting this response because: The representative did not say apr was not available on demand she said they never reduce apr percentage she also said they do not evaluate accounts. Customers will have to continue to have high percentage and pay an annual fee regardless of credit. She was also rude and said "well you used it and it helps you right." Terrible customer service.

I do not show a hold on the new account number.  if Mr. [redacted] is experiencing some kind of difficulty he can contact us at ###-###-#### and a representative can help him.  The process of investigating a potential fraud claim is required under the Visa and MasterCard rules and the policy of the Bank.  Normally the process only takes a few days. Mr. [redacted] will be notified as soon as possible.

Merrick Bank's response is a lie.  Merrick Bank was notified via Postal Service about the fraudulent overcharges from [redacted] and they received a copy of my Theft Affidavit, FTC Complaint and Police Report. This was mailed to Monique F[redacted] Paralegal at Merrick Bank Corporation in Utah and faxed to customer service (New York). Merrick Bank chooses to omit these complaints as they are not compliant with Lawful and Federal Banking Regulations concerning credit card theft. They have maliciously been uncooperative in the legal law that as a consumer I am not responsible for fraudulent charges of over $500 including Merrick Bank's insulting and greedy fees on this theft account. My $550 (limit) secured credit card account was closed and Merrick Bank retained my $550.00 security deposit September 2015.  Merrick Bank is fooling themselves if they think they will ever received a penny from me concerning their abusive illegal banking practices.  And Merrick Bank is further dishonest my last payment was not July 2015 it was December 2015 (see exhibit mailed to Revdex.com).  Merrick Bank omitted their incoming calls to my home from its nasty customer service center that I copied for the Police, Merrick Bank's claim of non-threats and harassment against me is a "likely" response due to the fact that I have legal recourse in a Court of Law.  The Minnesota State Attorney General "NOT Merrick Bank"  contacted [redacted] pertaining to a return of some of my money stolen from me $40.88 (see exhibit mailed to Revdex.com) letter dated October 20, 2015 and letter dated November 3, 2015 from Minnesota Attorney General.  From July to December 2015 and to date in January 2016 Merrick Bank have maliciously refused to credit / chargeback any money relating to this matter. [redacted] was never authorized to make fraudulent charges to my credit card.  Merrick Bank and its illegal $590.00 theft account it wants me to pay was given over to the Minneapolis, MN Police Department in that I'm not responsible to pay.  I further state that I do not accept the response from Merrick Bank.

Mr. [redacted] opened an account with Merrick in May 2014 but the account has had a zero balance and no activity for a year or more.  Merrick’s decision to close the account was based upon the inactivity of the account and no other reason.  The cardholder agreement between Mr. [redacted] and...

Merrick allows either party to close the account at any time, and allows Merrick to do so for any reason without prior notice. Merrick reported the account as “closed by credit grantor”, which is the correct reporting on the account.

Mr. [redacted] opened an account
with Merrick in April 2008 and has used the account for the purchase of goods
and services.  As Mr. [redacted] previously mentioned, the payments on the
account are due on the 16th of each month.  A payment of
$[redacted] was received on February 29, 2016 and...

was applied to the account the
date it was received. An additional payment of $[redacted] was also received and
subsequently returned due to the stop payment placed on the account with the
cardholder’s bank. Because of the financial risk related to returned checks, an
authorization hold was placed on the account.  This was in adherence to
Bank policy.
We apologize to Mr. [redacted] for
the inconvenience this situation caused. It was clear that he was acting in
good faith to make a payment on his account. As of the time of this response,
the hold has expired, the Late Fee from February and the Returned Check Fee
have both been refunded to Mr. [redacted].

I am rejecting this response because:I have been a customer for more than 3 years. I started with a blank credit score. You have increased my credit on the account multiple times because I have now established a good credit score. Your APR is stated as "variable", but I have not seen it vary from 25% at all in more than 3 years. Why would I accept your claim of a resolution where you do not honor your customer? This is crooked business at it's best right here with Merrick!

Ms. [redacted] was sent a solicitation via regular US mail for an account in October 2015 which was a “firm offer of credit.”  The offer included a disclosure regarding the amount of credit being offered and the fees that would be charged on the account.  The solicitation disclosed that there...

would be a $75.00 set up fee and an annual fee of $48. 
Ms. [redacted] responded to the offer by returning the Acceptance Certificate.  Merrick received the Acceptance Certificate and opened the account on October 15, 2015.  At the time she received the card a pricing appendix was also sent outlining the fees and costs associated with the account.   The card carrier sent with the plastic had a disclosure that indicated how to opt out of the fees associated with the account.
I have requested that the account be closed and the fees waived. Any credit reporting that may have occurred will also be deleted.
I have enclosed an example of a card carrier with the additional disclosure about the fees and how to reject them, a copy of the Acceptance Certificate submitted by Ms. [redacted] for the account.

Merrick apologizes that Mr. [redacted] did not receive the kind of interaction with the supervisor he expected.  The explanation regarding how the payments are applied is correct and according to the terms and conditions disclosed when the account was opened.  As stated if Mr. [redacted] needs payment assistance he will need to contact customer service to facilitate that process.

I apologize, Mr. [redacted] is correct his last payment in the amount of $39.00 was received and posted to his account on December 13, 2015.  Mr. [redacted]'s account is still open, but it is blocked because of the issues regarding the [redacted] matter and the fact that he has not been making the full minimum payment due on the account.  The security deposit on the account will be used to off set the account if there is still a balance owing at the time the account is closed.  This is part of the agreement between Mr. [redacted] and Merrick and is disclosed in the cardholder agreement at section 16 of that agreement.  Merrick is fully compliant with all of the laws and regulations that govern its activities and has followed all of those that are applicable to Mr. [redacted]'s issue.

[redacted] was the authorized user on an account under the name of [redacted] who according to the application was her husband. He added her as the authorized user at the time the application was submitted and she was removed upon receipt of this complaint.   Merrick has made a request to delete the trade line under Ms. [redacted] name as the authorized user on the account.   This request can take up to 30 days for the credit reporting agencies to process. Ms. [redacted] will want to check her report after that time to confirm the request has been processed.

After reviewing Ms. [redacted]’s
account, I was able to determine the final payment posted to the account on
March 16, 2016. The account is now at a zero balance. As a courtesy, Merrick
Bank has refunded the $3.00 fee. This fee will be mailed to the address on file

I am rejecting this response because: Merrick never gave me an opportunity to present another form of payment tp correct thos NSF. Instead they immediately close the account without notice and charge it off cause due stress toy credit ratings. In addition, Merrick never have sent any correspondence by email to me.  If, they have I would love proof of these correspondence. Secondly, I called them to pay on my account a day after it being close and instead of them working with me to bring the account in good standings once again, the rather close it to try and triple their money to recover the debt as their collections are in-house.  I have paid this account to zero before and I was planning to do the same the 1st of the year as I just started a new job on the 1st of December. This is why the money wasn't in my account because my direct deposit stop and I forgot I had this schedule.Merrick should want to treat their customers witb a bit more compassion and respect.

A review of Ms. [redacted] account was conducted.  The account was opened in June 2015 and has been used for the purchase of goods and services.  The payments for the account have been made on time with the exception of the December 2015 payment. The payment due on the 18th of December was not...

received until the 29th of December.  If Ms. [redacted] contends that she made a payment for December prior to the one received and posted to the account on the 29th she can send Merrick a copy of the cashed payment or proof of that payment from her bank.  Merrick will investigate the payment posting and correct any mis-posting that may have occurred.  Please have her send proof of payment to our fax number at ###-###-####.  I have attached copies of statements for the account for her review.

The annual fee is assessed to the account for each month the account is open and/or had a balance owing if it were closed.   The balance of the account accrued interest at $1.00 in April when the account was closed.  Mr. [redacted] received notices of his paperless statements for the account at the same email address he received them since the opening of the account, [redacted].  On June 26, 2016 Merrick waived the balance owing on the account in the amount of $12.00 as a courtesy.   Merrick understands Mr. [redacted]’s concerns regarding the credit reporting on the account.  In order to address his concerns Merrick has deleted the trade line for the account from his credit file.  Tell us why here...

phone number provided to us by the account holder until contact is made.  Contact is made when an account holder speaks to an representative about the account status.   If Ms. [redacted] is having financial difficulties and needs some payment assistance Merrick has many payment plans available.  She can contact us at ###-###-#### to discuss those payment plans and which ones may fit her situation.  The temporary do not contact flag will be removed n 90 days.

Ms. [redacted] opened an account with Merrick in July 2017 and has used the account for the purchase of goods and services. The due date on the account is the 27th of each month. All of the payments made on the account were credited on the day they were received. In the months of August through...

December the payments were received after the due date. Late fees for August and September were waived as a courtesy when Ms. [redacted] called and requested they be waived.     Merrick is obligated by law to post payments when it receives them (not when they are sent), and it is Merrick’s policy and practice to post payments to accounts as of the date they are received. Merrick has found that the US Postal Service is frequently slower than our cardholders expect when delivering payments to our processing center. The solicitation received by Ms. [redacted] was a firm offer of credit contingent upon the applicant continuing to meet the criteria as obtained in the pre-screen prior to the offer being sent. Ms. [redacted]’ application was denied because her FICO score was significantly less than the score at...

prescreening, among other reasons.   The pre-screen process takes place two months prior to the offer of credit.  The application allows Merrick to obtain a full credit report once it is received.  The offer of credit is contingent upon the applicant meeting the criteria that was in place at the time the pre-screen was conducted.  Because of the issue noted above Ms. [redacted] application was declined.   Merrick will not issue an account to Ms. [redacted] as she does not meet the criteria for an account. Merrick will not remove the inquiry made on her credit file. Merrick had permissible purpose to review her full credit file when she submitted the application. Merrick has replied to this account accurately.  Merrick audits the USPS process to the lockbox location and those audits have shown that the postal service is very slow and unpredictable.  That is why we offer alternative methods of making payments.  Merrick will not modify or remove the credit reporting as it is accurate and correct as required by the FCRA.

The account was 4 payments past due at the time the account was placed on the payment plan.  At the time the account was placed in the program, Merrick sent a letter to Ms. [redacted] explaining how the payment program works.  During the course of the payment plan there were late and missing payments. Because the account payments were not made per the agreement the account was charged off in December 2016.   Merrick has no relationship with Family Credit Management, nor does Merrick have any information as to what disclosures were made by Family Credit Management to Ms. [redacted] regarding how the payments were to be processed or what the timing of those payments would be.  Merrick processed all of the payments on the date they were received by Merrick.   The credit reporting provided to the reporting agencies is correct and accurate according to the account history and will not be removed or modified.  This would be a violation of FCRA and Bank policy.
