I then contacted the contractor who arrived at my house to take pictures in addition to the pictures I sent them initially, and removed one shingle and replaced it with a new one to not leave a exposed piece of roof. I completed all the information on the kit and the contractor company sent everything back to you.

This is being written in response to Revdex.com Complaint ID # ***. The homeowner contacted GAF to report a claim as some of the shingles on the hips of the roof had been displaced during Hurricane Irma. Upon receipt of his claim, GAF contacted the installing contractor to notify them that
the claim had been reported and that repairs were necessary. The contractor has arranged to have someone go out to the site today to address the homeowner's concerns. The contractor explained that the delay was the result of their being adversely affected by the storm (they lost power, employees suffered damage to their homes, etc). Additionally, they were inundated with calls from homeowners that were experiencing severe leaks and damage to property. The repairs were prioritized based on the severity of the damage. That said, the contractor will be at the site today. We hope the homeowner will understand that it was not "business as usual" for the roofers in light of the historic storm and resulting damage. With regards to the issues the homeowner had reaching GAF, we were unable to confirm the number he was calling, but we could not replicate the problem. Naturally, after such a devastating weather event, we were receiving many calls from the affected states. It's possible that our "hold" time was a little longer than usual, but the phones were operational and there were no disruptions to service

in contract negotiations between homeowners and roofing contractors. Additionally, GAF does not, as a rule, sell shingles directly to homeowners. Sales are conducted through distribution channels. This complaint does not draw a distinction between the manufacturer (GAF) and the installer (*** ***). The contract she is referring to is her contract with *** ***, not her warranty with GAF. All complaints or discussions pertaining to what products the claimant was sold, should be conducted with the installing contractor or distributor. GAF did not sell these shingles to this homeowner nor were we aware of the purchase at the time of sale. There was simply no opportunity for GAF to advise this homeowner that the product she purchased may not have been algae resistant. We hope the above paragraph adequately addresses the questions regarding why the claimant was not informed, by GAF, that her shingles were not algae resistant. The remaining open item is the GAF offer of settlement. It should be noted that, at the time of warranty registration, GAF was not advised that there were algae resistant shingles on the claimant’s roof. In 2016, when the claimant provided proof of purchase to support her claim, she sent us a “contract amendment/change order” that references the need for a product with algae eater protection. At that point, GAF, as a matter of customer goodwill, accepted that document as proof that the shingles were algae resistant. In fact, we do not know if the shingles are algae resistant. That said, GAF honored the terms and conditions of the warranty in effect for algae coverage and provided claimant with a settlement that is in strict accordance with the warranty's provisions. There is no breach on the part of GAF

the roof that was allowing water to leak into the house. Additionally, our inspector observed a damaged gable vent and solar panels bolted through the shingles. Any issues resulting from damage caused by "impact of foreign objects" are expressly excluded from warranty coverage. Our inspector noted and photographed a hole through the roofing shingles as well as other penetrations that could adversely affect the performance of the roofing shinglesAs a result, the claim was denied. On 1/25/2016, the homeowner contacted GAF to re-open this claim. In response, GAF is sending an inspector to the home to perform another inspection to determine the cause of this newly reported leak

During the claim intake process, the claimant’s representative stated that the shingles were brittle or “crunchy”. The claim was opened and the claim procedures for brittle material were followed. Upon receipt of the shingle samples, GAF discovered that the claimant was an eligible class member under the ***e Class Action parameters. As a result of this discovery, the claim process and corresponding requirements had to be modified to meet the criteria for claims that fall under the class action.
It is not always possible to identify the shingle type, date of manufacture or manufacturing plant during claim intake. The nature of the reported problem is often generic as well. We are better able to assess the nature of the problem, along with the shingle type, after we’ve evaluated the shingle samples and reviewed the submitted claim documents. In this particular case, the information uncovered during our claim analysis revealed that this claim had to be re-classified. As a result, we require additional information to conduct a thorough investigation and ensure that our findings are accurate

Section of the Settlement Agreement provides detailed claim requirements, which claimants are obligated to meet in order to be eligible for compensation. While it is regrettable that the claimant is not satisfied with GAF's offer of settlement, there is no breach on GAF's part. We have honored our warranty obligations. There were other, less expensive remedies, such as hand-sealing the affected shingles, but GAF provided this claimant with the maximum warranty claim benefit. The settlement is not-prorated and includes a Labor provision for the installation of replacement shingles. Claimant is requesting compensation that exceeds the terms and conditions of the GAF Limited Warranty

The business is covering the shingles but isn't covering the labor costsThey requested several quotes from a couple business in our area and the amount they approving is only a fraction of the total labor costsI don't feel it is my responsibility to cover excess costsThe reason we are having to redo the work is because their shingles were faulty in the first placeMe and my family should not be out of pocket any expenses due to faulty supplies.

I am rejecting this response because:The amount offered by GAF doesn't cover the cost of materials to replace their defective shingles The amount I have ask to be reimbursed doesn't even cover the total amount of repairs that was done to my home I have attached pictures of the damage to my home because of their defective shingles I have also attached pictures of the defective shinglesI do not believe GAF would have offered me a settlement if thee shingles were not defective and they clearly admitted they did My home was barely years old when the roof began to leakIt would seem to me a product that had a year warranty would last longer than years and when it failed to last it the company would stand by the warranty and replace their defective products which they did not Yes, I filed a claim that was later closed because as a single mother of three children I could not afford to have the shingles taken off, then new ones to replace the ones that had to be taken off, nor could I afford to have a contractor give me an estimate on what it would cost to have the shingles replaced, which is what GAF required of me before they would process the claim Once I could afford what GAF required of me I submitted the claim To have them refuse to reimburse me for the materials

While it is regrettable that the claimant is not satisfied with GAF's offer of settlement, there is no breach on GAF's part. We have honored our warranty obligations. There were other, less expensive remedies, such as hand-sealing the affected shingles, but GAF provided this claimant with the maximum warranty claim benefit. The settlement is not-prorated and includes a Labor provision for the installation of replacement shingles. Claimant is requesting compensation that exceeds the terms and conditions of the GAF Limited Warranty
