My Original creditor was *** which I had loan with but wasn’t accurate, due to multiple complaints and law suits they became ***. Both accounts were deleted from my credit report due to 7.5 years of limitations but Jefferson Capital did not attempt to contact me to allow me to dispute this account for $2976.00 and refused to delete from report after multiple disputes. Also the dates and information they have listed are incorrect. I request Jefferson Capital system verify 1) Original account number 2)Date Original account was opened 3)full account summary and intemized calculations of alleged debt 4) dates of first delinquencies.5) dates and times of any phone calls made and to what number in attempt to contact me about the alleged debt before it was reported to credit bureaus governed by the FDCPA law. If Jefferson Capital System is unable to provide me with above identification this account should be removed from all credit bureaus

Jefferson Capital put collection on my credit reports without my knowledge and in doing so, this violated the FDCPA Collection Practice by placing a collection account on my credit report without sending a letter to me.

I request that Jefferson Capitol verify the following information.
1. Full original Account Number
2. Date original Account was opened
3. Any written agreements between myself and the original creditor stating this debt is owed
4. Full account summary and itemized calculation of alleged debt
5. Date of the first delinquency
6. Dates and times of any phone calls made and to what number in attempt to contact me concerning the alleged debt before it was reported to an agency, and so proving that these calls were made in the times governed by FDCPA law.

If Jefferson Capital Systems is unable to provide the above identifying account information, this account must be deleted from all CRAs.

Jefferson Capital Systems also failed to follow FDCPA by not sending a letter giving the consumer time to dispute or validate the alleged debt within the allowed 30-day time frame that is allowed by law.

Dear Ms.:

We are in receipt of your correspondence sent on behalf of Carlos ***.

This letter will confirm that on April 22, 2019 we have responded directly to Mr. via regular mail to attempt to resolve this matter. Mr. should allow 7-10 days to receive our response.

Thank you for the opportunity to be of service.

In February 2019, Jefferson Capital Systems LLC sent me a collection letter stating that I owed a past due balance of over $11, 000 reference ***. I do not have a contract with Jefferson Capital Systems LLC with this account number, and exercised my rights according to the letter received and stated that I was disputing a debt with their company, and requested them to validate the debt. This request was sent via USPS certified mail (tracking ***), which shows that it was delivered on 2/12/19 at 9:03 AM and left with an individual. I requested a detailed accounting of what the money was owed for, a detailed explanation of how they calculated the amount owed, copies of any documents that showed that I agreed to pay them the amount that they said I owed, to identify the original creditor and provide their current contact information, documentation showing that they have the legal right to collect in my state of Virginia, and to provide me with the contact information for their Registered Agent for Service of Process. On 4/8/19, I received another collection letter dated 4/4/19 showing an account balance of $11, 286.01, with a demand to now pay $5760.50 by 4/14/19, stating in all caps that it was the LAST DAY FOR PAYMENT. The letter goes on to state that if I pay the amount now due by the last day for payment, that I may continue with the contract as though I were not late. As of this date, 4/9/19, they still have not responded to my request to validate the debt or provide with any detailed information in regards to this amount claimed that I owe them. The letter also states that if I do not pay by that date, Jefferson Capital Systems LLC may exercise their rights under the law, to include the right to repossess any property held as collateral for this transaction and the right, in many instances, to hold me personally responsible for any difference between the amount the property brings in a sale and the balance due to us on the credit transaction in question. The last line of the letter states that if I am late again in making my payments, they may exercise their right without sending me another notice like this one. How can a company, with whom I didn't enter a contract and didn't respond to my request in validating this debt, threaten me with action if they failed to follow FDCPA by not responding to my request to validate an alleged debt with their company? I also can't find any verification of any registration for Jefferson Capital Systems in the state of Virginia.

Jefferson Capital Systems Response • May 20, 2019

On May 3, 2019, we mailed our response to the Revdex.com as there was no CID number listed on your website for this complaint. Attached please find a copy of our response.

I had disputed this information with the credit reporting agencies because I never got a letter informing me that I had a balance. I'm actually with *** now so I do not understand how this collections was made. I did not get any calls about this account or a response to my debt validation request. I would like this account removed from my credit I do not owe this debt.

This company has placed two collection items on my CR and has never sent any type of documentation regarding this. My ssn is listed as *** , I have no account numbers because I’ve neber received any communication from this company. Numerous letters have been sent requesting verification of these debts, and they have gone unanswered.

If the above mentioned information cannot be verified, your collection must be deleted from all 3 credit reporting agencies. If this email not met with success, I will have to move on to other avenues to report these violations, such as a FTC complaint. I truly hope we can resolve this issue quickly.

Jefferson Capital has listed a false collection on my credit report that does not belong to me. I requested that they validate the account and they could not provide me any type of proof. No original contract or signature, nothing that proves this is my account. I know it’s not mine because I did not open the account.

I had no knowledge of Jefferson Capital Systems until they appeared on my credit report. I submitted a complaint with *** and Jefferson Capital Claims they purchased an account from *** but sent no information verifying or validating the debt. I called them regarding the account and they said they would fax me a settlement offer and also mail it and I never received it. I did not admit the debt as it is not validated but I am in the process of purchasing a home and this is adversely affecting that progress. I had no warning before they put this collection on my credit and received no communication from them. They did not prove this debt is mine nor did they prove I'm liable to pay them. This is unfair business practice and I'm sure my right and laws have been violated.

On February 12, 2019 Jefferson Capital Systems received my certified letter requesting validation of account they are attempting to collect on ***. They never responded. Under the Texas Finance Code the debt collection agency has thirty (30) calendar days to respond to a debt validation request. All debt collectors operating in the State of Texas must be able to verify, or "validate," any debt on which they are attempting to collect payment. Texas Finance Code Section 392.202 requires a debt collection agency or credit bureau to provide the alleged debtor with specific information concerning their debt including but not limited to: The name of the original creditor the original date of default or non-payment of the debt the date the debt was transferred from the original creditor to the third party debt collector The original balance The current balance Surety bond information respond or did not respond in time. If a debt collector has failed to respond to your debt validation request, then they have essentially admitted, per Texas Finance Code 392.202(b)(2), that the debt in question is inaccurate. As such, all collection efforts on the debt must cease and any derogatory listing should be permanently removed from any consumer credit reports. As of March 30, 2019 I still have not heard from them. Under state and federal law I could sue them and ask for thousands. However, I would like to make every effort to resolve this matter amicably without presenting this case in court before a jury in my community. If they delete the account and cease reporting to the bureaus I will consider this matter resolved.

Re: Addaris *** / ID# ***

Dear Ms.:

We are in receipt of your additional correspondence sent on behalf of Addaris *** concerning the above-referenced account.

This letter will confirm we responded to Addaris ***’s previous complaint with a letter sent directly to him via U.S. mail on April 10, 2019. Included with that letter were the last payment statement and final billing statement from Verizon Wireless that we provided as validation of the debt. The address on those statements matched the address provided by Addaris *** on the original Revdex.com complaint. We also advised that we had notified the credit bureaus that the account was disputed.

Thank you for the opportunity to be of service.

Been trying to get this issue resolved. Called multiple times trying to validate a false Debt on my cr report. Was told that they would email me and mail information. Account was not mine and open by fraud. They are playing games on my credit report on my dime. Was sent a offer to resolve and when I called about it they said it was not true. This is how I found out about this fraud account. It's been going on way to long.
