This is being written in response to Revdex.com Complaint ID * *** Claimant filed a claim with GAF in October, 2014. GAF requested additional information in order to fully investigate the claim, specifically, photographs and samples of the affected shingles. This requirement is
expressly set forth in the Limited Warranty on GAF Materials Corporation Fiberglass Asphalt Shingles in effect in when the subject shingles were installed. This practice is standard in the roofing industry, and the reason for the requirement is two-fold. GAF must identify the product at issue and confirm that it is, in fact, a GAF product. Additionally, GAF must examine the shingles to determine whether the shingles suffer from a manufacturing defect. Without the shingles, GAF cannot conduct a thorough investigation, nor determine whether the product in question has failed to perform as intended due to a manufacturing defect. Claimant suggests that her roofer's statements concerning the condition of the shingles should be sufficient. Please understand that many factors can reduce the useful life of roofing shingles. The quality of the installation, construction details of the house (such as proper ventilation and decking materials), weather conditions, etccan all adversely affect the performance of roofing shingles. Claimant has not provided any evidence to support a claim for defective manufacture. As a result, no relief can be provided

Please see GAF response below for Complaint ID ***. This homeowner did not transfer the warranty when the home was purchased.The GAF limited warranty for roofing shingles installed after January 1, allows a one-time transfer to the second owner, provided we are notified in
writing within days of the sale of the property. Unfortunately, due to the fact that you were not the original owner at the time the roofing shingles were installed and that we did not receive written notification of the limited warranty transfer, we are unable to process your claimPlease be advised that the transfer information is found in our limited warranties and is also printed on every bundle of our shingles. We hope this information is helpful and explains our position in this matter

This is being written in response to Revdex.com Claim # ***. GAF approved this claim for settlement. GAF settled this claim per the terms and conditions of our Limited Warranty. The settlement amount was not pro-rated and the claimant received the maximum settlement allowed
under the applicable warranty. Claimant is seeking compensation above and beyond the terms and conditions of their warranty. GAF is honoring all obligations under the Limited Warranty

This is being written in response to Revdex.com Claim ID # *** The complaint pertains to a claim filed pursuant to a Class Action Settlement Agreement reached in the matter of In re: Building Materials Corpof America Asphalt Roofing Shingle Products Liability Litigation. Complaint
is that they do not believe they should have to submit certain requested information, specifically, roof plane photos
Based on the information contained in the claim file, the claim must be processed pursuant to the terms of the Class Action Settlement Agreement approved by the Court in the above referenced multi-district litigation (the "Settlement Agreement")The Settlement Agreement, which was fully vetted by the Court prior to receiving final approval, includes detailed handling procedures and claim requirements, all of which apply to the claim in question. Section of the Settlement Agreement provides detailed claim requirements, which claimants are obligated to meet in order to be eligible for compensation. Specifically, Section (d) (iii) states: The Claim Kit will require a Settlement Class member to provide......photographs to demonstrate the condition of the shingles that are sufficient to establish the condition of the roof and Timberline Shingles of sufficient detail and quality to allow GAF to evaluate whether and how many of the shingles qualify as damaged under the Agreement and to determine the nature and extent of any affected areas, specifically....(a) minimum of two photographs of each roof plane showing the condition of the plane and the condition of the shingles. Such photographs should include clopictures of the problem
The photographs submitted for this claim were not sufficient to meet this requirement. While GAF regrets that this claimant is not satisfied, GAF is bound to comply with all of the claim handling procedures and claim requirements set forth in the Court approved Settlement Agreement. If the claimant disagrees with the outcome of their claim, there is a process in the Settlement Agreement to have a neutral third party known as "The Special Master" resolve disagreements with GAF. This is being written in response to Revdex.com Complaint ID # ***. A claim was initiated by *** *** *** on 3/29/16. That claim was closed on 12/21/due to inactivity. GAF did not receive any submittals or correspondence during that time frame. We have spoken with the
claimant and have agreed to re-open their original claim. GAF obtained the claimant's email address and sent the Claim Acknowledgment Letter along with the Claim Kit via email and regular mail today

In reference to ID # *** This claim was denied due to an absence of evidence to support a claim against the warranty. The photographs submitted do not show evidence of a manufacturing defect. We have spoken with the claimant and requested that the claim be re-submitted
with any additional evidence to support a claim. At that point, the claim will be re-evaluated. We hope this was helpful

This is being written in response to Revdex.com Complaint ID # [redacted].  Claimant is requesting a GAF inspection of his roof to identify any workmanship defects with the installation.  GAF has agreed to accommodate this request.  A GAF Inspector was dispatched to the site and has inspected...

the roof.  His report is forthcoming and the GAF Master Elite Contractor will be instructed to make any necessary repairs.  We hope these steps have satisfied the claimant's request for an inspection from GAF.

I am in receipt of Revdex.com Complaint ID [redacted] relating to the above-referenced consumer complaint filed by [redacted] concerning a claim she filed pursuant to a Class Action Settlement Agreement reached in the matter of In re: Building Materials Corp. of America Asphalt Roofing Shingle Products...

Liability Litigation, MDL No. 8:11-mn-0200 (D.S.C.). Ms. [redacted]s complaint is that she cannot provide the shingle sample requested by GAF because she has undertaken repairs to her roof. 
Based on the information contained within Ms. [redacted]s claim file, GAF has determined that her claim must be processed pursuant to the terms of the Settlement Agreements approved by the Court in the above-referenced multi-district litigation (the “Settlement Agreements”). More information about the Settlement Agreements can be found at [redacted]. The Settlement Agreements, which were fully vetted by the Court prior to receiving final approval, include detailed handling procedures and claim requirements, all of which apply to Ms. [redacted]'s claim. Section 7.4 of the Settlement Agreements specifies all of the documents and evidence needed to support a claim. While GAF recognizes that Ms. [redacted] has complied with  some of the claim requirements, she did not submit the shingle sample as required by Section 7.4(g). Therefore, at this point in time, Ms. [redacted]s claim remains pending. If Ms. [redacted] is not able to submit the required shingle sample as set forth in the Settlement Agreements, GAF will not be able to evaluate her claim. While GAF regrets that Ms. [redacted] is not satisfied, GAF is bound to comply with all of the claims handling procedures and claims requirements set forth in the Court approved Settlement Agreements. This is being written in response to Revdex.com Complaint ID # [redacted].  GAF has sent an offer of settlement to the homeowner.  This claim has been approved and the settlement offer is based on the terms and conditions of the GAF Limited Warranty.

This is being written in response to Revdex.com Complaint ID [redacted].  The 2002 GAF Golden Pledge Limited Warranty (the warranty purchased by claimant) expressly states the following: ("Warranty Term - Warranty Coverage against manufacturing defects extends to the end of the warranty term...

stated below.  Warranty coverage for misapplication, wind damage, and failure to seal lasts for the first twelve years after application (the Full Protection Period"). 
Coverage for misapplication had expired when the claim was submitted.  Claimant was notified that the workmanship provision in his warranty had expired and was urged to contact GAF with any questions or concerns.  Based on the language in the complaint, the claimant seems to think he has no recourse.  Please be assured, the Golden Pledge Limited Warranty is still in full force and effect for manufacturing defects on the GAF products on the claimant's roof.  Claimant may still file a defective manufacturing claim for the GAF roofing materials.  All terms, conditions and requirements of claimant's warranty remain in effect.

The photos sent have been reviewed and are not sufficient evidence to support this claim.  There appears to be confusion regarding the submission of photographic evidence.  The claimant is more than welcome to send any additional photographic evidence to [redacted].  We will gladly review any photos sent.  If the claimant is not satisfied with the outcome of the claim investigation, he can file an appeal with the aforementioned "Special Master", an independent third party who has been designated to review and resolve disputed claims.

This is being written in response to Revdex.com Complaint ID [redacted].  Claimant originally contacted GAF to open a claim on 11/10/2010.  That claim was closed, two years later, on 10/8/2012, due to inactivity, as GAF had not received any of the required submittals or evidence to support a...

warranty claim.  Claimant opened a second claim on 4/29/2015.  GAF approved the claim for settlement and an offer was sent to the claimant.  The offer was then increased due to GAF back-dating the settlement calculation to the date of the original (inactive) claim.  This was done as a courtesy to the claimant.  As a result of this adjustment, the offer of settlement was increased from $322.50 to 487.50.  Claimant is demanding compensation that far exceeds the amount due under the warranty.  A copy of the applicable warranty has been attached for your reference.  GAF has fulfilled all obligations under the limited warranty.

not trying to determine the coverage of my warranty. I can read that for myself. I am asking GAF to make a legal determination as to whether or not your subcontractor [redacted] CONSTRUCTION made a false representation of your product warranty. For example, you can say "The representation made by [redacted] Construction as quoted in this complaint to the Revdex.com is a false representation."This probably requires you to consult your legal counsel and upper management, and contact [redacted] Construction to investigate before answering.

I have reviewed the response made by the business in reference to complaint ID [redacted],The business (GAF) agreed to resolve the issue by sending the roofer again.I have not contacted by the roofer yet, but I look forward to seeing them soon.If it's the same roofer who took care of the back of the house, they already know what is required to fix the front side of the roof.

This is being written in response to Revdex.com Complaint ID [redacted].  Per the terms and conditions of the GAF Limited Warranty, on March 19, 2013, GAF made a settlement offer of (1) 26 Squares of Timberline HD Shingles OR (2) a cash allowance of $1040.00 (One Thousand and Forty...

Dollars).  In an effort to both compromise and accommodate the claimant, GAF increased the offer, on June 13, 2013 to an all cash settlement of $3000.00 (Three Thousand Dollars).  This offer is not an admission of liability.  It is being done in an effort to amicably resolve this disputed claim.  GAF has gone well above and beyond all warranty obligations in an effort to resolve this matter.  It is unfortunate that the claimant remains dissatisfied.
