I asked until Monday to come up with a reosolution for the inconvenience. I was not even give that opportunity, which is understandable considering the situation. However, we do not do bait and switch. This is a dealership that operates on a first come first serve basis like every other store in NJ....
We offered severeal vehicle at or BELOW the price listed for the car sold. We offered to purchase an identical car and show our cost without any mark up to make up for the inconvenience. I understand the frustration the customer faced, however, whatever we attempted to do to remedy the situation, we got shut down quickly. We really wanted to work with the buyers to make up for this headache, but it's a two way street and obivously we were not given the chance to redeem ourselves. Best of luck in your future endavors.

I am rejecting this response because: Auto holding Inc has not returned calls from the Mercedes dealership or I. Also, the car has been repaired by the Mercedes dealership and paid for by me because of the no return calls by Auto Holding Inc... There are other issue with the vehicle as stated previously and I can’t afford to not have a vehicle to get back and forth to work. PLEASE refund my money ASAP!
Regards,

While there are two sides to every story, getting in to detail on the matter would not account for any winners in the situation. We have issued the requested refund as well as additional compensation for the inconvenience caused in the matter. We apologize for the day several factors were addressed...
in this sale and hope that the customer has nothing but a positive experience moving forward with the car they have purchased. The refund as well as additional compensation funds are en route. Sincerely, Gene

I am rejecting this response because:The vehicle was not in flawless condition because when I tried to get it inspected, it failed because the tire rods as well as the tired was shot, and there was a slew of other issues totaling almost 4, 000 in repairs in order for them to pass it. I had to take the car back to Auto Holdings where they had the vehicle for a month getting the parts that was needed for the car to pass inspection. Shortly after getting the car back, I had a conversation with a manager in regards to getting the car repaired because as Audi said on the invoice from the diagnostic, the car was tripping codes. I went ahead and paid for the various items thinking that it will be fixed, but it has been one thing after another with the car. At this point, I do not know what to do as the car has not been driven in over a month, because I do not want to continue to erode what was already wrong with the car. I thought that I would have a decent car, and not have all of the stress related to purchasing a car, as it stands, I just want Auto Holdings to compensate me for the damaged vehicle. I am in the process of looking into purchasing a new car, but I cannot get a decent price for the car with all of the issues that the vehicle has.

We have spoke to the client and had resolved the issue. She traded the vehicle to another dealer as per our salesperson. She requested a refunded for the warranty purchased, and we notified the bank to do so. She has not contacted us directly since which leads us to assume all issues have been...
resolved. Should that not be the case, we look forward to communicating with the client to ensure this dispute is resolved immediately.
With all due respect, you are being unreasonable. The Owner, myself, and all related to this sale are fully aware of everything. The problem is that you cannot agree with the fact that your trade in that we sold and even provided your attorney with a copy of that bill of sale did not cover all the negative equity you had in that vehicle. The title to the [redacted] you purchased was without any defects or issues. A copy of which everyone saw. That vehicle was purchased directly from [redacted], not some tiny third party vender. We offered to get you out of that vehicle, which as you can tell is in outstanding condition, but that is besides the point. We offer you to choose from any identical type of car and an extended warranty on top. You requested a newer model worth significantly more. We then offered to completely terminate the transaction, take the car back, cover all related expenses. However you demanded we cover the thousands of dollars of negative equity you had due to your trade. Why would we ever want to create a headache for someone? Besides the fact that would be without moral, it would not be good for business by any means. So when you type that we "fraudulently obtained a loan" it makes it all but impossible to resolve this matter. We want to get this resolved for you to the best of our ability, but we need you to be nothing more than fair and reasonable. Until that happens, we will keep going back and forth. The only thing more important than health and money is time. Let's get this squared away and move on to use the time we waste disagreeing on something more positive and enjoyable.

I am rejecting this response because:
I am already in a financial bind having a vehicle that is deemed not safe, or road ready, As to add insult to injury, I was just notified that the tires that this establishment placed on my vehicle just last year July, 2014 were worn down and in need of new front tires, this is a result of Auto Holdings failing to align the tires when the vehicle was originally sent back to Auto Holdings when the vehicle first failed inspection in 2014. I was not prepared to be looking into getting another loan so soon after buying this vehicle. I am also not 100 percent sure that getting another vehicle off your lot will not place me in a similar demise. My original offer was to be refunded my original down payment which was a total of 3,500.00. Understand, I am fully aware that getting the truck in better working condition may take more than what I am asking to be considered safe, and within ** code for road safety. Please consider my offer, and understand that if this agreement is met, I will rescind my original dispute and place it in a satisfactory status.

I am rejecting this response because: I dispute much of your misrepresentation regarding the scheme that your business has attempted to play on me. You intentionally sold a vehicle knowing that it had no value since it was a salvage which your General Manager, Tony R, confirmed your company was aware of since it had been declared by an insurance company as a total loss. This can only mean that the vehicle was stolen and therefore the insurance company claim it as a total loss. Since this is your business and you should be aware that a vehicle previously claimed as a total loss by insurance company will be declared a salvage by the State of New Jersey and therefore cannot be register, you clearly had every intention of selling a vehicle with no value that could not be register. It is very simple how the scheme works. You buy a vehicle that you are aware cannot be register to a unsuspected buyer for an amount that is "below the market value". The buyer purchases the vehicle, then a few days or weeks later, the buyer gets a call from the dealership claiming that there is something wrong with the title to the vehicle and the vehicle must be return to the dealership. This is where the scheme comes along, now the buyer, not know what to do, will bring the vehicle to the dealership where the buyer is now told that the dealership has another vehicle for him but the value is substantially more than the salvage vehicle. The buyer will then purchase another vehicle that can be register for a greater amount that the salvage vehicle. This is exactly what you and your dealership attempted to do with me. Not only did I trade in my former vehicle, which I acknowledge had negative equity, however, you dealership immediately sold the vehicle for substantially more than the value that you place on it when you bought it from me, thus making a $8000 profit on my vehicle, which by the way wiped out any negative equity my vehicle had. I, unlike your dealership, entered this contract with nothing more than good faith and good intention. You instead sold me a vehicle without any value that cannot be register or insure and stole my trade in, for which you made a profit wiping away any negative equity I had. Consequently, the newer model was chosen because it is worth around the $29,000, what I owed the bank after being defrauded by your dealership. Your business expects me to roll over on this matter, for what can only be described as criminal behavior and enterprise. I can promise you, I will not. What you fail to comprehend, is that your business alone is accountable and liable, since clearly you had enough knowledge that this vehicle was not marketable. What you need to understand is that this is your job, you know every detail about the product prior to you selling it to the consumer, who happens to be a lay person. I have been more than reasonable in my attempts to resolve this matter without litigation. Consequently, my terms are reasonable given the damages I have suffered. I will accept a vehicle with a market value of $29,000 or a full refund of $29,000. Please be advised that if a resolution is not reached by the end of this week. I will be filing a formal complaint with the NJ Federal trade commission and/ or NJ Consumer Affairs, where a thorough investigation will be conducted on this matter and on the day to day operations of your dealership to make sure this does not happen to any other unsuspecting consumers. I will also be proceeding with both civil and criminal action in this matter given the above.

I am rejecting this response because:
I was told by the saleman there was NOTHING wrong with the vehicle and everything worked. That is NOT the case. The key and Key fob will be mailed out tomorrow to Auto Holding. The car did NOT pass inspection! All the vehicles are suppose to pass inspection... this one did NOT because of the back brakes. They were Not truthful when selling this car.Nothing was stated as is!

Thank you for your service and we will leave it up to the attorneys to resolve this.

I am rejecting this response because:As I mentioned previously, I was not made aware of dealer fees being added to the purchase price of $49,995. There were other complaints made by other customers regarding fees being added after negotiations. All of us did not misunderstand. They mentioned reducing the total price but did not specify the amount of the reduction or provide any detail. Does this entail removing the $3,500 of dealer fees as well as reducing the price of the vehicle? I would like them to be clear in their offered resolution.

I am rejecting this response because: This was fraudulent transaction due to that...
fact that the dealership sold me a vehicle with a defected title and zero value in the vehicle. To my detriment I am now indebted in the sum of $29,000 with a vehicle that has no value. This is why I am requesting a full refund in the amount of $29,000. In their communication with my attorney a full refund of $29,000 was never offered.

No water which way we try to explain it comes to no avail. Please stop in at your convenience so that we can go over everything in person.Thank you.
Please note that we always send the buyer a refund of the dmv fees minus actual cost and broker transaction charge. Whatever that amount adds to, will be mailed to the buyer if it hasn't already been done so. The vehicle itself was sold as-is with no guarantees from our dealership. We often offer...
the buyer an option to purchase the vehicle with a dealer warranty or as-is. This was requested to be an as-is sale. As for the key not working, please send it our way, we will confirm the defect and fix it or refund the money for it. Should you have any other questions or requests, please contact us anytime.

I am rejecting this response because:
Yes, after 14 days of possessing a vehicle I could not legally drive, the paperwork was finally received today. HOWEVER I am awaiting a reply regarding a refund of fees in the amount of $847.88 charged by [redacted] for registration & document fees. As they were unable to complete the transaction as promised (plus the fact that I now have to take time off from work to complete this deal) I don't feel I should pay for a service they were unable to deliver.

We are not going to accept the requested down payment refund. If you do not wish to purchase another vehicle from us, that is absolutely fine. We are still willing to buy back your vehicle at a fair price to both parties.
[A default letter is provided here which indicates your acceptance of the business's response. If you wish, you may update it before sending it.]
Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me.
After further discussion Auto Holding agreed to remove the total amount that was in dispute and I purchased the car. I am satisfied with the resolution.
